AN ORDINANCE TO AUTHORIZE THE ACQUISITION
OF CERTAIN REAL PROPERTY WITHIN
THE BOROUGH OF CARTERET
WHEREAS, the Mayor and Council of the Borough of Carteret (`Borough ") has determined that
a need exists to acquire the parcel of real property identified as Block 6501, Lot 1 on the Borough's tax
maps and having a legal address of 50 -52 Washington Avenue, Carteret, New Jersey, for public purposes
as are authorized by law, including but not limited to the redevelopment thereof; and
WHEREAS, the Governing Body has determined said use is a public purpose and will promote
the general health and welfare of the community; and
WHEREAS, pursuant to N.J.S.A. 40A:12- 5(a)(1) of the Local Land and Buildings Law, N.J.S.A.
40A:12 -1 et seq., and the Borough may provide for the acquisition of any real property, capital
improvement, or personal property by, among other things, purchase, gift, devise, lease, exchange or
installment purchase agreement.
NOW THEREFORE, BE IT ORDAINED, by the Mayor and Council of the Borough
Carteret, as follows:
Section 1. The aforementioned Recitals are incorporated herein as though set forth at length.
Section 2. The Borough is hereby authorized to acquire the property identified as Block
6501, Lot I on the Borough's tax [naps.
Section 3. The property acquisition authorized herein may be achieved by any of the
following methods: (i) consummation of a purchase and sale contract by negotiations with the property
owner or (ii) by a gift, grant, or contribution by the property owner.
Section 4. The Borough Attorney, and /or other special legal counsel are hereby authorized
and directed to perform or carry out or cause to be performed or carried out, any studies, surveys, tests,
soundings, borings, appraisals, title searches and title report reviews, as may be necessary to determine
the value of the property, the location and quality of the property and any environmental matters
associated with the property and to undertake any action necessary or appropriate to acquire the
aforementioned property. Any such actions taken prior to the date hereof are hereby ratified.
Section 5. The Mayor and Borough Clerk and such other officers as may be necessary are
hereby authorized to undertake any actions and execute and deliver any paper, form or document
necessary or appropriate to acquire said parcel by any of the methods set forth herein.

OF CERTAIN REAL PROPERTY WITHIN
THE BOROUGH OF CARTERET
This ordinance provides for the Acquisition of Property identified as
Block 6501, Lot 1. The foregoing ordinance was introduced at a
meeting of the Council of the Borough of Carteret held May 17,
2018 when it was adopted on first reading.
The said ordinance will be further considered on second reading for
final adoption at a meeting of said Council of the Borough of Car-
teret on June 7, 2018 at approximately 6:00 P.M., Borough
Hall /Council Chambers, 61 Cooke Avenue, Carteret, New Jersey at
which time and place all persons interested will be given
an opportunity to be heard.
