At 7:00 p.m. President Rock called the meeting to order. Roll call was taken, all Trustees were present. Clerk Janik led the pledge to the flag. PRESIDENTIAL COMMENTS: Chief Donald Bennett presented a Lifesaving certificate, medal and a $100 gift certificate to Al's Steak House to Officer Robert Plutz. Clerk Janik read a Resolution of Appreciation for Edward Schrader, Deputy Fire Marshal of the Village of Plainfield who will be leaving his position at the end of May. Mayor Rock proclaimed the Month of May, 2000 as National Drug court Month recognizing the practitioners and participants who make drug courts work and the significant contributions that drug courts have made and continue to make in reducing drug usage and crime. ---~ TRUSTEE'S COMMENTS: Trustee Mike Collins complimented Allen Persons, Public Works Director on the placement of garbage cans throughout the downtown area. Clerk Janik requested that Item #C The Ponds Unit #1 Letter of Credit reduction be removed from the Consent Agenda. S. Rathbun moved to approve the Amended Consent Agenda to include the following: Board Meeting Minutes, 5/12/2000 approved; Bills Payable 5/15/2000; The Fields ~Heritage Meadows, Unit 1, Letter of Credit reduction; Wallin Woods, Unit #1, Letter Plainfield Village-Board of Trustees May 15, 2000 2 of Credit reduction; Ordinance No. 1975 establishing a Class J2 Liquor License for Plainfield Moose Lodge //2491 location at 604 ½ Des Plaines Street in Plainfield; Resolution No. 1249 supporting the DuPage River Sweep to be held on June 3, 2000; Resolution No. 1250 temporarily closing a portion of U. S. Route 30 in the Village for the purpose of Plainfield Fest; Ordinance No. 1976 authorizing the sale of personal property; Reserve of Plainfield, Unit I/IA Letter of Credit release; Jewel Incentive Agreement approval; Resolution No. 1251 amending the Personnel rules and Regulations, commonly known as the Village of Plainfield Personnel Policy Manual; Grant of Easement Agreement with park District for watermain. Motion carried. #3 CONCERNED CITIZENS OF PLAINFIELD INQUIRY. Donna Koehler, CCOP asked the following questions: What areas of land would Plainfield like to annex, which is not included in the current comprehensive plan? If the Village of Plainfield starts to annex land in Kendall County, does it plan to adhere to the Kendall County Land Resource Management Plan's goals and objectives? Administrator Burghard stated that the Board has said it wants to plan for an eventual border of approximately 111th Street on the North, one mile west of Stewart on the West, Walker on the South and 1-55 on the East. We have a working relationship with Kendall County and assisted them in their development of their Comprehensive Plan. We also provided several thousand dollars for they're planning efforts. The Village will comply with the law and Kendall County's interpretation of its plans. Has Oswego endorsed the WIKADUKE Trail? Administrator Burghard stated that all of the municipalities and counties affected by the road have endorsed the right-of-way for WIKADUKE by actually recording the centerline for the road with the county against an actual piece of land. The only town that balked at this was the Village of Oswego. Has Plainfield made use of or is looking into utilizing TEA-21 ? Administrator Burghard stated that we have used it and will continue to use. TEA-21 is a Federal Financing mechanism that was extended in Congress two years ago. We have made formal application for Van Dyke Road, 143rd Street and we are in the process with the Park District and the County and the TOwnship to do it for Renwick Road and Renwick Road Bridge. Who put together the Plainfield Club book, which is located in the library together? Administrator Burghard stated that the book was published and prepared by the Developer and he directed that a copy be placed in the Library to maximize public availability because of the proposed project's scope. Plainfield Village-Board of Trustees May 15, 2000 3 In regards to retention ponds, or bodies of water located in subdivisions in Plainfield, who is liable, in case of law suits? Is the village? Administrator Burghard stated that only a court could determine liability. Retention ponds owned by a homeowner's association are their responsibility. Those owned by the Park District are theirs. Anyone can charge the Village with liability in these cases, but a court would have to decide. Is the new waste/water treatment plant being constructed because of growth or because of EPA standards? Administrator Burghard stated that 2/3rds of the new plant is for growth and 1/3rd is for compliance. 