CITY COUNCIL WORK MEETING
NOVEMBER 18, 2014 - 6:00 P.M.
IONA COMMUNITY CENTER
PRESENT: Council President Robyn Walker, Council Member Rob Geray, Council Member
Dan Gubler, Council Member Kathy McNamara, Public Works Director Zech Prouse, Building
Inspector Allen Eldridge, and Treasurer Amy Sullivan.
ABSENT: Mayor Brad Andersen, City Clerk Julie Hammond, and Animal Control Officer
Kayla Key.
VISITORS: None.
Robyn Walker, Acting Mayor opened meeting at 6:03 p.m.
Solid Waste Franchise
Council President Walker stated that the proposed code section for Solid Waste Hauler
Regulations was given to Council in September. She does not want to be in the business of
regulating services. Trash removal companies need to provide the City with evidence of
insurance; state and county already regulate trash haulers; and garbage trucks need to be
maintained so hydraulic oil, etc. is not on roadways.
Council Member Gubler would like to see limited road usage, establish regulations by code,
changing code as the city grows, also stating that regulation exists so that drivers cannot use
citizen's drive -ways for turn a rounds.
Public Works Director Prouse suggested scheduling a day, one day a week for all companies, to
limit days on roads. Council President Walker agreed with Director Prouse for a one day pick up
and to table proposed Solid Waste Hauler Code for some time in the new year to invite Attorney
Dale W. Storer and Haulers to a work meeting.
Council Member Rob Geray stated that we need to make sure we are not duplicating state codes.
Council Member Gubler stated that cities have to enforce laws/regulations because it's not
getting done by the state. Council Member Geray attended Association of Idaho Cities (AIC)
training last week sharing concerns that the state is looking for ways to receive funding for
public defense. A lot of cities are duplicating the state code in their own local city codes and in
duplication of this, say the violation of it is a misdemeanor. If it involves potential jail time, a
Public Defender may be needed. The state is underfunded in this area and if it's already in state
code, write the violation up in state code because then the state has to fund the public defense.
If we duplicate the state code in our codes and write up the violation then we are now on the
hook to fund the public defense and it gives the state ammunition to go after us for public
defense funding. AIC recommends getting rid of everything that really doesn't have to be a
misdemeanor and call it an infraction because there's no public defense involved in an infraction
since it's just a fine. This is to keep in mind as we go forward with code to not duplicate the
state's code.

When new Officer, Matt Lurker starts next month have him go through code and see everywhere
there's a misdemeanor. In council session schedule Solid Waste Franchise discussion to be
placed on Jan. work meeting agenda.
Cell Tower
Providing for a new code section for Iona City Code -all agreeing that it is needed. Cell Towers
are allowed by law but in code, city can identify where and in what zone. Council Members
concurred that overall there are just a few areas that need to be changed. The height of the tower
to be established. Council Member Geray to write comments of proposed code and send it on to
all Council Members, Mayor including Director Prouse and Building Inspector Allen Eldridge to
review.
Firearms
Council Member Gubler, we have no other verbiage than 11-11-18 that he could find.
Recommends removing the second sentence and reference state code. Prohibit firearms in the
City and define what a firearm is.
Council Member Geray, build code specific to our City and suggests visiting with our City
Attorney on this. Council Member Kathy McNamara stated there are already things in place.
Director Prouse suggests reviewing state code so that we are all on the same page with this.
Westmark CD Discussion
Treasurer Amy Sullivan stated the CD with Westmark Credit Union will mature Dec. 26th and to
roll it back in we could do an 11 month for 1.5% or 23 months for 1.6%. Council will make a
decision during City Council Meeting.
Reports
Building Inspector Allen Eldridge: Checked on Carbon Monoxide/Smoke Detectors for City
Building for safety especially with Preschool in building now. State of Idaho Building & Safety
suggest the devices that have a ten (10) year battery.
Director Prouse: Coliform MCL violation has been cleared.
On November 13`h the Sanitary Survey was completed with Department of
Environmental Quality (DEQ) with City Water System and there were no
violations.
Josh Williams approached Mayor Andersen and me about putting in a frost
free hydrant to water livestock on his property. His property is not annexed
into the City. It would also be a branched service coming off an existing line
that would then be servicing more than one customer off of one line.
Mr. Williams also stated that he would be watering a few livestock and last
week there were forty head of cattle on the property.
Code 8-2-37 through 8-2-39 explains this process.
Council Member Gubler suggested Mr.Williams annexes into City and at that time there would
be further discussion on providing water service.

Council Member Gubler: There are two new Fire Stations, one on 55th & Arco Hwy. and 4750
E. 65th S. off of Holmes.
Council President Walker: Would check into the shelving that was ordered for the library this
past summer.
Council Member Geray: Wi11 share some other highlights from AIC training last week at regular
City Council meeting.
