HomeMy Public PortalAbout19270902CCMeetingTown of Tybse,Ga.Beptember 2nd 1927. at 4:00 p.m • The regular meeting of Town Council was held to-day/and was attended by the Mayor and Councilmen Horovitz,Walthour,and Farr and also Messrs S.N.Harris and W.P.Brooks. The following resolution was readv; WHEREAS,in order to enable the Town of Tybee to construct an Electric Distribution System on Tybee Island before beginning of the summer season of 1927,the property owners et said Town of Tybee heretofore executed their several notes for various amounts for the purpose of borrowing from the Liberty Bank and Trust Company a sufficient sum to construct said system: the said property owners being represented in said matter by a committee; and WHEREAS,qe amount of money so procured for the purpose of constructing aliGibuting system with interest thereon paid or to be paid the said Liberty Bank and Trust Company,amounts to the, sum of Twenty-One Thousand six hundred seventy three Dollars and Thirty Cents ( $ 21.673.30 ); and WHEREAS,an issue of bonds for the purpose of paying for said distribution system has beenade in accordance with the laws of the State of Georgia,and sold and the proceeds of said sale of said bonds are now in hand for the purpose of paying the costs of said system; NOW THEREFORE BE IT RESOLVED by the Mayor and Councilmen of the Town of Tybee,the proper officers of said Mayor and Council- men of the said Town of Tybee be and they are hereby directed to pay to the Liberty B ank and Trust Company the amounts with interest to . dateof payment,so borrowed from said Liberty Bank and Trust Company upon the notes of said property owners from the proceeds of said bond issue. BE IT FURTHER RESOLVED that the said officers cf the said Mayor and Councilmen of the Town of Tybee be and they are also authorized to pay to whomsoever there be may be due any amount for the construction of said system which has rot heretofore been paid either from funds derived from said loans by the Liberty Bank and Trust Company or otherwise,so that the entire cost of said distri- bution system shall be fully paid for. BE IT FURTHER RESOLVED that an instrument be taken from said committee of said property owners reciting the payment of the costs of said electric distribution system by the said Mayor and Councilmen of the Town of Tybee and conveying the said distribution system and the properties in connection therewith to the Mayor and Councilmen of the Town of Tybee in such term as may be approved by the acting City Attorney of said Town of Tybee. BE IT FURTHP' RESOLVED that upon the payment of tyre indebt- edness to the Liberty Bank and Trust the Notes of all of said property owners oe recieved from said Liberty Bank & Trust Company andmarked canc611ed and returned to the individual property owners executing the same. BE IT FURTHER RESOLVED that the proper officers cf the Town of Tybee be authorized to do every act and thing necessary of desirable to pay the cote of said distribution system,to relieve the said property owners from their obligations R8 hereinbefore set 1 lin forth and to procure the vesting of the title of the said distri- ' butdon system in the Mayor and Councilmen of tie Tvon of Tybee. Can motion of it Horovitz, that it be adopted, seconded by N Mr Walthour,the motion carried. f The committee appointed to represent the property owners is,W.P.Brooks and Dr.H.Y.Righton,Dr.Righton was Messrs S.N.Harr eing unable to be present. r.Harris suggested that it would be a fine thing to have a supper out at Bannons Lodge to celebrate the lighting up of Tybee from Savannah and invite the property owners of Tybee and also the County Commissioners and others,the committee was excused. A petition was read from John. Stelljes requesting a remission of fine imposed upon him of $ 25.00 but the opinion of Council was that the fine should not be rem i . Led. The following amendment to the Town Charter was read and upon motion of Jr. fi Walthour that it be adopted, seconded by Mr.Espy, it was passed unanimously; N ACT. To nevi se, a,lt er and amend the several Acts to and incorporbing the Mayor and Councilmen of The Town of Tybee,and for other purposes. SECTION ONE. Be it enacted by the General Assembly of the State of Georgia,and it is hereby enacted by the authority of the same, that, from and after the passage of this Act, the Mayor and Coun- cilmen of the Town of Tybee, in Council assembled,inay elect an officer to be called "RECORDER" for such time,and for such Com- pensation, as they may orda.in,who shall be authorized to preside in and hold the sessions of Court known as Mayor's Court or Police 41prourt of the Town of Tybee,with all of the powers and authority conferred upon the Mayor er other presiding officer by Sections number 17 and 18 of the Act of the General Assembly, entitled "An act to arnend,revise and consolidate the several Acts granting authority to the Town of Tybee; to confer additional powers upon the Mayor and Councilmen of the Town of Tybee; to define thecor- porate limits of said town and for other purposes ", approved August 19th 1922. 79
