O'Connell, S. Rathbun, R. Smolich. President Rock was absent. Others Present: T. Burghard - Administrator J. Harvey - Attorney _ S. Janik - Clerk D. Bennett - Chief of Police H. Hamilton - Engineer J. Durbin - Planner C. Minick - Finance Director 7:21 p.m. J. Dement moved to convene the Public Hearing for Farmington Village Annexation Agreement. Seconded by S. Rathbun. Vote by roll call. Stalzer, yes; Darnell, yes; Dement, yes; O'Connell, yes; Rathbun, yes; Smolich, yes. 6 yes, 0 no. Motion carried. The Village approved plans for detached single family residential development approximately two years ago on a 285 acre property located approximately 1/4 mile west of Rt. 30 between Rt. 126 and 143rd Street (formerly known as Sweetwood). Prior to execution of the annexation agreement, the request was withdrawn by the applicants. Another developer is now requesting reapproval of the plans and seeks to move forward with the development as previously proposed. A public hearing is scheduled to determine whether conditions are still favorable for the annexation agreement. If supported, the annexation agreement will require refinement along with the subdivision review and approval process. Janet Steiner, officer, director, and shareholder of Red Fox Farms, Inc. The owner of almost 400 acres adjacent to and west of the Farmington Village project. She stated many concerns, such as safety of the people moving into Farmington Village, safety of the 25 to 30 horses kept on the Farm; safety of Farmington Village children who will live and attend school in close proximity to a retention pond. With the addition of Farmington Village she is concerned that the cumulative effect of so much impervious surface adjacent to the Red Fox land may cause an intolerable surface water flow. Attorney Michael Saper, representing Janet Steiner also talked about the previous stated concerns of his client. Attached hereto and made a part hereof is letter from Attorney Saper presented to the Board. After hearing public comment, the Board continued discussion on issues; such as Meadow Lane and gaining right-of-way, screening and buffering along the Red Fox Farms property on the west, setbacks, variation on lot sizes, sq. ff. of homes, covenants and restrictions, surface water, addressing 143rd Street being extended, traffic signalization. Public Hearing January 5, 1998 Page Two Janet Steiner requested a report on the Farmington Village issues. She is particularly concerned about the water run-off. The Staff was advised to keep Ms. Steiner informed. J. Dement moved to close the Public Hearing. Seconded by K. O'Connell. Vote by roll call.
