LOCKPORT STREET, SUITE 20G, PLAINFIELD 7:00 P.M. 1) CALL TO ORDER, ROLL CALL, PLEDGE a) Approval of Minutes of Workshop Meetings February 14, 2000 and March 13, 2000. 2) BOUNDARY AGREEMENT POLICY REVIEW. As we enter some initial phases of the Comprehensive Plan update, the Village Board may want to review its previous policy decisions regarding borders. Staff will be prepared to demonstrate visually the extent of our current border agreements with Joliet, Naperville and Bolingbrook. These agreements expire on January 1, 2005, November 16, 2007 and January $, 2116 respectively. The most pressing issue with existing agreements is the expiration date with Joliet. Recently, Mayor Rock contacted Mayor Schultz of Joliet to discuss a time extension of the present agreement. A copy of their response is attached. Joliet wants to annex north to Route 126. In May of 1999, the Village of Plainfield initiated some discussions with the Village of Oswego. These discussions have proved fruitless and no agreement exists. Developments in that northwest corridor will have significant innpact upon the Village of Plainfield, its other taxing jurisdictions, traffic, storm water control and commercial development. Recent contact with the City of Aurora has produced verbal consensus far a border generally along 111th Street. An actual written agreement has not been produced. Once a vision of our borders can be established by the Board and community, the Comprehensive Plan update and its community input process can assign broad development goals and guidelines. With these concepts in place, we can then plan and finance our infrastructure and operating needs. Growth management applications over the next 5 to 7 years will solidify the character of the community for many years to came. The policies adopted now will determine those growth management tools mast likely to achieve your vision. • 530 W. Minick will update the Board on the procedures and ordinances required to fund the new wastewater plant. Pursuant to earlier Board direction this new plant must be funded by "growth" revenues. Therefore, we are proposing an Alternate Bond Issue funded by developer sewer taps. Last yeax we increased the sewer taps and their collection procedures in anticipation of this bond issue. ~) ANY OTHER BUSINESS. Enclosed in the packets is a draft of the Ordinance to formally begin this process. This Ordinance authorizes the "Alternate Bond Proceedings," and begins the bond issuance process which will culminate with the approval of a bond ordinance and actual sale of bonds in the marketplace during this summer or early fall after construction bids are taken. The bonds to be issued are Alternate Revenue Bonds that require the Village to pledge funding sources to repay the bonds. The Village will be pledging its sales and utility tax revenues as the funding sources. The bonds also carry a property tax provision in the event that the funding sources pledged are not adequate to repay the bonds in a particular year. The Village is seeking authority to issue $18,000,000 in bonds to pay for the treatment plant. Even though we are pledging sales and utility tax revenues for the bond repayment, we will actually .make the bond payments from the water and sewer system revenues. Tap- on fees will fund approximately 70% and water rates will fund approximately 30% of the bond payments. We have pledged sales and utility taxes to make the bonds more attractive in the bond market. The Village Board recently increased the sewer tap-on fees to fund the construction of this plant. if the ordinance is acceptable to the Board at the workshop, Staff will be bringing forward the final ordinance at the meeting on April 17 for Board consideration. • Richard A. ORDINANCE AUTHORIZING THE ISSUANCE OF $18,000,000 GENERAL OBLIGATION ALTERNATE BONDS OF THE VILLAGE OF PLAINFIELD, ILLINOIS FOR THE PURPOSE OF FINANCING A WASTEWATER TREATMENT FACILITY BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, ILLINOIS, AS FOLLOWS: 1. Section Authority and Purpose. This ordinance is adopted pursuant to Article 8 of the Illinois Municipal Code, 65 Illinois Compiled Statutes 5/8 and the Laval Government Debt Reform Act, 30 Illinois Compiled Statutes 350, for the purpose of financing the construction of a new wastewater treatment facility with an anticipated capacity of 33,600 p.e., to be located at Lockport Road, and Old Van Dyke Road in the Village and to be known as the "North Sewer Plant" (the "Improvements"). 