ROCK, R. SMOLICH, J. CHERRY, M. COLLINS, S. RATHBUN. TRUSTEE O'CONNELL AND CALABRESE WERE ABSENT. OTHERS PRESENT: D. BENNETT, CHIEF OF POLICE T. L. BURGHARD, ADMINISTRATOR J. REGIS, ENGINEER S. JANIK, CLERK C. MINICK, FINANCE DIRECTOR J. DURBIN, COMMUNITY DEVELOPMENT J. HARVEY, ATTORNEY A. PERSONS, PUBLIC WORKS L. VAUPEL, ECONOMIC DEVELOPMENT J. TESTIN, VILLAGE PLANNER NEW COMMUNITY CHURCH. Planner Testin stated that the applicant is requesting a special use permit to allow a Religious Institution (church) in a B-1 District located at Meadows Professional Campus. The church wishes to hold services in one of the existing buildings. In addition, the applicant has requested amending the annexation agreement to allow for different hours of operation for a church. The present agreement limits the hours of operation on the site. The application previously requested hours of operation for the church to be 8:00 a.m. to 8:30 p.m. on Sundays. This was revised at the Plan Commission meeting upon agreement by the surrounding landowners and the applicants to be 8:00 a.m. to 6:00 p.m. None of those present at the Plan Commission public hearing expressed opposition to the changes in hours if the hours are only for the church. Plan commission and Staff recommends approval of the special use and the amended annexation agreement. Pastor DeWayne Rush, New Community Presbyterian Church gave a brief explanation of his requests and their only desire is to serve the residents of the Village of Plainfield in a facility that is permanent and allows us more opportunity to serve their spiritual needs. We want to be sensitive to our neighbors and we are more than willing to accept any language that the Board chooses to allow the change in the hours that we request. Rich Noonan, resident of Golden Meadows and he is very pleased that the New Community Presbyterian Church will be in the Meadows Professional Campus. He is concerned about the safety of the pond for the religious congregation. Mike Guinta, Developer of Meadows Professional Campus stated that the pond has been a concern, we didn't realize the water table in the area would be so high~ and the depth of the pond in the middle at 5 1/2 ft. We have considered having wrought iron fencing around the play area in the daycare and I am giving consideration to fencing that entire portion on my side and putting Plainfield Village Board of Trustees March 20, 2000 13 fencing in the yards on my property to interconnect all of the neighbors so that we have a decorative fence so the pond would be totally enclosed. We will be doing this when we do our landscape just before occupancy for this particular building. I also emphasize that we are making this special use request specific to the church. Administrator Burghard requests our engineering firm to look at the pond and the safety of the slope and coordinate the building of the fence. I would like to see the fence constructed by a date certain in the ordinance granting the special use and I would like to see the occupancy of the church held up until these items are completed. The records show that Mr. Guinta stated "that's fine". Deborah Passtert, adjacent to the property, and would like to clarify the closing on Sunday at 6:00 p.m. Pastor Rush answered that the church will abide by the hours of operation. Dan Sampson, resident of Golden Meadows, stated that this is a no-issue, it is no different to enforce it from the church than to enforce it from businesses currently operating there. Rhonda Henricksen, Golden Meadows resident, stated that she personally sent out notices about the requests to about 23 homeowners, only 6 homeowners came to a meeting, and none had opposition. Trustee Rathbun had a problem with setting hours for the church and is very uncomfortable with this. The record shows that there were no other public comments made.
