Hart, Secretary Chairman Sobkoviak called the meeting to order at 7:00 p. m. Roll call was taken, M. Krippel was absent. Chairman Sobkoviak declared the minutes of the May 18, 1993 meeting approved as presented. CASE NO. 411-080593.FV KOCH, FENCE VARIANCE The subject site is a wedge shaped fully developed parcel, with asingle-family residence and detached garage. The bulk of the usable yard area at this site is found east of the house, garage and driveway. The two key criteria used to determine the appropriateness of a variance, are unique conditions, and hardships if the variance is not granted. It was the Planners conclusion, that the variance meeth both criteria, the unique condition is the shape of the lot, the hardship is that without the variance, they cannot fully use their side yard area, due to safety from vehicles making turns, and parking in that area, their dog was injured by a turning car. A fence was erected in 1991 without a permit, and a stop work order was issued until a variance could be applied for. The applicants are now properly requesting a variance from Village fence regulations to allow a four foot tall solid type screen fence along the front property line east of their driveway. It is Staff's finding in this case are that: The subject site is unique in terms of its geometric configuration. The unusual configuration of the site does not allow full use of the rear property for recreational purposes. The side yard area east of the driveway is the primary recreational area of this residence. A four foot screening fence adjoining the Main Street right- of-way would not provide a negative impact on the neighborhood. Staff is viewing this fence, not as a front yard fence, though it is in the front yard, as a rear yard fence. Because this is a rear yard sort of use, that a screening fence would be appropriate for this yard. Staff recommended approval of a variance for Gordon and Sally Koch at 614 Main Street fora 48" tall solid type cedar fence located one foot from the right-of--way along Main Street. Manning moved to recommend to the Village Board the approval of a fence variance, to allow a 4 ft. tall, solid cedar fence, in the front yard along Main Street at the 614 Main Street. Seconded D.
