At 7:17 p.m. Mayor Rock called the Public Hearing to order.
HERITAGE OAKS ANNEXATION AGREEMENT AND PRELIMINARY PLAT
CONSIDERATION.
Director Durbin told the Board that the applicants are hoping to develop 80 acres of
agricultural land for a 100 single family and 110 multi-family residential subdivision.
The subject site is located at the southwest comer of 119th Street and 248th avenue. The
subject property is located in unincorporated Will County and is not contiguous to the
Village corporate limits nor are utilities immediately available to the site. The applicant
may be contiguous if Century Trace located directly north of this project is annexed to
the Village. Currently, Century Trace is seeking annexation agreement and preliminary
plat approval at the Village Board level. The applicant proposed conveyance of the 26.84
acres of park and open space to the Village in full satisfaction of the Village's Park
donation requirements. Cash payment to meet the school land/cash donation requirement
of the Village are proposed. The applicant is reliant on Century Trace bring water and
sewer to the area and anticipates connection to those lines. Since the applicant will
directly benefit from water and sewer brought to the area by Century Trace, it probably
should be liable for recapture. The Transportation Plan shows significant signalization in
the area; therefore, a signalization impact fee should be discussed.
Trustee O'Connell questioned "If you took away the lake, what percentage would actually
be donated? Director Durbin responded that without the lake the donation would fall
below 10 percent, but did not some benefits. The Trustees discussed possible uses for the
donation of the six acres of actual parkland. Ken Smith, Park District representative told
the Board that the Park District had not yet reached a firm conclusion what was planned
for the land. Board members have concerns over the use of parkland by the Park District
for recreational space, or active parks like ball fields, instead of open space, or passive

parks. Applicant's Attorney, John Phillipchuck was present and was looking to solicit
comments from the Board only, and no formal action tonight. Mayor Rock suggested
that we bring forward this discussion i'tem to our next Committee of the Whole Workshop
to try and resolve this issue.
There were no public comments.
S. Rathbun moved to close the public hearing and return to the regular meeting.
