THE BOROUGH CODE OF THE BOROUGH OF CARTERET.
WHEREAS, the Borough of Cartemt (the "Borough") has established curfews for juveniles
within the community based upon the age of the juvenile; and
WHEREAS, in consultation with the police department juvenile officer, and in light of the
Federal Missing Children Assistant Act which indicates that juveniles 13 years of age and
under are "at risk" when out alone late at night; the Mayor and CounciI of the Borough of
Carteret has determined that it is appropriate to amend the curfew ordinance for juveniles 13
years of age; and
WHEREAS, the Mayor and Council have also determined to establish a curfew for October
30, and for trick-or-treating on October 31.
NOW, THEREFORE, BE IT ORDAINED that the Borough Code section designated 168-
11 is hereby amended as follows:
1). Section 2. A is amended by deleting the age "twelve (12)" and replacing it with
the age "thirteen 13".
2). Section 2. B is amended by deleting the ages "thirteen to sixteen (13-16)" and
replacing them with the ages "Fourteen to sixteen (14-16)".
3). There shall be added a new section designated "Section 2.01" which shall mad in
its entirety as follows:
"Section 2.01:
A. It shall be unlawful for juveniles sixteen (16) years of age and under to be in any
public place within the Borough of Carteret on October 30 of each year
irrespective of the day of the week on which it shall fall, between the hours of 7:00
P.M. and 6:00 A.M. on the day next following. This section is intended to be in
addition to sections 2A and 2B of this ordinance and shall not be interpreted to be
modified by those subsections.
B. It shall be unlawful for juveniles sixteen (1) years of age and under to "trick-or-
treat" after 7:00 P.M. on October 31, Halloween, of each year."
