RESOLUTION AUTHORIZING A CHANGE ORDER IN THE CONTRACT BETWEEN THE
VILLAGE OF PLAINFIELD AND AM-COAT PAINTING, INC.
WHEREAS, the Village of Plainfield and Am-Coat Painting, Inc.
entered into a certain agreement dated April 3, 1995, for painting
the Mill Street Water Tower and;
WHEREAS, it has been determined that it is in the best
interest of the Village of Plainfield to approve Change Order No.
1, a copy of which is attached hereto and made a part hereof as
Exhibit "A";
WHEREAS, THE Village's Engineer has determined that said
Change Order is in the best interest of the Village of Plainfield;
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF PLAINFTELD, AS FOLLOWS:
1. It is hereby determined, that it is in the best interest
of the Village of Plainfield to authorize certain changes in
the agreement dated, April 3, 1995, between the Village of
Plainfield and Am-Coat Painting, inc. as set forth in the
attached Exhibit "A", and said Change Order is authorized by
law.
2. That the circumstances which necessitated the Change Order
were not reasonably foreseeable at the time the contract was
executed, and were not within the contemplation of the
contract as signed, and it is in the best interest of the
Village of Plainfield to approve said Change Order, which is
authorized by law.
3. That the Village President is hereby authorized to execute
said proposed Change Order, a copy of which is attached hereto
and made a part hereof as Exhibit "A" to be preserved in a
permanent contract file open to the public pursuant to 720
ILLS 5/33 E-9.

Pursuant to Public Act 85-1295, the circumstances which necessitate this Change
Order were not reasonably foreseeable at the time the Contract was signed, were
not within the contemplation of the Contract as signed, and are in the best

On April 3, 1995 the Village Board entered into a contract for painting the Mill Street
Water Tower with Am-Coat Painting, Inc. This project was advertised and bids were open
on January 17, 1995. The delay in the opening and award of the contract was due to the
review and discussion on the concern for the disposal of the paint waste. In that the Staff
spent several weeks on this matter, the proposed completion dates in the contract
documents were unrealistic. To that end, at the April 11, 1995 pre-construction conference
Staff proposed the following completion dates.
1) Substantial Completion 7/14/95
2) Completion 8/14/95
The proposed Resolution would authorize the change in the completion dates.
RECOMMENDATION
Staff recommends that the Village Board authorize the Resolution to execute Change
Order #1 extending the completion dates as listed.
