A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ACTING AS
THE SURPLUS PROPERTY COMMISSION DECLARING OBSOLETE AND NOW
FUNCTIONAL COMPUTER EQUIPMENT AND PERIPHERALS (ATTACHMENT `A')
AS SURPLUS EQUIPMENT AND AUTHORIZING THEIR DISPOSAL THROUGH SIMS
RECYCLING SOLUTIONS
WHEREAS, pursuant to Cal. Const. art. XI section 5 and Government Code
section 37350 et seq., the City may dispose of personal property in any way it chooses
if the disposition is for the common benefit; and
WHEREAS, pursuant to Section 2 -15 of the Lynwood Municipal Code, the City
Council is the Surplus Property Commission, which has the authority to authorize the
disposal of surplus properties; and
WHEREAS, pursuant to section 6 -3.14 of the Lynwood Municipal Code, personal
property of the City which has been determined by the City Council to be surplus to the
needs of the City may be sold by the purchasing officer either in the form of a trade in
for credit against the purchase of new personal property similar in character or through
public sale which shall, be noticed and conducted in the manner deemed most
appropriate by the purchasing officer; and
WHEREAS, after years of service, certain city -owned computer equipment and
peripherals have either reached the end of their service life, become damaged beyond
repair, or have become obsolete; and
WHEREAS, staff. has-researched three certified recycling centers, and has
determined that Sims Recycling Solutions would be the best company to recycle the old
equipment due to their. reputation and reimbursement rate; and
WHEREAS, the equipment has no significant residual value, the City will be paid
$.20 per pound, and it is in the City's best interest to dispose of the surplus property in
question in this manner.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY RESOLVE, 'DECLARE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the City Council of the City of Lynwood approves surplus
equipment to be sold or recycled by Sims Recycling Solutions and authorizes the City
Manager to sign an agreement in a form as approved, by the City Attorney.
Section 2. This Resolution shall go into effect immediately upon its adoption.
PASSED, APPROVED and ADOPTED this 16th day of September, 2014.
