Norris, H. Bayer, W. Schempf, E. Fortini. ALSO PRESENTS P. J. Waldock, Village Planner L. Pelhlke, Acting Secretary Chairman Sobkoviak called the meeting to order at 7:00 p.m. Roll call was taken. Chairman Sobkoviak declared the minutes of the May 19, 1992 meeting approved. OLD BUSINESS: None. NEW BUSINESSS CASE NO. 351-060592 SBV OWNER: Joseph and Janice Ray. REQUEST: Setback Variance for a six foot screening fence. LOCATION: 307 North Willow Drive West. Mr. Waldock summarized his report as follows: The applicants have constructed a swimming pool in the rear yard of their home at 307 N. Willow Drive West. As part of this improvement, they also desire a six (6) ft. screening fence to enclose the rear yard and pool. As shown on the diagram, it would have a setback of twenty (20) ft. from Sandbank Drive West. The site is a corner lot, and six foot tall fences, require a thirty (30) foot setback. This variance would result in a ten (10) foot deviation from the required setback. The fence parallels the property line, the lot is unusually shaped, in that it is 99.74 feet wide at the front (along Willow Drive) and tapers down to 77.92 at the rear. Staff finds that the property shape is unique, due to it's tapered layout. Hardship in this case results from limited useable rear yard area, resulting from Village setback requirements for screening fences. The variation if approved would not be harmful to adjoining properties. Staff cited 2 previous cases, that the Plan Commission had granted variances for fences for corner lots. One on Joseph and Route 59 and one on Pheasant Chase and Route 59. The Pheasant Chase location, resulted in a five foot setback, and the Joseph Street location was a zero setback from Route 59. Staff therefore recommended approval of the variation request by Joseph and Janice Ray to allow a 6 foot screening fence at a 20 foot setback from Sandbank.
