MINUTES
JUNE 7, 1993
I. ROLL CALL AND CALL TO ORDER
Chair Grote called the meeting to order at 7:15 p.m. Committee members Martens, Killen, and
Coyle answered the roll call. Chair declared a quorum present. Also attending was Administrator Schmidt,
Director Baker, Mike Stewart, John Barnes - State Transportation Department.
II. MINUTES - MAY 3, 1993
After brief discussion, Martens moved to accept the May 3, 1993 minutes as written, seconded by
Coyle and the motion carried.
III. HEART OF IDAHO FLAT WATER CANOE RACING SERIES - AUGUST 28,
1993
Mike Stewart distributed an outline for the Run From Sharlie Paddle for Your Life Canoe Race
(attached) and informed the committee that the race would start from the edge of the no wake zone near
Legacy Park run to Shore Lodge and back.
After discussion with the committee, Mr. Stewart decided that the race could be held without
reserving Legacy Park. Mr. Stewart will meet with the race organizers, discuss if there is a real need to use
Legacy Park and get back to the Parks and Recreation Committee at a future date.
IV. STATE TRANSPORTATION GRANT - JOHN BARNES
Mr. Barnes gave a brief background on the Federal Funding Act of 1991, the State Transportation
Department and its many sub departments and his job as Technical Assistant for Bike and Pedestrian Traffic.
Mr. Barnes informed the committee that the Payette Lakes Trail System has just been awarded a $947,000
grant for fiscal year 1996. He said the PL Trails grant may be moved into FY '95, the same year as the
grant given to the City of McCall, because some projects funded in '95 have been interrupted. The
committee asked Mr. Barnes if the city's bike path system and Payette Trails are funded in the same year,
could the two projects share engineering and other costs. Mr. Barnes said he didn't know, but encouraged the
committee to work with Mr. John Collins, the Idaho Transportation Department's road engineer assigned to
this area while going through the grant process. Mr. Barnes distributed a copy of the planning requirements
for projects of these types (attached).
The following summarizes the discussion between the committee and Mr. Barnes:
• The committee asked Mr. Barnes if the city's bike path system and Payette Trails are funded in the same
year, could the two projects share engineering and other costs. Mr. Barnes said he didn't know, but
encouraged the committee to ask Mr. Collins. He said the City of Boise is also raising the question because
they have several separate projects awarded in the same year.
• The committee asked Mr. Barnes to list the minimum compliance the city must have in place by October
1995 (when the funding year expires). Mr. Barnes said that the city will have to have initiated a
construction contract by that time, so the project will have to be engineered. He said that grant
administrators allow changes to specifics of the project, such as routing. As long as the "scope" of the
project remains the same, the plans can change. As long as a construction contract is out to bid at the close
of the funding year, extensions can be sought to cover the construction phase.
Administrator Schmidt told the committee that the design and engineering could not begin until
close to the opening of the grant year because the city cannot afford to front the expense more than one
month before reimbursement. He said that project design would likely begin in September 1994.
V. STAFF REPORTS
A. Recreation Director
1. Commercial use of city parks. Director read the city code(attached) concerning commercial use
of city parks and informed the committee that violating the city code is punishable as a general
misdemeanor resulting in a maximum of six months jail and/or $300.00 fine. Chair directed Director Baker
to contact Ernie Revello, who is managing a triathlon event involving the use of Rotary Park (according to
the promotion for the event) and inform him of the ordinance and his need to secure a special use permit for
his event.
B. Administrator
Administrator informed the committee that the city had been granted a one year extension
from the Land and Water Conservation Fund for compliance on land conversions involved in the
construction of Legacy Park. Administrator informed the committee that the L.W.C.F. people were
understanding of the need for an extension but are afraid of court appeals concerning the Hoyle and Kahlman
section dragging out compliance for five or more years.
Administrator informed the committee that High Mountain Nursery's bid of $12,800 was
the low bid for park maintenance and he expects the council approve the contract on Thursday and turn the
parks over to the contractor on Saturday, June 12.
Administrator informed the committee that the Toys for Tots Battle of the Bands - Mi11 Park
would include Juice Newton and council has asked for staff reports from police and fire so plans for the
concert are being prepared. The committee discussed the following objections to the change:
• The special use permit the committee recommended the council grant to Toys for Tots was based on an
understanding undisputed by promoter Ron White that the event would be similar in nature to the event he
staged in Mill Park last summer. That event drew about 1,000 people over a period of three days and no
more than 300-400 were in the park at any one time. Nothing in written presentations to the committee by
Mr. White or in the committee's minutes demonstrates that the committee willfully approved any event that
would draw more people than that into the park at any one time. The consensus of the committee is that
Mill Park is suited for events attracting crowds of no more than 500. The only time an event held in Mill
Park was larger than that was the first Arts and Crafts Faire which caused so many problems that it was
moved to Fairway Park the following year.