2. Section Authorization of Bonds. To meet the $18,000,000 estimated total cost of the Improvements, including the cost of issuance of the bands herein authorized and provision for capitalized interest on bonds and band reserve funds, all as permitted under the Local Government Debt Reform Act, the Village is hereby authorized to issue general obligation bands of the Village (the "Bonds") in one or more series and in the maximum aggregate principal amount of $18,000,000. The Bonds shall constitute "Alternate Bonds" under Section 15 of the Local Government Debt Reform Act, 30 Illinois Compiled Statutes 350/15. 3. Sectian General Obligations. The full faith and credit of the Village are hereby irrevocably pledged to the punctual payment of the principal of and interest on the Bonds. The Bonds shall be direct and general obligations of the Village, and the Village shall be obligated to levy ad valorem taxes upon all the taxable property in the Village for the payment of the Bands and the interest thereon, without limitation as to rate or amount. 4. Section Revenue Source, The Bonds shall be payable from (i) sales tax and use tax receipts derived by the Village from taxes imposed under the Use Tax Act, 35 Illinois Compiled Statutes 105; the Service Use Tax Act, 35 Illinois Compiled Statutes 110; the Service Occupation Tax Act, 35 Illinois Compiled Statutes 1 15; and the Retailer's Occupation Tax Act, 35 Illinois Compiled Statutes 120; (ii) utility tax receipts derived by the Village from taxes imposed under 65 Illinois Compiled Statutes 5/8-1 1-2, and by virtue of Ordinance No. 1638 of the Village, adopted December 18, 1995; and (iii) telecommunications tax receipts derived by the Village from taxes imposed under 65 Illinois Compiled Statutes 5/8-1 1-17, and by virtue of Ordinance No. 1639 of the Village, adopted December 18, 1995. The sales and use tax receipts, the utility tax receipts and the telecommunications tax receipts constitute a "Revenue Source" within the meaning of Section 15 of the Local Government Debt Reform Act. . 5. The Revenue Source is hereby pledged for the payment of the Bonds. The President and Board of Trustees of the Village covenants to provide for, collect and apply such Revenue Source to the payment of the Bonds and the provision of not less than an additional .25 times the annual debt service on the Bonds. 6. Section Supplemental Proceedings. If no petition meeting the requirements specified in Section 15 of the Local Government Debt Reform Act is filed during the applicable petition period, then the President and Board of Trustees of the Village may adopt additional ordinances and proceedings supplementing or amending this ordinance so long as the maximum amount of Bonds herein authorized is not exceeded and there is no material change in the purpose described in this ordinance. Such additional ordinances or proceedings shall in all instances become effective immediately without publication or posting or any further act or requirement. • 7. Section Publication. This ordinance shall be published in the "Enterprise," a newspaper of general circulation in the Village. The publication of this ordinance z J shall be accompanied by the publication of the notice required by Section 15 of the Local Government Debt Reform Act. 8. For a period of 30 days after such publication, a petition may be filed with the Village Clerk signed by electors numbering the greater of 1i) 7'.5% of the registered voters in the Village or (ii) 200 of those registered voters or 15% of those registered voters, which ever is less, asking that the issuance of the Bands be submitted to referendum. If no petition is filed within such 30 day period, then the Bonds shall be authorized to be issued. 9. Section Effective Date. This ordinance shall take effect in the manner provided bylaw. This proposal is in response to letters sent by your Mayor to our Mayor and in respanse to our previous discussions. The attached map indicates the, proposed Plainfield/Oswego Boundary Agreement as we understand it Please note that the proposed Baundary Agreement with Joliet would extend the Plainfield/Oswego boundary line south along Ridge Road to Walker Road. This seems to be a logical extension and also follows the area drainage divide. This makes sense far sanitary sewer service and other drainage issues. I would appreciate it if you would review the proposal and provide an indication whether you would like to extend the current Boundary Agreement on this basis. If you and your City Council have an interest, I would be glad tv approach our City Council with this proposal.
