APPROVING THE RENEWAL OF PLENARY RETAIL CONSUMPTION LIQUOR LICENSE
NO. 1201 -33- 038 -008 FOR THE 2017 -2018 LICENSE TERM PURSUANT TO A SPECIAL
RULING GRANTING N.J.S.A. 33:1-12.18 & 12.39 RELIEF

WHEREAS, a Verified Petition was filed the New Jersey Division of Alcoholic Beverage Control for a
Special Ruling pursuant to the provisions of N.J.S.A. 33: 1 -12.18 requesting authorization for the Borough
of Carteret Alcoholic Beverage Control Board ( "ABC Board "), the local issuing authority, to consider the
renewal of Plenary Retail Consumption Liquor License No. 1201 -33- 038 -008 ( "License ") for the 2017 -2018
license term by way of the issuance of a "new" license therefore upon the failure to file timely renewal
applications for the aforesaid license terms, and further, for relief pursuant to N.J.S.A. 33: 1 -12.39 to
subsequently consider the renewal of the subject License for the 2016 -2017, 2017 -2018 & 2018 -2019 license
terms in its inactive state; and
WHEREAS, according to the Director's Special Ruling, dated May 23, 2018, the ABc Board has been
authorized to consider the application for a new license for the above License upon the failure to file timely
renews for the 2017 -2018 license term, and thereupon to grant or deny said application in the reasonable
exercise of its discretion, all in accordance with the provisions of N.J.S.A. 33: 1- 12.18; and
WHEREAS, further, in accordance with the Director's Special Ruling, relief was also granted pursuant to
N.J.S.A. 33:1 - 12.39, authorizing the ABC Board to consider an application for renewal of the subject License
for the 2016 -2017, 2017 -2018 & 2018 -2019 license terms, in its inactive state, should the Borough act to
approve the application for a new License pursuant to the relief granted by the Director under N.J.S.A. 33:1-
12.18.
WHEREAS, all of the requirements for the ABC Board to properly consider the above actions, including
the publication requirements set forth in N.J.A.C. 13:2 -1.5 with regard to the application for the "new"
License as set forth in the Director's Special Ruling, have been satisfied.
NOW, THEREFORE, BE IT RESOLVED by the Alcoholic Beverage Control Board of the Borough of
Carteret, County of Middlesex, State of New Jersey, as follows:
1. That the renewal of Plenary Retail Consumption Liquor License No. 1201 -33-
038 -008 is hereby approved for the 2017 -2018 license renewal term by way of the issuance
of a "new" license therefore, as authorized pursuant to the N.J.S.A. 33: 1 -12.18 Special
Ruling relief granted by the Director on May 23, 2018.
2. That, further, upon the renewal of Plenary Retail Consumption Liquor License
No. 1201 -33- 038 -008 for the 2017 -2018 license term as aforesaid, the renewal of the
subject License for the 2017 -2018 license term, in its inactive state, in hereby approved, in
accordance with the N.J.S.A. 33:1 -12.39 relief provided for in the Director's Special
Ruling.
3. That the ABC Board Clerk be and is hereby authorized and directed to issue an
A.B.C. License Renewal for Plenary Retail Consumption Liquor License No. 1201 -33-
038 -008 for the 2017 -2018 license term byway of the issuance of anew License therefore,
and to issue the said renewal for the 2017 -2018 license term, in its inactive state, Special
Ruling relief having been so granted therefore.
4. That two (2) certified copies of the Resolution be forwarded to the New Jersey
Division of Alcoholic Beverage Control, Licenses Bureau as may be required or provided
for.
