HomeMy Public PortalAboutORD-CC-1988-02ORDINANCE NO. 88-02 AN ORDINANCE PERTAINING TO THE INSTALLATIONS OF "POINT OF USE" AND "POINT OF ENTRY" WATER TREATMENT DEVICES. BE IT ORDAINED BY MOAB CITY CORPORATION, a body politic duly organized under the laws of the State of Utah and created by the Governing Body of Moab City Corporation, State of Utah, that the following responsibilities and liabilities shall pertain to the installation of "point of use" and "point of entry" water treatment devices: is responsible for the quality of water delivered to its consumer, and WHEREAS, Consumers of water may install "point of entry" and/or "point of use" treatment devices on their private home plumbing, and WHEREAS, these "point of entry" and/or "point of use" water treatment devices are designed to alter the quality of water, and WHEREAS, this altering of water quality is beyond the control of Moab City Corporation and it's staff; THEREFORE, BE IT ORDAINED, that Moab City Corporation shall not accept responsibility or liability for the quality of water at any location on a customer's private home plumbing system beyond the point where a "point of entry" or point of use" water treatment device has been installed. WHEREAS, Moab City Corporation, as a public drinking water system DEFINITIONS Unless the context specifically indicates otherwise, the meaning of terms used in this ordinance shall be as follows: 1. Point of Entry Water Treatment Device: Any device designed to alter water quality which is installed on the consumer's household plumbing in such a manner that all water entering the household plumbing is affected by the device. 2. Point of Use Water Treatment Device: Any device designed to alter water quality which is installed on a specific tap or outlet of a consumer's plumbing in such a manner that only water issuing from that tap or outlet becomes affected by the device. 3. Consumer: A household and the individuals which reside therein which is connected to, and receiving their water supply from, the public drinking water delivery system. 4. Public Drinking Water System: Any system which has at least fifteen (15) service connections, or serves at least twenty- five (25) individuals daily at least sixty (60) days out of the year. 5. May: is permissive. 6. Shall: is mandatory. This ordinance shall take effect and be enforced from and after its passage and publication according to law.
