CALL TO ORDER Mayor Vizcarra called the City Council Regular Meeting to order at 7:30 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: ABSENT: ALSO PRESENT: Councilmember- Chavez, Sternquist, Wong, Yu, Vizcarra Councilmember -None Interim City Manager /Parks and Recreation Director Burroughs, Interim City Attorney Vail, City Clerk Flandrick, Community Development Manager Lambert, Financial Services Manager Molina, Public Services Manager Tidwell, Public Safety Officer Ariizumi 3. PLEDGE OF ALLEGIANCE Linda Payne, Chamber President and CEO, led those present in the Pledge of Allegiance to the Flag. 4. CEREMONIAL MATTERS — PRESENTATIONS — None JOINT CLOSED SESSION — CITY COUNCIL AND COMMUNITY REDEVELOPMENT AGENCY Councilmember Wong recused herself from the closed session. At 7:33 p.m., the Community Redevelopment Agency was called to order and recessed with the City Council to a joint closed session for the purpose stated below. Purpose: Existing Litigation Cases: One (1) — The Interim City Attorney /Agency Counsel has recommended the City and Agency hold a closed session regarding existing litigation (TCD v. City of Temple City) Authority: Government Code Section 54956.9(a) Representatives: Interim City Manager /Executive Director, Interim City Attorney /Agency Counsel, City /Agency Special Counsel RECONVENE At 8:28 p.m., the City Council and Community Redevelopment Agency meetings were reconvened with all members present. CLOSED SESSION STATEMENT Interim City Attorney Vail stated the City Council and the Community Redevelopment Agency met with its legal counsel with regard to the lawsuit, TCD v. City of Temple City, discussed the case and its status and provided direction to counsel. There was no reportable action. The Community Redevelopment Agency concluded its agenda and adjourned at 9:11 p.m. 5. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Temple City resident complimented Council on choosing to broadcast its meetings. CONSENT CALENDAR Councilmember Wong moved to approve the Consent Calendar, seconded by Councilmember Chavez and unanimously carried by the following roll call vote: AYES: Councilmember- Chavez, Sternquist, Wong, Yu, Vizcarra NOES: Councilmember -None ABSENT: Councilmember -None ABSTAIN: Councilmember -None A. APPROVAL OF MINUTES Approved as presented: 1) Minutes of the City Council Special Meeting of August 27, 2009; 2) Minutes of the City Council Regular Meeting of September 1, 2009; 3) Minutes of the City Council Special Meeting of September 5, 2009. B. PLANNING COMMISSION ACTIONS — MEETING OF SEPTEMBER 8, 2009 Received and filed the Planning Commission actions of their meeting of September 8, 2009. C. AWARD OF CONTRACT FOR PURCHASE OF FORD ESCAPE HYBRID Awarded a contract to Bob Wondries Ford for the purchase of one (1) Ford Escape Hybrid for use by the Code Enforcement Division in the amount of $27,990.38 (plus tax and fees). D. APPROVAL OF PROGRESS PAYMENT NO. 6 TO CHAP INC. FOR WORK PERFORMED ON THE LIVE OAK PARK MULTIPURPOSE FACILITY PROJECT Approved progress payment No. 6, in the amount of $188,100.00, to Chap Inc. for work performed on the Live Oak Park Multipurpose Facility Project (P08 -01). E. APPROVAL OF MUNICIPAL LAW ENFORCEMENT SERVICES AGREEMENT Approved the Municipal Law Enforcement Services Agreement by and between the County of Los Angeles and the City and authorized the Mayor to sign. F. RELEASE OF GRADING SECURITY FOR PARCEL MAP NO. 060102 AT 4823 -4829 ARDEN DRIVE Authorized release of security, in the amount of $10,000.00, to ensure that grading improvements were completed on the private property located at 4823 -4829 Arden Drive, Parcel Map No. 060102. G. RECEIVE AND FILE ANNUAL SUPPLEMENTAL LAW ENFORCEMENT SERVICE FUND (SLESF) CONSOLIDATED REPORT AND CERTIFICATION STATEMENT FOR FISCAL YEAR 2008 -2009 Received and filed the annual SLESF Consolidated Report and related certification statement submitted to the County's Supplemental Law Enforcement Oversight Committee. H. APPROVAL OF SALARY RANGE AND CLASS SPECIFICATION FOR THE SPORTS OFFICIAL POSITION Approved the salary range and class specification for the Sports Official position. ADOPTION OF RESOLUTION NO. 09 -4631 — APPROVAL OF PAYMENT OF BILLS Adopted Resolution No. 09 -4631, a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $702,649.62 DEMAND NOS. 27726 THROUGH 27842. 