• Committee members expressed concern that even though the promoter is required to be bonded, wet
weather conditions prior to the event would seriously increace the danger of severe damage to the park's
landscaping, to the point that repairs could take portions of the park out of public use for the rest of the
season.
• Committee members are concerned that the addition of a major performer to this event changes it's
character from an innocent fund-raiser to a major commercial operation. Member Killen said that if the
event is allowed, she would like to see the council review the fee for closing the park in light of the
potential revenues such an event will attract.
Killen moved to recommend city council rescind the Toys for Tots Battle of the Bands
special use permit and send the park reservation application back to the Parks and
Recreation Advisory Committee. Substantial changes in the size and type of event
make the fees and/or location inappropriate. Martens seconded and the motion carried.
Administrator informed the committee that a R.F.P. for park concessions would not be prepared
for this summer. Chair requested staff to put the park concessions on the September agenda with the
objective to have an R.F.P. distributed in January for the'94 summer season.
VI. NEW BUSINESS
A. McDonald's playground equipment donation - Lori Braun
Chair informed committee that Mrs. Braun has received a donation of playground equipment from
McDonalds due to the closing of a McDonalds in Boise. Committee members had no initial objection to
the character of the equipment, which follows the theme of the franchise, but asked Chair to contact Mrs.
Braun and ask for pictures. Administrator also noted that replacement parts and pieces may not be available
or may be extremely expensive.
VII. OLD BUSINESS
A. Garnett Beach
Director informed committee that the Garnett Beach Homeowners Association had not yet gotten
their maps and by laws to Attorney Burton so no further progress has been made.
B. Parks Reservation System
After discussion concerning defining sizes of parties, closing parks down to the public, and
commercial ventures in the parks, Chair with consent of the committee will develop site specifics for each
park and have them ready for the July meeting.
C. Dock Building Permits on Payette Lake
Chair informed committee that she and committee member Killen were doing a parks tour prior to
the master plan public hearing and noticed a dock builder has set up shop near the net pens and the area
looked very messy. After discussion concerning safety, atmosphere of the park way and noise, Killen
moved to recommend council rescind all upland access permits along the city park way
between the Sports Marina and Mill Park on November 1, 1993 and send copy of the
action to Idaho Department of Lands. Seconded by Martens and the motion carried.
VIII. MASTER PLAN
Chair with consent of the committee deferred any further master plan action to the July meeting.
IX. REPORTS ON NON -CITY PARKS AND RECREATION ISSUES
Committee members had no new information to report.
X. OTHER BUSINESS
A. Skateboarding in the parks.
Committee member Martens informed the committee that skateboarders had been causing damage
to the railings at the Legacy Park entrance stair case. After discussion Killen moved to
recommend council amend ordinance title 8 chapter 14 of the city codes to include
prohibition of skateboards except as specifically designated and signed location
effective immediately and signs prohibiting skateboards be posted in Mill Park, Art
Roberts Park and Legacy Park. Coyle seconded and the motion carried.
XI. NEXT MEETING
Next Parks and Recreation Advisory committee meeting set for July 12, 1993 - 4:OOpm in the
council chambers.
The Run From Sharlie, Paddle -For -Your -Life Canoe Race
Date: August 28, 1993
Place: Legacy Park to Rotary Park (or Shore Lodge) and return, along the lake front.
Time: 10 a.m. race staart..
Summary: The Sharlie Canoe race is proposed to be part of The Heart of Idaho Flatwater
Canoe Racing Series, which takes in three flatwater canoe races in June, July and
August. The focus is on fun and intended to provide recreational paddling opportunities to
those who venture to Valley County to recreate in the summer. The first two races are on
Cascade Lake on June 19, and on the North Fork of the Payette River on July 17.
Co -Sponsors: Gravity Sports, Idaho River Sports, The Advocate, Cascade Chamber of
Commerce, The Advocate, Wetumpka Canoe Company, Water's Edge Resort.
Request: We would like permission to use Legacy Park as the place at which to start and
finish the race, and also as the place to conduct a pre -race paddling clinic, and post -race
awards and barbecue. The race shouldn't take more than an hour to an hour -and -a -half
to complete, and post -race activities shouldn't take more than a similar amount. We
would fully expect to be all wrapped up, cleaned up, and out of the park by 2 p.m. on race
day. We would also like to conduct a paddling clinic at the park at 8:30 a.m. that day, an
event that would be taking place while registration packets are being handed out.
Starting and ending such an event in one place greatly simplifies the problem of moving
canoes back to starting points from finishing points.
We plan on running race day registration from 8 to 9:30 a.m., with the race to start at
10 a.m.
