ORDINANCE NO. 87-04
AN ORDINANCE AMENDING THE MOAB CITY ORINANCES RAISING THE FEES,
TAXES AND SCHEDULES TO COMPLY WITH THE FEES, TAXES AND SCHED-
ULES NOW IN EFFECT THAT HAVE BEEN ESTABLISHED BY RESOLUTION,
MOTION OR ORDINANCE, AND BRING ALL FEES, TAXES, AND SCHEDULES
INTO LINE TO REFLECT THE ACTUAL FEES,TAXES, AND SCHEDULES NOW
BEING USED.
PREAMBLE:
WHEREAS, the fees, taxes and schedules have in the past been
adjusted by motion, resolution, or ordinance, and there are
ordinances on the books that do not reflect the true conditions
as they exist at the present time, and
WHEREAS, the 1986 Municipal Code is in the process of being
adopted by Codifying all the ordinances heretofore passed or
codified, and
WHEREAS, It will therefor be necessary to amend the 1965
Moab City Code, as amended, to comply with the present taxes,
fees and schedules.
NOW THEREFORE, be it ordained by the City Council of the
City of Moab that certain Sections of the Moab City Ordinances
and Moab City Code 1965, as amended, be and the same are here
amended to read as follows:
1. The following subsections of Section 13-24 Moab City Code
1965, as amended, be amended to read as follows:
(a) A fee upon every retail sale of tangible personal
property made within the city equivalent to one percent of the
purchase price paid or charged; or in the case of retail sales
involving the exchange of property, equivalent to one percent of
the consideration paid or charged, including the fair market
value of the property exchanged at the time and place of the
exchange; provided, that the fee upon any single item of personal
property shall not exceed five dollars ($5.00).
(b) A fee equivalent to one percent of the amount paid for
all meals furnished by any restaurant, hotel, drugstore, club, or
other place.
(c) A fee equivalent to one percent of the amount paid for
admission to any place of amusement, entertainment or recreation.
(d) A fee equivalent to one percent of the amount paid or
charged for all services for repairs or renovations of tangible
personal property, or for installation of tangible personal
property rendered in connection with other tangible personal
property.
(e) A fee equivalent to one percent of the amount paid or
charged for tourist home, hotel, motel, or trailer court accommo-
dations and services; provided that this subsection shall not
apply to the amount paid ar charged for tourist home, motel,
hotel or trailer court accommodations where residency is main-
tained under the terms of a lease or similar agreement for a
period of thirty days.
(f) A fee equivalent to one percent of the amount paid or
charged for laundry and dry cleaning services;
2. The following subsections of Section 26-40 Ordinance 3-77
of the Moab City Code 1965, as amended, be amended to read as
follows;
(a) Water Connection fees.
(1) There shall be a fee of four hundred twenty-five
dollars ($425.00)for each three -•fourths inch meter connection
plus thirty-five dollars ($35.00)for each unit in excess of one
unit in any dwelling, trailer court or motel.
(2) There shall be a fee of five hundred fifty dollars
($550.00) for each one -inch meter connection plus thirty-five
dollars ($35.00) for each unit in excess of one unit in any
trailer court or motel.
(3) There shall be a fee of seven hundred fifty dollars
($750.00) for each one and one-half inch meter connection plus
thirty-five dollars ($35.00) for each unit in excess of one unit
in any dwelling, trailer court or motel.
(4) There shall be a fee of nine hundred twenty-five
dollars ($925.00) for each two-inch meter connection plus thirty-
five dollars ($35.00) for each unit in excess of one unit in any
dwelling, trailer court or motel.
3. The following subsections of Section 26-62 of Ordinance
3-77 of the Moab City Code 1965, as amended, be amended to read
as o1lows.
(a) Rate No. 1, Commercial within the City:
Minimum charge, 3,000 gallons or less per month $6.00.
Next 47,000 gallons, $0.51 per thousand gallons.
Next 50,000 gallons, $0.44 per thousand gallons.
Next 400,000 gallons, $0.39 per thousand gallons.
Next 500,000 gallons, $0.33 cents per thousand gallons.
All over 1,000,000 gallons per month 27 cents per
thousand gallons.

(b) Rate No. 2, Residential, within the city:
Minimum charge, 2,000 gallons or less per month, $4.80.
Next 8,000 gallons $0.38 per thousand gallons.
A11 over 10,000 gallons per month, $0.52 per
thousand gallons.
(c) Rate No. 3, Commercial, outside the City:
Minimum charge, 3,000 gallons or less per month, $12.00.
Next 47,000 gallons, $1.02 per thousand gallons.
Next 50,000 gallons, $.88 Per thousand gallons.
Next 500,000 gallons, $.78 per thousand gallons.
Next 1,000,000 gallons $.66 per thousand gallons.
A11 over 1,000,000 gallons per month $.54 per thousand
gallons.
(d) Rate No. 4, Residential Outside City:
Minimum charge, 2000 gallons or less per month, $9.60
Next 8000 gallons, $0.76 per thousand gallons
A11 over 10,000 gallons per month $1.04 per thousand
gallons.
4. The following subsections of Section 26-63 of Ordinance
3-77 of the Moab City Code 1965, as amended, be amended to read
as follows:
(a) For residences, $8.40 per family unit per month,
plus $4.80 per month for each additional toilet.
(b) For commercial enterprises when toilet facilities
are used by employees only, there shall be a minimum
charge of $8.40 per month.
(c) For commercial enterprises and churches, when
toilet facilities are used by the public, there shall
be a minimum charge of $8.40 per month plus $4.80 for
each toilet in excess of two.
(d) For motels or hotels there shall be a mimimum
charge of $8.40 per month plus $4.80 per month for each
toilet in excess of two.
(e) For schools there shall be a charge of $6.72 per
month for each one hundred (100) pupils which may be
paid on an annual basis.
(f) For other than one -family residences, any person
using water which is not furnished to them from the
city water system, at their own expense and under the
supervision of the City, shall install a meter in the

water or sewer line, in which case the schedule shall
be the same as those listed under subsection (b) of
this section for commercial enterprises.
(g) Rates for sewer services furnished outside the City
shall be exactly twice the rates set out in this
section for services within the City.
5. Section 26-66 Moab City Code 1965, as amended,be amended
to read as follows:
If any person neglects, refuses or fails to pay his water or
sewer service charges within thirty days from the date of billing
thereof, the city recorder shall notify the person in writing
that the water will be turned off from his premises after ten
days from the date of such notification. The city recorder shall
issue an order to the waterworks superintendent to turn the water
off from the premises of such person where such unpaid charges
are assessed. Before the water shall be turned on again, all
delinquent water and sewer service charges shall be paid in full,
plus a turn -on fee of twenty-five dollars ($25.00), if during
normal working hours, or a turn -on fee of fifty dollars ($50.00)
after working hours. The city recorder is authorized to enforce
the payment of all delinquent water and sewer rates by an action
in law in the corporate name of the city.
6. The following subsection of Section 5-3 Ordinance 3-81 of
the Moab City Code 1965, as amended, be amended to read as follows:

Fee: $.05 Sq. Ft.
14. Move on Fee:
Fee: $35.00--Building or mobile homes, plus foundation,
water, sewer and other structural improvement.
