HomeMy Public PortalAbout01-15-1979 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, SERVING AS A BOARD IN CHARGE OF THE OPERATION OF THE RICHMOND POWER & LIGHT PLANT, JANUARY 15, 1979 1 The Common Council of the City of Richmond, Indiana, serving as a Board in 2 charge of the operation of the Richmond Power &' -Light Plant, met in regular 3 session January 15, 1979, at the hour of 7:00 p.m. in the Municipal Building 4 of said City. Councilman Ahaus presided with the following members present: 5 Messrs. Elstro, Williams, Austerman, Mills, Paust and Welch. Messrs. 6 Merchanthouse and Carter. The following business was had, to-wit: I 7 8 Councilman Williams moved to approve the minutes of the previous meeting as 9 prepared, seconded by Councilman Paust and on unanimous voice vote, the motion 10 was carried. 11 12 Councilman Welch stated he had examined the bills and they are not in balance 13 with the claims. Councilman Austerman nominated Councilman • 49 Welch for Vice Chairman of RP&L, seconded by Councilman Paust. Councilman 50 Mills moved .the nominations be closed, seconded by Councilman Paust and- on=_-- 51 • unanimous_voice vote, the motion was carried. Chairman Ahaus-announced Councilman 52 Welch_ is 'elected_.Vice. Chairman of RP&L Board by-.acclamation. Chairman Ahaus . 53 stated the.. Committees: will remain the same as last year. - - 54 55 City Attorney Ed Anderson examined proof of publication for one (1) automobile III56 and found it to:be in order. - Councilman Mills, moved to accept. and file the 57 proof-.of publication,-seconded by Councilman Welch and_ on -unanimous voice; vote, 58 - the motion was carried. - The following bids were received_and recorded: _ 59 - 60 • Bob Ross Buick - 1 Buick Century 44door $5920.02 61 _• - less trade-in of 1973' Ford- 500.00 62 .. . .. : $5420.02 RP&L Minutes Cont. Councilman Paust so moved, seconded by 11 Councilman Austerman- and on unanimous voice vote, the motion was carried. 12 13 General Manager Irving Huffman reported on the I&M refund that the Public 14 Service Commission has issued an order in wholesale rate tracking which will 15 refund customers on future use rather than in arrears. This is what RP&L 16 has in their case, so the Commission has gone contrary to one .of their own 17 rulings. Another factor is that the Commission wants the refund on a per. 18 . kilowatt hour usage over a time frame which involves two (2) different 19 settlement figures. The average .cost per kilowatt hour for a residential 20 customer is a higher figure than the average cost per kilowatt hour for 21 industrial•,' therefore, the major portion of the refund would go to industrial. 22 23 The way the refund was made by RP&L gave every customer. his share percentage 24 wise. It is Mr. Huffman's recommendation to not accept the Commission's order 25 and appeal to the Indiana Court of Appeals. Mr. Huffman presented=a motion 26 in writing that -authorization be given to the General Manager to engage the 27 firm of Haymaker, Hirsch & Fink to appeal to the Indiana Court of Appeals the 28 order of the Public Service Commission of Indiana issued in Cause No. 33780 29 on December 21, 1978 and also be authorized to negotiate -an effective settlement 30 if possible and practical,"-for RP&L. Councilman Williams so moved, seconded by 31 Councilman Paust and on a callof the roll the following was recorded: Ayes: 32 Elstro, Williams, Austerman, Mills, Paust, Welch and Ahaus. Noes.: None. 33 The vote being seven (7) to zero (0) in favor of passage of the motion. 34 35 City Attorney Ed Anderson presented a Dedication of Utility Easement 36 requesting the Board to authorize their Chairman to sign such easement. At 37 the time of construction of the new County Annex, RP&L relocated underground 38 facilities. No one could find the utility easements. The County Attorney . 39 requests the Board approve this easement and recite that this is the only . 40 easement to' the City of Richmond, Indiana and the Richmond Power & Light 41 in the city block, generally described in the City of Richmond, Indiana 42 bordereeby -Main Street on the North, South "A" Street on the south, South 43 5th Street on the west, and South 4th Street on the east. 44 , . 45 Following is the easement description: .being parts of Lots .numbered 14, 15, 46 . 18'a.nd 19, and two (2) vacated(-alleys, in the Original Plat of John Smith's 47 Addition to the City of Richmond, Wayne Township; Wayne County, Indiana, and 48 more particularly described as follows: beginning at a point in the east line 49 of South 4th Street, said point being south 5 degrees.; 21 minutes 45 seconds 50 west 348.13 feet from an Iron Rod, said Iron Rod being the southeast corner of 51 the intersection of South 4th Street and Main Street; thence-south 84 degrees 52 34 minutes east 95.17 feet to a point; thence south 62 degrees 04 minutes east. 53 51.0 feet 'to a point; thence south 84 degrees .34 minutes east 121. 76 feet to 54 a point in the west line of South 5th Street. Easement to be 8``:feet in equal 55 width on both sides of the above described centerline. 56 57 Councilman Austerman moved to suspend the rules and take a motion not in 58 writing, seconded'' by Councilman Paust and on unanimous voice vote, the11/ 59 motion was carried. 60 61 Councilman Austerman- move&to approve the easement and accept it as RP&L 62 easement in areas described, seconded by Councilman Paust and on a call==o-f 63 the roll the following was recorded: Ayes: Elstro, Williams, Austerman, 64 • Mills, Paust, Welch. and Ahaus. Noes: None.