2/3rds of the plant is being paid for by tap on fees and 1/3rd by user fees. The Village purchased property in the early 1990's specifically for such expansion. The new plant design is currently under review by the Illinois EPA and a construction contract should be issued this summer. J. Chobar, concerned citizen, stated that all the above questions are self-answered or do not apply. Pat Andreasen suggested that the concerned citizens should send a representative to all Board Meetings on Monday night and Tuesday for the Zoning and Plan Commission meeting. Why are they so worried what Kendall County is doing? Maybe they should be more concerned about what Plainfield is doing. R. Smolich asked if a Comprehensix~e Plan has been offered to the Concerned Citizens? They responded that they have read the Comprehensive Plan. D. Koehler requested the reason why the Comprehensive needed to be redone. R. Smolich stated that it was appropriate that the Comprehensive Plan is redone and we were late in the game, it was suggested that this plan be updated every 5 years when the original one was prepared. #4 KENSINGTON CLUB (PULTE) Acting Community Development Director J. Testin spoke briefly about the changes that were made which were directed by the Board. The Board generally agreed and approved the modifications. Pulte then requested to erect three signs along its property on Route 59. Ordinance would permit Pulte to erect signs measuring 10 feet by 20 feet. This request did not meet with the Board's approval. Mr. Jack Weber of Pulte expressed concern that limiting the signs could cause difficulty in locating the development. The Board requested him to eliminate one sign and he agreed. R. Smolich moved to adopt Ordinance No. 1977 authorizing execution of an Annexation Agreement between the Village and the Estate of Frances Reibel, Deceased and Pulte Home Corporation for the Kensington Club. Testin told the Board that the applicant is requesting a special use permit from Will County to allow outside storage at an existing automotive repair facility. The property is located in the Wolf Creek Industrial Park, which is east of IL Route 59, and south of 119th Street. The property is within one and one half miles of the current Village limits, and the applications are subject to Village review and consideration per Illinois State Statues. The Village cannot approve or deny the application; however, Will County is seeking Village comment. Plan Commission and Staff recommends forwarding a letter of no objection with the following stipulations: 1. A vehicle under repair is parked outside no longer than fourteen days; 2. All repair work is conducted within the repair facility. 3. All outside storage is enclosed with fences or landscaping of at least seventy-five (75) percent opacity. 4. Outdoor lighting is consistent with the requirements of the Village. S. Rathbun moved to authorize staff to forward a letter of no objection for a special use permit for outside storage for 12011 S. Aero Drive in Wolf Creek Industrial Park to Will County with the stated stipulations in the staff report. Seconded by R. Smolich. Vote by roll call.. ADMINISTRATOR'S REPORT Administrator Burghard stated that earlier in the Consent Agenda we approved a Resolution asking for the closing of Rt. 30 for the purposes of Plainfield Fest. The Board passed this, but I have problems as to whether the State will approve the closing of this road this year because of accelerated roadwork on the viaduct and Rt. 59. It is also highly unlikely that the State will approve a closing of Rt. 30 for Harvest Fest for the same reasons. I have requested an early response from the State for the closing of Rt. 30 for Plainfield Fest. The Staff has been looking at the request for the Moose and in terms of the B5 traditional Zoning District downtown, under permitted uses it permits eating and drinking establishments and under Special Use it calls for fraternal organizations. Eating and drinking establishments have significantly more impact on the neighborhood than a fraternal organization. The Board approved our interpretation of the proposed location of the Moose and felt it was consistent with the eating and drinking establishment section of the Zoning Ordinance. Plainfield Village-Board of Trustees May 15, 2000 5 FINANCE DIRECTOR'S REPORT No report ECONOMIC DEVELOPMENT DIRECTOR'S REPORT Larry Vaupel told the Board that today was the deadline for the Fagade Improvement program and we received five applications. In early June the Economic Development Commission will review them and in late June they will be presented to the Board. PUBLIC WORKS DIRECTOR REPORT S. Calabrese moved to adopt Resolution No. 1252 prohibiting sod/seed installation June 12 to September 4, 2000. Seconded by K. O'Connell. Vote by roll call. Rathbun moved to instruct the Mayor and the Village Clerk to execute the Miles Street Easements for the purpose of installing streetlight. Seconded by S. Calabrese. Vote by roll call. Allen Persons announced that the EJ & E Railway Company will be temporary closing Grade Crossings at Center Street, Eastern Avenue and Lockport Street during the week of May 22, 2000. The operation should take 2 hours or less. ENGINEER'S REPORT H. Hamilton spoke to the Board about the Des Plaines Street North Reconstruction, which will take place before the end of this year. We are presently taking bids for the construction of all underground utilities, watermain, sanitary sewer replacement, storm sewer, Commonwealth Edison, Ameritech, AT & T and streetlighting electrical. June 16- 18, 2000 U. S. Route 30 will be closed at DesPlaines Street to all traffic. June 23-25, 2000 I1. Route 126 closed at Des Plaines Street to all traffic. August 21, 2000 Des Plaines Street closed to through traffic. COMMUNITY DEVELOPMENT DIRECTOR'S REPORT No report POLICE CHIEF'S REPORT S. Rathbun moved to adopt Ordinance No. 1979 Three way stop sign on Lily Cache Road/Rolf Road intersection. Seconded by M. Collins. Vote by roll call.
