HomeMy Public PortalAbout2008-34 Coastal Systems International, IncRESOLUTION NO. 2008-34 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AUTHORIZING THE FURTHER PROCUREMENT OF ENGINEERING SERVICES FOR THE VILLAGE OF KEY BISCAYNE, FROM THE FIRM OF COASTAL SYSTEMS INTERNATIONAL, INC.; PROVIDING FOR APPROVAL OF WORK AUTHORIZATION CONCERNING MONITORING OF SEAGRASS MITIGATION; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR EFFECTIVE DATE. WHEREAS, pursuant to a contractual agreement previously entered into between the Village of Key Biscayne and Coastal Systems International, Inc. (the "Engineer"), the Engineer has been retained by the Village in connection with services needed for the Village of Key Biscayne Beach Renourishment Projects; and WHEREAS, the Engineer, pursuant to its continuing contract, has proposed to perform certain seagrass monitoring and reporting services for the Village upon completion of seagrass restoration work to be performed by CSA International, Inc.; and WHEREAS, the Village Council finds that it is in the best interest of the Village to utilize the Engineer for the purpose of monitoring the seagrass restoration and reporting thereon, as described in the attached Work Authorization and proposal. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Section 1. Recitals Adopted. That each of the recitals stated above is hereby adopted and confirmed. Section 2. Work Authorized. That pursuant to the existing continuing contract between the Engineer and the Village, the performance of seagrass monitoring services and reporting thereon, as described in the Work Authorization and proposal attached hereto, is hereby approved. Section 3. Agreement Approved. That the Village Manager is hereby authorized to execute the Work Authorization in substantially the form attached hereto, for the engineering work authorized hereunder between the Village and the Engineer, once approved by the Village Attorney as to form and legal sufficiency. Section 4. Implementation. That the Village Manager is hereby authorized to take any necessary action to implement the purposes of this Resolution and the attached Work Authorization and proposal. (Coastal Systems) is pleased to present this proposal for consulting services relative to seagrass mitigation monitoring for the Village of Key Biscayne (Village). The following parts describe the scope of work to be performed by Coastal Systems and present the terms of agreement between Coastal Systems and the Village: PART 32 — SEAGRASS MITIGATION MONITORING Coastal Systems will monitor the success of the seagrass mitigation project described in the "Seagrass Restoration and Mitigation Plan: Village of Key Biscayne" recently issued in draft format by CSA International, Inc. This draft mitigation plan is still pending regulatory agency approval. Any amendments of scope, such as requirement to monitor seagrass donor sites, required upon agency authorization of the final plan or based upon as -built seagrass mitigation project conditions or other external factors will be addressed as an amendment to this scope. The Florida Department of Environmental Protection (DEP) Permit Modification No. 016086- 010 -EM requires 1.26 acres of off -site seagrass mitigation and an additional 0.07 acres of off -site mitigation is recommended in lieu of on -site mitigation within the pipeline corridor. The draft mitigation plan consists of restoration of 192 sites within 4 areas covering an area of 1.338 acres. Specifically, seagrass mitigation monitoring is anticipated to assess the success of transplantation efforts and natural re -colonization of seagrass at approximately 5% of the mitigation sites. The monitoring will consist of an assessment using a modified Braun-Blanquet technique to document the community composition and percent cover of seagrass within the off -site mitigation areas and background reference areas. Qualitative still photos and video data will also be collected to document mitigation site conditions. Twelve (12) monitoring events are included in this scope of services (see attached Table 1), following the time "zero" post -construction report, on a quarterly basis for Year 1 and a bi- Coastal, Environmental, Civil Engineering and Management 135040.01 Mr. Armando Nunez July 2, 2008 Page 2 annual basis for Years 2 through 5. Reports summarizing the seagrass mitigation monitoring data will be submitted to the DEP, U.S. Army Corps of Engineers, and Miami -Dade County Department of Environmental Resources Management for their files. Any additional discussion or negotiation required with the regulatory agencies regarding permit compliance will be addressed under a separate general administration scope of services. GENERAL Estimated fees and expenses are summarized in the attached Table 1. This fee proposal is valid for sixty (60) days. These services will be provided as an addendum to Coastal Systems' agreement dated August 1, 2006. Coastal Systems is not responsible for circumstances beyond our immediate control, including but not limited to, rule or legal interpretation changes, Client or agency staff delays, physical site impacts, additional coordination with regulatory agencies, additional agency mitigation monitoring requirements, litigation or other legal actions.
