BOARD ABSENT: K.O'CONNELL AND S. THOMSON OTHERS PRESENT: S.JANIK, CLERK; J.HARVEY, ATTORNEY; J.TESTIN, COMMUNITY DEVELOPMENT DIRECTOR; A DE BONI, ADMINISTRATIVE ANALYST; C.MINICK, FINANCE DIRECTOR; D.BENNETT, CHIEF OF POLICE; APERSONS, PUBLIC WORKS DIRECTOR; S.LARSON, ENGINEER; S.SHEETZ, PLANNER; M.GIBAS, RECORDING SECRETARY; AND T.L. BURGHARD, ADMINISTHATOR VACATION OF A PORTION OF FRITZ ROAD Mayor Rock called the meeting to order at 7:27 p.m. Present roll call stands. Mrs. Stephanie Houk Sheetz presented to the Board a drawing ot the roadway in question. Fritz Road is a 40-toot wide publicly dedicated right-ot-way that is currently maintained by the Village. The Developer ot Hidden River requested the Village to vacate 20 teet ot the portion ot Fritz Road that would be on the Hidden River side ot the property. There will still be reminants ot that road that will still be publicly dedicated. Now the Streams preliminary plat is showing a dedication or use ot existing right-ot-way ot ,approximately ot 540' ot the existing Fritz Road, instead of a straight road, it will meander. In staff's opinion, we're not losing a road, just shifting where the road is going to be. Staff feels it would be a good option to vacate the entire 40 foot right-of-way and dedicate it to a certain party. Mr. Ed Welsh, the attorney for Midwest Development, stated the gravel road would still remain as an access tor Mr. Fritz until the additional right of way is provided. Mr. Fritz stated he did not want the access road to his home to change. It would be more difficult for him to travel with his machinery down the proposed road. Ms. Mary Stewart, a LeWood Drive resident, stated her objection to the removal of the road. Mr. Welsh stated access is not being denied rather enhanced because the road will be paved. Mr. Gary Lichtenwalter stated he is the landowner on the right hand side where the proposed Streams Development is. The Streams have the option to buy that land, and, if the people ot the- Streams do not exercise their option to purchase the property, he would like to have the property remain as it is now. It would be extremely difficult for Mr. Fritz to move his farm equipment through the subdivision. Mr. Arvin Keneski, stated he did not know anything about the Streams Subdivision. Mr. Ross Stewart stated he is concerned with the farm equipment having to travel through the subdivision and Fritz Road should be kept the way it is. Mr. Burghard questioned if the public understands that if Fritz Road is kept the way it is, it will become a collector and all traffic from those two subdivisions will be directed up north through LeWood. Mr. Ross Stewart stated they are aware of that. A representative of the Streams developer stated their preliminary plat was designed to respect the right-of-way as it exists today and requested not vacating Fritz Road. Mr. Welsh requested just vacating the western half. Trustee Calabrese moved to close the Public Hearing and return to the regular business meeting. Seconded by Trustee Collins. Vote by roll call. Swalwell, yes; O'Connell, absent; Thomson, absent; Cherry, yes; Calabrese, yes; Collins, yes. 4 yes, 0 no, 2 absent. Motion Carried.
