HomeMy Public PortalAboutORD-CC-1987-03CITY OF MOAB ORDINANCE NO. 87-03 AN ORDINANCE AMENDING THE MOAB CITY CODE TO CHANGE THE REQUIREMENTS FOR THE CITY COUNCIL TO GRANT BEER LICENCES. WHEREAS, the Council has found the ordinance granting beer licenses to be cumbursome and drawn out and difficult to administer under certain conditions. WHEREAS, it is in the best interest of this municipality to amend the Moab City Code to allow for a more orderly manner for the council to grant licenses for applicants to apply for and receive beer licenses. NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Moab that Section 5.20.210 of the Moab City Code of 1986, be amended as follows: Section 1. Section 5.20.210 is amended to read as follows: 5.20.210 Application --Police department referral. The appli- cation for such license, together with such information and certificate as is required by the city council to be attached there to, shall be referred to the city chief of police for inspection and report. The chief of police shall, as soon as possible, after receiving such application, make a report to the council relative to the granting or denying of such application. Upon receipt of the report, the council shall act upon the appli- cation as it shall deem fair, just and proper in regard to grant- ing or denying the same. Pending the report of the chief of police, the council may for good cause, grant a temporary licence to an applicant not to exceed a period of three months, who shall state under oath or affirmation that applicant is a resident of Grand County, State of Utah, immediately prior to making the application, that appli- cant has no prior criminal record, and that no outstanding war- rants or criminal complaints are on file or record against appli- cant in any jurisdiction. tion.
