RESOLUTION AUTHORIZING A CHANGE ORDER IN THE CONTRACT BETWEEN
THE VILLAGE OF PLAINFIELD AND BAISH EXCAVATING, INC.
WHEREAS, the Village of Plainfield and Baish Excavating, Inc. entered into a certain
agreement dated October 26, 1995 for Whispering Creek Storm ,Sewer Reconstruction and;
WHEREAS, it has been determined that it is in the best interest of the Village of
Plainfield to approve Change Order No. ~, a copy of which is attached hereto and
made a part hereof as Exhibit "A";
WHEREAS, the Village's Engineer has determined that said Change Order is in the
best interest of the Village of Plainfield;
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEE5
OF THE VILLAGE OF PLAINFIELD, AS FOLLOWS:
1. It is hereby determined, that it is in the best interest of the Village of Plainfield
to authorize certain change in the agreement dated, October 26, 1995, between the
Village of Plainfield and Baish Excavating, Inc. as set forth in the attached Exhibit
"A", and said Change Order, is authorized by law.
2. That the circumstances which necessitated the Change Order were not
reasonably foreseeable at the time the contract was executed, and were not within
the contemplation of the contract as signed, and it is in the best interest of the
Village of Plainfield to approve said Change Order, which is authorized by law.
3. That the Village President is hereby authorized to execute said proposed Change
Order, a copy of which is attached hereto and made a part hereof as Exhibit "A" to
be preserved in a permanent contract file open to the public pursuant to 720 ILCS
5/33 E-9.