Other: The race will be insured through the American Canoe Association, but is not a
"sanctioned race." We will obtain the necessary permit through the Valley County
Waterways Commission, as we've had to do for the first two races in the series. The
Idaho Department of Lands has no requirement for a permit, nor do they object to our use
of the lake for the event. We would like to run the race along the lake shore inside the
no -wake zone buoys. Having the race held along such a course would give the event some
visibility, would give visitors to McCall and residents alike a chance to watch something
that should be fun. There is a lot of flatwater paddling opportunity in this area, and it is
underdeveloped and underutilized. We will also have two privately -owned boats on site to
serve as safety boats, and will also have a sheriff's department marine patrol boat on
site, as they will also do for the Cascade Lake race.
401.04 Project Development for Enhancement and Congestion
Mitigation/Air Quality Proiects
Enhancement and Congestion Mitigation/Air Quality (CMAQ) projects
are placed in the program by submitting an application form to
Program Control. After the program is approved by the Idaho
Transportation Board, the following procedures need to be followed:
Step 1 On local projects a state/local agreement will be
prepared by Local Roads. Included in this agreement
will be the amount to be deposited by the Sponsor to
cover ITD review of the plans.

Prepare and submit an ITD-205, Authority for Project
Expenditures, by the District/Local Roads.
Funding for transit related projects will be
transferred to the Federal Transit Agency (FTA).
These projects will be administered by the Public
Transportation Division.
The District Planner (and Local Roads Area Engineer on
Local Projects) will prepare and submit to the
Environmental Section an ITD-654 and 654A
Environmental Evaluation for the determination of the
appropriate level Environmental Clearance. Additional
information that may be necessary will be identified
and direction given to the designing agency by the
Environmental Section.
Step 5 The ITD-783 Concept Approval (Figure 405.08-01) will
be submitted by the "Designing Agency." The minimum
submittal will include: Signature Sheet, Design
Standards (ITD-783A), Project Description, Vicinity
Sketch and Estimate. Approval of this form will be
all inclusive and constitute Concept Approval,
Preliminary Design Review and Design Approval, except
for projects that include Signalization (see Step 5a)
or Bridges (see Step 5b). When concept approval and
environmental clearance are complete the designing
agency shall write a letter requesting design
approval. Design approval will be granted by the
Roadway Design Engineer in accordance with
Administrative Policy A-13-02.
Step 5a On signal projects, prepare a set of plans for
(Signals) Preliminary Design Review in accordance with Section
12-308.01 of the Traffic Manual. A preliminary Design
Review will be required unless waived by the Traffic
Engineer and should follow normal procedures.
Step 5b On Bridge projects, prepare a set of plans for
(Bridges) Preliminary Design Review in accordance with Sections
411.03 and 411.04 of the Bridge Manual. A Preliminary
Design Review will be required unless waived by the
Bridge Engineer and should follow normal procedures.
Step 6 Prepare a complete set of plans following the format
for Federal -Aid plans outlined in Section 800 of the
Design Manual. Permit and Environmental Clearance
requirements will be the same as regular Federal -Aid
projects.
Step 7 A formal Final Design Review will be required and
should follow normal procedures. Prior to final
design, the project will be re-evaluated by the
designing agency to insure the environmental clearance
remains valid.

(C) Pets and Animals:
1. Domestic Animals: Domestic animals are not allowed within the
boundaries of City parks or park facilities except for animals
trained to assist and assisting a person with a physical disability.
2. Wildlife: Molesting, injuring, killing or disturbing any wild
creature or animal is strictly prohibited. This does not prohibit
game fishing as regulated by Idaho Fish and Game regulations.
(D) Ovemight Parking and Camping: Overnight parking and camping at
the parks and beaches is prohibited. Police are authorized to cite,
arrest, or remove from premises any violators of this provision.
(E) Political and Sectarian Uses: Persons or groups attempting to
persuade, convert, cajole, or engage in activities common to
political campaigns who solicit the public or interfere with the
public's quiet enjoyment of parks and facilities is prohibited.
Commercial Uses: No person, firm, corporation, association, or
other organization shall operate any concession, business, or
enterprise, or offer for sale any article or thing or item within City
parks or facilities except as authorized by a special use permit
issued by the McCall City Council.
(G) Firearms:. No person shall discharge firearms or any other
projectile firing device within or over the boundaries of City parks.
(H) Dangerous Games: No person shall take part in or abet the
playing of any games involving thrown or otherwise propelled
dangerous objects such as stones, arrows or javelins, except in
areas set apart for such forms of recreation. Golfing or driving golf
balls is prohibited.
(I) Other Prohibited Activities in Parks and Park Facilities:
1. Begging or soliciting for any purpose.
2. Gambling or operating games of chance or gaming devices.
3. Abandoning property.
4. Posting handbills, circulars, posters, or signs advertising any
