Roll Call: 2. Approval of Agenda: Minutes of February 23, 2011 Commissioner Soles moved, and Commissioner Sumrall seconded the motion to approve the minutes. Motion carried: 6 -0. 3. Open Forum: None. 4. Public Hearing and Action Regarding: a. Byers Peak Ranch Planned Development District Plan Parts of Sections 19 and 20 Township 1 South, Range 75 West of the 6 PM County of Grand, State of Colorado Applicant Byers Peak Properties, LLC. Commissioner Sumrall moved, and Commissioner Shapiro seconded the motion to open the public hearing on the Byers Peak Ranch Planned Development District Plan Parts of Sections 19 and 20 Township 1 South, Range 75 West of the 6 PM County of Grand, State of Colorado Applicant Byers Peak Properties, LLC. Motion carried: 6 -0. Proof of publication was provided. TP Trotter briefed the Commission on the history of the Byers Peak Ranch Planned Development District Plan Parts of Sections 19 and 20 Township 1 South, Range 75 West of the 6 PM County of Grand, State of Colorado. Background information: In the fall of 2007, the Town of Fraser received the Amended Petition for Annexation for Byers Peak Ranch. The Town Board adopted a resolution finding that the Petition was substantially complete. In early 2008, the Town Board held an annexation hearing and adopted a resolution finding that the property is eligible for annexation. In October 2010, the Town and BPR entered into a Pre annexation Agreement. On February 23, 2011, In October, 2010, the Planning Commission had a workshop with the applicant to discuss ideas and gather input for the Byers Peak Ranch property. Page 2 of 3 the Town received a submittal for a Planned Development District Plan for Byers Peak Ranch. At this time, Byers Peak Properties has submitted sufficient information for us to begin processing the request. The public process will begin with a hearing regarding the land use component (the PDD). Concurrently, others are processing the legal, fiscal, and infrastructure, and contractual components of the proposal. The role of the Planning Commission in the annexation process is to provide the Town Board with a recommendation regarding the land use and zoning proposed for the property. The following is a brief project description submitted by the applicant: "Byers Peak Ranch is a 295 acre neighborhood located south of Mill Ave. and west of the railroad tracks. Fraser Valley Parkway bisects the site. The existing neighborhood to the north of the property includes single family, attached residences and apartments oriented in a traditional grid pattern; community meeting facilities, Town Hall, Town maintenance facilities and the Fraser Valley Elementary School. The PDD for Byers Peak Ranch contemplates 498 detached and 938 attached residential units, 350 lodging units, RV sites and 270,000 sf of commercial /industrial units. The residential product types will vary throughout the community and include single family lots, attached units, and lodging integrated into a cohesive community linked by open space corridors. The community will include a central open space and park with recreational uses and ponds that will be accessible to all residents. The commercial /industrial uses are located along the railroad tracks and will serve as a transition from the railroad tracks to the residential neighborhoods. There will also be some commercial uses along the Fraser Valley Parkway to serve the residents and visitors. Planned Development District zoning is proposed for the property (rather than one of the traditional zoning districts. The Planned Development District (PDD) is located in Chapter 16, Article 5 of the Town Code. The PDD plan application is intended to generate enough site plan information in the form of written statements and schematic plans in order to provide adequate information for review by decision making bodies and the general public in regards to the proposed PDD zoning. Furthermore, the standards and procedures are intended to ensure integrated planning goals and objectives of the Comprehensive Plan while allowing greater flexibility and innovations in development and site designs than is typically possible under conventional zone district regulations. In addition to the zoning component, the Planning Commission should consider the Town of Fraser Three Mile Plan (a component of the 2010 Comprehensive Plan). The Three Mile Plan states that development proposals for areas surrounding the Town of Fraser should be considered for incorporation within the municipality before development in unincorporated areas. Higher density residential, mixed use, commercial and light industrial should be directed towards municipal areas because public utilities and services can be provided more efficiently. The Comprehensive Plan notes that the fiscal impacts of development should be considered as a component of the decision making process regarding potential annexations. This information will be provided to the Town Board along with other economic components of the annexation. Sheet 2 of 8 lists the land use and development notes for the 14 Planning Areas and depicts a development standards chart which identifies the proposed land uses, building heights and setbacks for each planning area. Sheet 4 of 8 depicts a land use plan and a site data chart which further identifies the proposed land uses, total acreage and density for each planning area. Jack Bestall outlined the proposed development for the Commissioners and members of the audience. Letters submitted regarding the proposed annexation were read into the record.
