HANSEN - PLANNER At 8:26 p.m. Mayor Rock called the Public Hearing to order. REQUEST FOR PARTIAL RIGHT OF WAY VACATION SPRING HILL ESTATES SUBDIVISION, BETWEEN LOTS 15 AND 16. Planner Testin explained that the applicants are requesting partial vacation of a 66-foot Right of Way (ROW) stub_street in Spring Hill Estates reducing the ROW to 40 feet. The Stub Street is located on the East Side of the development. By reducing the ROW from 66 to 40 feet the goals of the Village and the residents of the subdivision can be met. Both Staff and the Plan Commission recommend approval of the partial vacation of the ROW with the following stipulations: 1. The applicant shall be responsible for reimbursement of any engineering, surveying and legal costs incurred by the vacation. 2. That the owners of Lots 15 and 16 be responsible for landscape maintenance until such time as the stub road in constructed. 3. That drainage and utility easements be created for the vacated portions of the ROW. 4. That the drive on Lot 16 that extends beyond the house toward Hawthorn Circle be removed and the drive connected to the stub road once the road is constructed. This provision shall be recorded against the property by the applicants prior to building permit. There were no public comments. Meeting adjourned at 8:29 p.m. SUSAN JANIK,/,..~VILLAGE CLERK
