Account # T- 25-56- 817 -201 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. That the proposal from T &M Associates for engineering services with regard to the Construction Administration & Inspection Services and Project Design and LSRP services for the Noe Street Park Improvements Project at a total cost not to exceed $225,000.00 at the rate set forth in T &M's existing contract with the Borough is hereby approved. 2. That annexed hereto is a copy of said proposal. 3. That this action is approved as an award of a professional services contract pursuant to N.J.S.A. 40A:11- 5(l)(a) in accordance with the Borough's Fair and Open Process as authorized by law. 4. That a copy of this resolution be forwarded to the Borough's Purchasing Department, T &M Associates and Borough Director of Engineering. As requested, this proposal also encompasses the environmental consulting services at the Noe Street Park Properties required for the implementation of institutional and engineering controls and issuance of a Response Action Outcome (RAO) which are related to the NJDEP Green Acres property acquisition grant and closeout requirements. In addition to the park improvement field survey and design services, T &M. has prepared this proposal to provide Licensed Site Remediation Professional (LSRP) services to conduct the next phase of the environmental remediation at the Noe Street Park Properties. T &M completed a Site Investigation (SI) at the project site in question confirming the presence of site - wide historic fill. Based on this investigation, the next step toward issuing an RAO is the institution of engineering controls (capping the historic fill). As discussed, the Borough is currently redeveloping the site as part of a Borough wide drainage improvement project which will ultimately be utilized as a public park, and include walkways, a timber observation deck, a restroom, site lighting, landscaped areas, benches and other park amenities. SCOPE OF IMPROVEMENTS Based on the March 2018 Park Concept Plan (copy attached) prepared by our office at the Borough's request, the improvements to Noe Street Park include the following: A 6' wide concrete walkway around the perimeter of the site with connections to Noe Street, Pershing Avenue, and Emerson Streets; Site lighting to match the fixtures installed at Carteret Park with provisions for electrical outlets at the fixtures; Evergreen and deciduous trees and up to six (6) small landscaped areas throughout the park; YOUR GOALS. T &M ASSOCIATES, 11 Tindall Road, Middletown, NJ 07748 U 732.671.6400 © 732.671.7365 13 tandmassociates.com CART -G1801 July 3, 2018 Revised July 5, 2018 Page 2 Le: Mayor Daniel Reiman Borough of Carteret Re: Noe Street Park Improvements Project Design and LSRP Services • Six (6) Interpretative Signs to be located around the wet basin (signs will match the design of the nature signage at Carteret Park); • Timber spilt rail fence or timber railing (30" high) around the wet basin; • A 2,500 SF timber decking with metal railing at a single point in the southwest corner of the wet basin or as directed by Carteret Engineer; • Benches, picnic tables, bike racks, and waste containers throughout the site; • A Unisex bathroom to be constructed in existing storage area of generator building on Noe Street site utilizing existing connections to utility services on site; • A 30' high aluminum Flagpole with a light; and • An earthen engineered environmental cap to cover the onsite historic fill as appropriate. (NOTE: SEE LSRP SERVICES BELOW) The estimated construction cost for the improvements noted above is approximately $1,500,00. (THIS INCLUDES PARTIAL CAP OF SITE) Upon authorization from the Borough, we are prepared to proceed with the Design and LSRP Services for the Noe Street Park Improvements, as described below. SCOPE OF SERVICES LSRP SERVICES Item 1: LSRP Management, Technical Support and Project Coordination The LSRP is required to oversee the remediation activities conducted at the Site in accordance with the Site Remediation Reform Act (SRRA). T &M's LSRP will provide management and technical support services during the proposed activities as needed (e.g. clean fill coordination, engineering control improvement requirements, etc.). In addition, services will include assisting with follow up of the Hazardous Discharge Site Remediation Fund (HDSRF) application, coordination with the NJDEP, the Borough, contractors, as well as time for meetings, teleconferences, etc. Item 2: Environmental Cap - Design and Construction Phase Oversight T &M will provide environmental construction drawings and details for cap instal lation/construction activities. Generally, a cap consisting of one foot of clean fill/topsoil, while the cap in the landscape areas will consist of two feet of clean fill/topsoil. All imported fill material including, but not limited to, topsoil, quarry fines, dense grade aggregate, clean stone and sand must be sampled and analyzed in accordance with the NJDEP Fill Material Guidance for SRP Sites (April 2015), Section 6, Clean Fill prior to delivery to the site. The Owner and LSRP must APPROVE the material for it to be considered acceptable for use on the NJDEP SRP site. Upon approval of the source of the fill material the Contractor shall provide load tickets or bills of lading identifying the source of all material furnished for the project. It is acknowledged that T &M's LSRP will NOT be able to issue the referenced RAO if pre - approval of the material imported to the Site is not granted by the LSRP. T &M will collect and organize material manifests associated with cap installation/construction activities for submission in a final Remedial Action Report (RAR) (see below). Item 3: Deed Notice Preparation Following installation of the on -site engineering controls (soil cap), T &M will assist the Owner in preparing Deed Notice to establish an area where soil contamination due to historic fill material that will remain above a concentration that would allow for unrestricted use of the property. The Deed Notice will be prepared