HomeMy Public PortalAboutResolution No. 24-037 - Approving a change order request for Diamanti Construction for Police Department Security AccessSponsored by: Interim City Manager RESOLUTION NO. 24-037 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING THE INTERIM CITY MANAGER TO APPROVE A CHANGE ORDER REQUEST FOR DIAMANTI CONSTRUCTION & DEVELOPMENT, INC. FOR THE POLICE DEPARTMENT SECURITY ACCESS, SURVEILLANCE AND NETWORK INFRASTRUCTURE FOR THE NEW POLICE STATION WITHIN CITY HALL, IN AN AMOUNT NOT TO EXCEED NINETY-NINE THOUSAND NINE HUNDRED NINETY DOLLARS ($99,990.00); PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, in 2021, the City of Opa-Locka received a grant from the Florida Department of Law Enforcement for the Demolition and Rehabilitation of the Old Police Station (2495 Ali Baba Avenue) and Relocation of the new Police Station in the amount of One Million, One Hundred Twenty -Five Thousand Dollars ($1,125,000.00). Due to mold, mildew, and the dilapidated conditions of the previous Police Station, the grant amount was insufficient to repair or replace the Police Station, which costs on average on approximately Ten Million Dollars ($10,000,000.00); and WHEREAS, the Interim City Manager is requesting an additional amount of Ninety -Nine Thousand Nine Hundred Ninety Dollars ($99,990.00) for certain access, surveillance and network infrastructure for the new Police Station as a change order for work to be performed; and WHEREAS, the following items are needed as a part of the additional funding: Access Card System for main door for staff and entrances to private areas; surveillance cameras to monitor the inside, surrounding areas and access points. Additional infrastructure for network and improvements to the communication system, as well as additional data storage and back-up to ensure the Police Department's main force and command staff can serve and protect; and WHEREAS, the Interim City Manager has determined that the change order is necessary and Diamanti Construction & Development, Inc. is willing to provide the additional services, attached hereto as Composite Exhibit "A". The Change Order includes for the Police Department access, surveillance and network infrastructure for the new Police Station, in the amount of Ninety -Nine Thousand Nine Hundred Ninety Resolution No. 24-037 Dollars ($99,990.00); and WHEREAS, the City Commission finds it is the best interest of the City to approve the change order. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, THAT: Section 1. Adoption of Representations. The foregoing "Whereas" clauses are hereby ratified and confirmed as being true and the same are hereby made a specific part of this Resolution. Section 2. Approval of Change Order. The City Commission of the City of Opa-Locka hereby authorizes the City Manager to approve a Change Order for Diamanti Construction & Development, Inc, to include Police Department access, surveillance and network infrastructure for the new Police Station, as set forth in Composite Exhibit "A", in the amount of Ninety -Nine Thousand Nine Hundred Ninety Dollars ($99,990.00). Section 3. Scrivener's Errors. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors, which do not affect the intent of this Resolution may be authorized by the Interim City Manager, following review by the City Attorney, without need of public hearing, by filing a corrected copy of same with the City Clerk. Section 4. Effective Date. This Resolution shall be effective immediately upon adoption hereof and approval by the Governor of the State of Florida or Governor's designee. For the new site total construction cost is $1,323,850.00. The selected location used to function as a daycare center and has not been utilized for the last 10 years. This space had to go through complete demolition of the existing structure and in addition to the construction cost, additional security and IT System and infrastructure need to be added. As part of the security system that's needed the following items need to be added: Access Card System for main door for staff and entrances to private areas. Surveillance Cameras monitor the inside, surrounding areas and access points. Additional Infrastructure for Network and Improvements to the Police Communication System was also added as part of this project as well as additional Data Storage and Back -Up to ensure the Department can serve the community without any interruptions. Financial Impact: The cost of this portion of the Police Station project will be $99,990. Financial Impact: This additional funding is to be provided by a budget amendment for the Safe Neighborhood Police Station Account 44-541839. Proposed Action: Staff recommends the City Commission authorize the Interim City Manager to approve the Security, Camera and Network for the new Police Station for $99,990. Attachment(s): 1. WITNESSETH: WHEREAS, pursuant to Resolution 23-048, Contractor and City entered into an agreement for the completion of a project titled "Demolish the Existing Layout and Build the Police Station at 780 Fisherman Street, Suite 105. WHEREAS, pursuant to Resolution No. , the City Commission approved the amendment to the Scope of Services of the Project for Contractor to provide, install and configure a Physical Access Control System (PACS) to provide secured access to the New City of Opa-Locka Police Department build -out at City Hall within the City; and WHEREAS, the parties desire to specifically amend the Project Agreement, Article 4 entitled "Contract Sum" and an additional Scope of Services attachment, attached hereto, to Attachment "A" of the Agreement; and WHEREAS, the Amendment will increase the original fee by Ninety -Nine Thousand Nine Hundred Ninety Dollars ($99,990.00) and work is expected to take 6 months from the execution of this Amendment; and WHEREAS, the City Commission desires to authorize the Interim City Manager to execute the Amendment to the Original Project Agreement between the CITY and DIAMANTI CONSTRUCTION & DEVELOPMENT, INC, as set forth herein. NOW THEREFORE, in consideration of the mutual terms, conditions, promises, covenants and payments hereinafter set forth in this Amendment, the parties hereby agree to amend the Project Agreement, as follows: 1. The foregoing recitals are true and correct and incorporated herein by reference. Terms not defined herein shall have the same meaning as ascribed to them in the Agreement. 2. Page 2, Article 4, Section 4.1, entitled "Contract Sum" is hereby amended and shall read: 4.1 The CITY hereby agrees to pay CONTRACTOR for the faithful performance of this Agreement, for work completed in accordance zvith this Agreement and RFP 23-0307100. The payment for services pursuant to this Agreement shall not exceed One Million Three Page 1 of 2 Hundred Twenty -Three Thousand Eight Hundred Fifty Dollars ($1,323,850.00) for the Nezv Opa-Locka Police Department demolition and build services and Ninety -Nine Thousand, Nine Hundred Ninety Dollars ($99,990.00) for Physical Access Control System provision, installation, and configuration services for the New Opa-Locka Police Department. 3. Attachment "A" to the Project Agreement shall be amended to include an additional Scope of Work, attached hereto as Exhibit "A". The foregoing recitations are true and correct and are hereby incorporated by reference. All other provisions of the Agreement, except as modified herein, shall remain in full force and effect.
