BENNETT - CHIEF OF POLICE H. HAMILTON - ENGINEER L. VAUPEL - ECONOMINC DEV. COORDINATOR A. PERSONS - PUBLIC WORKS DIRECTOR PUBLIC HEARING: BROWN ALLEY VACATION Planner D. Carroll summarized the requested vacation of the alley bisecting their triangular property, zoned ORI, located along the west side of Center Street just south of Main Street at the EJ & E railroad tracks. The subject site is vacant with the exception of a private driveway extending to the rear of adjoining lots to the north. Several mature trees are found on the premises. The applicants are requesting vacation of a sixteen- (16) foot wide alley tha{ separates Lot 2 from Lots 4 through 7, all owned by Mr. and Mrs. Brown. Staff recommends approval subject to the following stipulations: 1) The provision of a private access easement along the rear of lots 4,5,6, and 7 adjacent to the E J & E tracks; 2) Applicants shall be responsible for payment of appropriate fees (including legal fees and compensation to the Village in an amount equal to the benefits accrued by the vacation); 3) Applicant shall obtain approval from all utilities, trash collection, and other public agencies and provides any easements necessary to accommodate existing uses of the alley. Past policy has been to not require compensation other than reimbursement of legal and surveying costs. Staff recommends a change to current policy requiring compensation to the Village in an amount which shall be equal to the benefits that will accrue the applicant by reason of the vacation. Staff has initiated an appraisal. The Board had questions regarding easements in this area. The applicants, Mr. and Mrs. Brown requested to swap the alley to the southwest of their home in exchange for the easement. There were no public comments. gUSAI~ JANIK, VILI~,~GE CLERK