in accordance with N.J.A.C. 7:26C -7.2 and Appendix B, including the following exhibits: • Vicinity Map • Metes and Bounds Map and Legal Description • Property Map • Restricted Area Map, including as -built diagrams of soil engineering controls • Soil Sample Location Plan • Restricted Area Data Table, including analytical results regulatory standards • Narrative Description of Institutional Control (Deed Notice) • Narrative Description of Soil Engineering Controls In accordance with N.J.A.C. 7:26C, the Deed Notice will be filed with the appropriate agencies (hard copy and electronic copy), including: 1. NJDEP; 2. Municipal clerk, mayor and town council of each municipality in which the property is located; 3. Local, county and regional health departments; 4. Any gas, electric, water, sewer, cable and other utilities that service the property or have a license or easement to cross the property; and, 5. Any other person who requests a copy. O CART-G1801 July 3, 2018 Revised July 5, 2018 Page 4 Le: Mayor Daniel Reiman Borough of Carteret Re: Noe Street Park Improvements Project Design and LSRP Services Item 4: Remedial Action Permit Preparation — Soil and Groundwater Once the Deed Notice has been filed with the appropriate agencies, T &M will complete the Remedial Action Permit Application —Soil (Historic Fill) for submittal to the NJDEP along with the RAR (see below). Submittal of this form will require an estimated cost of maintaining the engineering controls at the site, determination of the Financial Assurance instrument, and an Initial Application Fee (The NJDEP fee is not included in this proposal and is not covered by HDSRF). A Remedial Action Permit Application — Groundwater is not required for historic fill; however, the groundwater impacts will be noted on the Remedial Action Permit - Soil and the CEA/WRA Fact Sheet Form will be submittal to the NJDEP along with the RAR. In addition, the CEA Map, Site Location Map, Cross - Section, GIS compatible CEA boundary and NJDEP Electronic Well Search will be completed and submitted for the groundwater impacted by historic fill. Note: The subsequent NJDEP requirements following the Deed Notice and Remedial Action Permit submittals are not included in this proposal which include annual Remedial Action permit fees, cap inspections, Biennial Certifications, etc. In accordance with the Administrative Requirements for the Remediation of Contaminated Sites (ARRCS) Rules N.J.A. C. 7:26C, for each year following issuance of a Remedial Action Permit, the NJDEP will invoice the permittee(s) a Remedial Action permit fee on a yearly basis until termination of the permit. This fee is not included in this proposal and will be the responsibility of the Borough for each year that the Deed Notice and Remedial Action Permit remain in place. In addition, as required by the NJDEP, a biennial certification for the Deed Notice at the property will need to be completed by an LSRP every two (2) years. As part of the biennial certification, inspection and documentation (photos, inspection logs, etc.) of the physical integrity of all engineering controls associated with the cap is required. Based on the proposed ]-foot vegetation cap (two feet in planting areas), one (1) inspection per year will be proposed. A Remedial Action Protectiveness /Biennial Certification Form — Soil will also be completed and submitted as part of the biennial certification process. Please note the subsequent NJDEP requirements following the Deed Notice and Remedial Action Permit submittals described above are not included in this proposal. Item 5: Remedial Action Report Preparation A Remedial Action Report (RAR) will be prepared for submittal to the NJDEP. In accordance with N.J.A.C. 7:26E -4.9 and 5.7, the RAR will include details of the results of the remediation activities (cap installation/construction); a summary of the history of the site; a general description of the physical setting; a summary by AOC of contaminant concentrations and applicable remediation standards; a summary of remediation costs; a copy of the Deed Notice, stamped "Filed" along with a Remedial Action #e. " fik CART-G1801 July 3, 2018 Revised July 5, 2018 Page 5 Le: Mayor Daniel Reiman Borough of Carteret Re: Noe Street Park Improvements Project Design and LSRP Services Permit form; an updated Receptor Evaluation Form; a completed Case Inventory Document; and the Remedial Action Report form signed by the Person Responsible for Remediation and the LSRP assigned to the Site. Item 6: NJDEP Forms The following forms will be completed and submitted to the NJDEP as required: A. Case Inventory Document: The Case Inventory Document (CID) is a concise summary of all ADCs and major case components that serve to form the basis for remedial decisions. The person responsible for conducting the remediation shall develop and submit the CID with each remedial phase report and Direct Oversight Documents. B. Cover /Certification Form C. Remedial Action Report Form: This form is used when submitting a Remedial Action Report to the NJDEP. D. Remedial Action Permit Application: This form is used to apply for a permit for a soil /groundwater remedial action that includes an engineering and/or institutional control that require long -term monitoring, maintenance and evaluation requirements. E. Classification Exception Area/Well Restriction Area Fact Sheet Form: This form is used to document the vertical and horizontal extents of the CEA/WRA, type of contamination present and the anticipated duration of time the restriction will remain in place. For historic fill the CEA will encompass the Site boundary and the timeframe will be indeterminate. F. Response Action Outcome Form: The purpose of this form is for a LSRP to memorialize the completion of remediation by issuing an RAO to the person responsible for conducting the remediation. The RAO renders the LSRP's opinion that the site has been remediated in accordance with all applicable statues, regulations and guidance. This form is submitted to the Department simultaneously with the RAO when the LSRP issues the RAO to the person(s) conducting the remediation. This form allows for a self - evaluation compliance check by the LSRP helping to ensure that the RAO accurately reflects the scope and extent of the remediation and appropriate notices. Note: Any NJDEP fees associated with the various forms listed above are not included in this proposal and will need to be prepared by the Borough for submittal with the forms. 