Board being present, Hes,rs, Hammond, Charles and Zimmerman,
The following proceedings ivere had, to -wit: -
The Board direct the City Civil Fngineer to notify Linus P.
Meredith contractor under Improvement Resolution No. 247-1911,
and the Street Car Co. to begin work on said improvement of
North "E" Street, on Monday April 3rd, 1911,
Whereas, The Board of Public Works of the City of Richmond, Ind-
iana, on November 14th, 1910, adopted Declaratory Resolution No,
"63-1910, For the appropriation & condemnation of certain real
estate w1thout the City of Richmond, Indiana, for use by said
city for sanitary purposes, and Earlham Cemetery owner of said
land proposed to be condemned & appropriated by said city, having
through its attorney & President, Jonathan W. Newman, appealed
from the assessment of benefits & damages made by said Board, as
shown by the final assessment roll, and said appeal being now pend-
ing in the Wayne Circuit Court, and said Board of Public Works &
said city of Richmond not deeming for the best interest of said
city to pay any considerable sum out of the funds of said city
for damages in the matter of said appropriation & condemnation of
said land as described in said resolution,
Now be it Resolved, by said Board of Public Vlorks of said city
of Richmond, that said Declaratory Resolution No, 63-1910, be and
the same is hereby wholly rescinded, and the said proceedings to
Appropriate & Condemn said real estate without said city of Richmond.
Indiana, for use by said city for sanitary purposes be and the same
is hereby digmissed, and the City Attorney is hereby authorized
and directed to take the necessary steps to have said matter dis-
missed in the Wayne Circuit Court,

Mr. Wm, Campbell, V. P. 0aar Scott & Co, appeared before the
Board in regard to the matter of the vacation of North "F" Street
from

p t from North Bth StnOt to Washington Ave.,
back of the old furniture factory, also reiterating a statement
made to the Board on February 23rd, 1911, that his company could
take care of any damages which might be awarded to the knrlcan
Telephone & Telegraph Co. Of Indiana, by the City, or.on appeal
to the Courts. Mr. Zimmerman instructed Mr. Campbell to have his
company make the aforesaid agreement in writting,
The Board unanimously adopts Improvenant Resolution No, 256-1911,
providing for the construction of a sanitary sewer in the alley
between South 9th & 10th Streets, from South "I" to South "J" St.
The Board did then adjourn.