7. UNFINISHED BUSINESS A. CITY HALL HOURS OF OPERATION AND WORK SCHEDULE FOR CITY EMPLOYEES Interim City Manager Burroughs stated, at the City Council meeting of August 18th, Council directed staff to come up with a plan to keep City facilities open five days a week. The City is currently on a 4 -10 work schedule wherein City Hall and the Civic Center are open Monday through Thursday from 7:30 a.m. to 6:00 p.m. and closed on Fridays. Staff proposed two options for Council's consideration: an open 4 -10 schedule and a 9 -80 open work schedule. The open 4 -10 schedule would allow City Hall and the Civic Center to be open from 7:30 a.m. — 6:00 p.m. Monday through Friday, in which some staff would work Monday - Thursday and some staff would work Tuesday- Friday. With a 9 -80 open work schedule, City Hall and the Civic Center would be open from 8:00 a.m. - 6:00 p.m. Monday- Thursday and from 8:00 a.m. - 5:00 p.m. on Fridays, with both facilities half- staffed on Fridays. All employees (except weekend staff) would work Monday- Thursday and every other Friday. Staff recommended the open 4 -10 schedule which would keep office hours the same as they currently are Monday through Thursday and the same hours on Friday. Staff also recommended that changes to the current work schedule not be implemented until January 4, 2010 to allow sufficient time for the new hours to be advertised in the City's winter issue newsletter and also eliminate the need to change the designated holidays for fiscal year 2009 - 2010. In response to Council questions, Interim City Manager Burroughs stated, although not substantial, there would be additional costs with both schedules for part-time help and utilities. The security concerns with half - staffing have been addressed. The open 4 -10 schedule would provide full services every day Monday through Friday. Jerry Jambazian, Temple City businessman, asked if there would be any day that a person comes into City Hall and 100% services were not available. Interim City Manager Burroughs stated that should not be the case. Permitting and inspections through the Community Development Department will be closely monitored as there is one individual who performs those duties at present, but other employees will be trained to process basic permits. Councilmember Wong moved to approve an open 4 -10 work schedule effective January 4, 2010, seconded by Councilmember Chavez and unanimously carried by the following roll call vote: AYES: Councilmember- Chavez, Sternquist, Wong, Yu, Vizcarra NOES: Councilmember -None ABSENT: Councilmember -None ABSTAIN: Councilmember -None 8. RECESS TO COMMUNITY REDEVELOPMENT AGENCY MEETING The Community Redevelopment Agency concluded its meeting after the closed session earlier in the evening and adjourned at 9:11 p.m. Minutes of the Agency Meeting are set forth in full in the Agency's records. RECESS TO COMMUNITY DEVELOPMENT AND HOUSING AUTHORITY MEETING At 9:28 p.m., the City Council recessed to the Community Development and Housing Authority Meeting. Minutes of the Authority Meeting are set forth in full in the Agency's records. RECONVENE AS CITY COUNCIL The City Council meeting was reconvened at 10:11 p.m. with all Councilmembers present. 11. ACTION ON REQUEST BY CRA — None 12. UPDATE FROM CITY MANAGER — None Mayor Pro Tem Yu moved to continue Agenda Items 13 through 15 to the next City Council meeting, seconded by Councilmember Wong and unanimously carried. 13. MATTERS FROM CITY OFFICIALS (continued to next meeting) A. DISCUSSION REGARDING THE REPORTING OF POTENTIAL BUSINESS AND DEVELOPMENT ACTIVITY ON LAS TUNAS DRIVE Since mid - August, Staff has been informing the City Council about potential development and businesses in the downtown area. The Council has received weekly confidential memos if there has been any significant activity. At the September 1st City Council meeting, Councilmember Chavez asked that staff place this item on the next City Council agenda for discussion. 14. MAYOR VIZCARRA 1) Remodel of City Council Chambers 2) Chamber Report — SGV Economic Partnership Meetings Councilmember Chavez thanked the Sister Cities organization, especially Nancy Terry and Anita Aemmer. The Temple City High School students were welcomed back from Australia and are great ambassadors of the City. Councilmember Sternquist requested the meeting be adjourned in memory of City employee Fern Kokayko who recently passed away. Councilmember Wong reported on a social media session and an e- service session she attended at the League conference. She purchased a book by the keynote speaker to share with all of the Council. She also thanked the Sheriffs Department for quickly responding to a neighborhood incident. 1 1 1 1 1 City Council Minutes September 21, 2009 Page 5 16. ADDITIONAL PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Mary Burke, Temple City resident, complimented staff on the latest newsletter, stating it was well written with good photography and a joy to read. She felt Council would soon have to come to a decision regarding the color of downtown buildings and was glad that City Hall would soon be open on Fridays. Peggy Miller, Temple City resident, expressed thanks to the Sheriffs Department, in particular Herb Howland, for his help in locating her daughter who wandered off of school premises about two weeks ago, and asked if the City could honor him in some way 18. CLOSED SESSION STATEMENT Interim City Attorney Vail stated The City Council met with its recruitment consultant to discuss the City Manager recruitment process and provided direction.