000 ► CART -61801 July 3, 2018 Revised July 5, 2018 Page 6 Le: Mayor Daniel Reiman Borough of Carteret Re: Noe Street Park Improvements Project Design and LSRP Services Item 7: Response Action Outcome (RAO) Upon completion of all required remedial activities and once the T &M LSRP has determined that the investigation and remediation is fully protective of public health, safety and the environment, our LSRP will issue site -wide RAO. The LSRP will make this determination based on the remediation conducted, supervised and reviewed, and ultimately accepted by the LSRP using independent professional experience. In accordance with the SRRA, the LSRP is authorized to memorialize the completion of remediation by issuing a RAO and Covenant not to Sue (CNS) to the person responsible for conducting the remediation. The RAO renders the LSRP's opinion that the Site has been remediated in accordance with all applicable statutes, regulations, and guidance. The RAO will be issued to the NJDEP and client along with a Response Action Outcome form which will represent the LSRP's opinion that: • There are no discharged hazardous substances or hazardous wastes present at the Site or area of concern; or, • There are discharged hazardous substances or hazardous wastes, present at the Site, area of concern and /or migrating from the Site that have been remediated in accordance with all applicable statutes, regulations, and guidance; and, • The remedial action undertaken is protective of public health, safety and the environment. The T &M LSRP will use the standard format RAO shell document posted by the NJDEP to ensure content consistency. The LSRP is not allowed to modify the content of a RAO except as explicitly provided for in the NJDEP guidance. In addition, the client should note that the RAO is subject to a 3- year NJDEP auditing timeframe, during which the Department can audit or rescind the RAO if it is deemed to not be protective of public health, safety and the environment. Note: For the purposes of this proposal, T&M has assumed that no additional AOCs other than the historic fill that is present at the Site If additional ,400 or other contaminants are identified during the work, additional investigation and reporting may be required following the completion of the tasks described above and are not included in this proposal. CIVIL DESIGN SERVICES Based on the above outlined scope of improvements, we will provide the following design services for this project and the above listed park improvements: We will work with the Borough and develop a theme for the site. We will work with the Borough's architect consultant, out of scope for a unisex bathroom at the generator building lower lever with storage for recreation equipment as space allows. 3. We will provide topographic field survey of the areas included as part of the proposed improvements. Horizontal and vertical data will be tied into the datum used for previous projects at the site. (a price quote from the recommended surveyor was quoted and was within T &M's estimate. The Borough can select either surveyor.) 4. We will prepare base maps for the project by compiling the survey noted above, previous surveys and the Borough of Carteret aerials. (a price quote from the recommended surveyor was quoted and was within T &M's estimate. The Borough can select either surveyor.) 5. Once the base maps are prepared, we will conduct field investigations to verify the mapping and note conditions of existing features. Utility locations and available electrical service will be reviewed and located. 6. We will prepare preliminary plans and a preliminary construction cost estimate for the proposed improvements for review and approval by the Borough prior to proceeding with final design. 7. Upon approval of the preliminary plans, we will prepare final construction plans for the proposed improvements. 8. Specifications will be based on the 2007 NJDOT Standard Specifications and will be prepared in T &M Associates' format. 9. Upon completion of final engineering documents, a construction cost estimate will be prepared. 10. Upon completion and approval of the final design documents, T &M Associates will print and distribute specifications to prospective contractors. Cost of printing will be offset by the purchase price of the plans and specifications. 11. T &M Associates will answer any questions that arise during the bidding phase of the project from prospective bidders. 12. T &M Associates will attend the bid opening with the appropriate Borough Officials. 13. We will receive the bids received and make a recommendation of award to the Borough. Construction administration and inspection services are budgeted at $100,000 based on a $1,500,000 project estimate. Note: The NJDEP fees associated with the LSRP program are not included in this proposal and will be paid directly by the Borough. LIMITATIONS This proposal does not include environmental investigations beyond what is presented. T &M will rely on the accuracy of any information submitted to us by the Client in the performance of our services and will not be held responsible for errors or inaccuracies contained in information provided to us. T &M shall be responsible only for its activities and that of its employees on the Site. Neither the professional activities nor the presence of T &M or its employees or subcontractors on a Site shall imply that T &M controls the operations of others. If any condition is observed by T &M that warrants a notification to the NJDEP, in accordance with 7 :1 E- 5.3 and/or N.J.A.C. 7:26E -1.4, T &M will notify the Client prior to notification to the NJDEP, if required.
