A RESOLUTION OF THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, FLORIDA, VACATING AND
ABANDONING A PORTION OF THE RIGHT-OF-WAY
COMMONLY KNOWN AS BANYAN ROAD AS SHOWN
ON THE PLAT OF POLO COVE, AS RECORDED IN
PLAT BOOK 24, PAGE 73 PUBLIC RECORDS OF PALM
BEACH COUNTY, FLORIDA, AND AS MORE
TICULARLY DESCRIBED HEREIN; AND FOR
HER PURPOSES.

WHEREAS, the er of the land abutting the property hereinafter described has
petitioned the To Gulf Stream ("Town") to abandon and vacate a portion of the
right-of-way comm nown as Banyan Road, over and across the lands more fully
hereinafter describe ;
WHEREAS, a duly no ublic hearing was convened on November 13, 2020 for
the Town Commission to w the request to abandon and vacate said right-of-way;
and
WHEREAS, Petitioner has c lied with all provisions and requirements of the
Town relating to the Petition andonment; and
WHEREAS, the Town Commis%aan
he Town of Gulf Stream does hereby find and
determine that there is not, noere be, a need for the use of the right-of-way
for any public purpose, that thnment does not, nor will not, prevent access
to a lot of record, and that the abandonment will not result in detriment to the
provision of access to adjacent properties or the general area.
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. The foregoing recitals are hereby ratified and confirmed.
Section 2. That portion of the right-of-way commonly known as Banyan Road,
as shown on the Plat of Polo Cove as recorded in Plat Book 24, Page 73, more
particularly described below, be and the same is hereby vacated and abandoned.
A PORTION OF BANYAN ROAD AS PLATTED IN THE PLAT OF POLO COVE,
ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 24, PAGE 73
OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA. SAID
PORTION OF BANYAN ROAD DESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTHWEST CORNER OF LOT 1 IN THE PLAT OF
POLO COVE;
THENCE SOUTH 84034'17" EAST ALONG THE NORTH LINE OF SAID LOT 1, A
DISTANCE OF 110.00 FEET TO THE SOUTHWEST CORNER OF BANYAN ROAD
AND THE POINT OF BEGINNING;
THENCE NORTH 0502543" EAST ALONG THE WEST LINE OF BANYAN ROAD,
A DISTANCE OF 50.00 FEET;
THENCE SOUTH 84034'17" EAST, A DISTANCE OF 50.00 FEET TO A POINT ON
THE EAST LINE OF BANYAN ROAD;
THENCE SOUTH 05025'43" WEST ALONG THE EAST LINE OF BANYAN ROAD,
A DISTANCE OF 50.00 FEET TO THE SOUTHEAST CORNER OF BANYAN
ROAD, AND ALSO A POINT ON THE NORTH LINE OF LOT 1;
