RESOLUTION OF THE BOROUGH OF CARTERET, IN THE COUNTY
OF MIDDLESEX, NEW JERSEY DESIGNATING THE AREA
IDENTIFIED AS BLOCK 402, LOT 24 & 25 AND BLOCK 301, LOTS 3, 4
& 5 ON THE TAX MAP OF THE BOROUGH AS A NON -
CONDEMNATION AREA IN NEED OF REDEVELOPMENT PURSUANT
TO THE LOCAL REDEVELOPMENT AND HOUSING LAW
WHEREAS, the Borough of Carteret, a public body corporate and politic of the State c
New Jersey (the "Borough") is authorized pursuant to the Local Redevelopment and Housin
Law, N.J.S.A. 40A:12A -1 et seq. (the "Redevelopment Law") to determine whether certai
parcels of land within the Borough constitute an area in need of rehabilitation and/or an area i
need of redevelopment; and
WHEREAS, by Resolution No. 18 -98, adopted on May 3, 2018, the Borough Counc
authorized and directed the Planning Board to conduct an investigation to determine whether th
properties identified as Block 402, Lot 24 & 25 And Block 301, Lots 3, 4 & 5 on the Offici;
Tax Map of the Borough (collectively, the "Study Area ") constitute an area in need c
redevelopment according to the criteria set forth in the Redevelopment Law; and
WHEREAS, the aforesaid resolution authorized the Planning Board to investigate th
Study Area as a Non - Condemnation Redevelopment Area (as defined in Section 6(a) of th
Redevelopment Law), within which the Borough may use all of those powers provided under th
Redevelopment Law for use in a redevelopment area, except the power of eminent domain; and
WHEREAS, the Planning Board caused Beacon Planning and Consulting Services, LL
(the "Planning Consultant ") to conduct a preliminary investigation to determine whether th
Study Area should be designated as an area in need of redevelopment; and
WHEREAS, the Planning Board received a report and map depicting the Study Are
prepared by the Planning Consultant, entitled "217 -223 Roosevelt Avenue & 237 Rooseve
Avenue Redevelopment Area Assessment", dated June 2018 (the "Report"), concerning th
determination of the Study Area as an area in need of redevelopment; and
WHEREAS, on June 20, 2018, the Planning Board reviewed the Report, heard testimon
from a representative of the Planning Consultant, and conducted a public hearing during whic
the owners of the property in the Study Area and members of the general public were given a
opportunity to present their own evidence and/or to cross - examine the Planning Consultai
concerning the potential designation of the Study Area as an area in need of redevelopment; and
WHEREAS, the Planning Consultant concluded in the Report and testified to th
Planning Board on June 20, 2018 that the properties in the Study Area satisfy certain criteria R
redevelopment area designation set forth in the Redevelopment Law; and
WHEREAS, after the conclusion of the public hearing described above, the Plannin
Board determined that the Study Area satisfied the criteria set forth in the Redevelopment Lai
for designation as an area in need of redevelopment and determined that it would recommen
that the Borough Council so designate the Study Area; and
WHEREAS, on June 20, 2018, the Planning Board adopted a Resolution of Findings an
Conclusions setting forth such findings and recommendations; and
WHEREAS, the Borough Council agrees with the conclusions of the Planning Boat
that the Study Area satisfies the criteria for redevelopment area designation set forth in th
Redevelopment Law and the Borough Council finds that such conclusion is supported h
substantial evidence; and
WHEREAS, the Borough Council now desires to designate the Study Area as a Not
Condemnation Redevelopment Area, pursuant to N.J.S.A. 40A: 12A-6.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, as follows:
Section 1. The foregoing recitals are incorporated herein as if set forth in full.
Section 2. The Borough Council accepts the recommendations and conclusions of the
Planning Board.
Section 3. Based upon the findings and recommendations of the Planning Board, and
the Borough Council's conclusion that such findings and recommendation are supported by
substantial evidence, the Study Area is hereby designated as a Non - Condemnation
Redevelopment Area.
Section 4. The Borough is authorized to prepare a redevelopment plan for the Non -
Condemnation Redevelopment Area described herein, including an amendment to an existing
redevelopment plan or a stand -alone redevelopment plan.
Section 5. This resolution shall take effect in accordance with applicable law.
