ROLL CALL AND CALL TO ORDER Chair Grote called the meeting to order at 7:15 p.m. Committee members Martens, Killen, and Coyle answered the roll call. Chair declared a quorum present. Also attending was Administrator Schmidt, Attorney Burton, Director Baker, Mr. & Mrs. Ron White - Toys for Tots, Dave Dean & Dowell Larson - Garnett Beach Homeowners Association, Patty White & Nancy Umbach - McCall Music Society. II. MINUTES - MARCH 15, 1993 After brief discussion, Coyle moved to accept the March 15, 1993 minutes as written, seconded by Martens and the motion carried. III. GARNETT BEACH CONTRACT - DAVE DEAN & DORRELL LARSON Mr. Larson stated that the contract is acceptable generally to the association, but the fee is too high in view of a new finding by the association. The Department of Lands has informed the association that they must cut the number of slips on the dock from six to four in order to conform with department policy that docks cannot be more than 85 feet long. In addition, Mr. Larson informed the committee that in the city's proposed fees several association expenses were not considered such as a $250 year fee to the State Land Board and $728/year in insurance costs. Mr. Larson's financial analysis (attached) of associated costs yielded a bottom line of $27 net rent due to the city if association members were to keep their monthly cost at $535.00/month. Committee took the following points into consideration in making its decision: •the association wants a dock, not the city, the association will be enjoying a privilege the general public does not have. .dock rights will raise the property value of association members, as will the benefit of a neighborhood park. Committee member Killen asked Mr. Larson and Mr. Dean what they felt was a reasonable yearly fee and they replied $150/boat or $600/year. Committee member Coyle said he sympathized with the association and its costs to build, insure and maintain the dock, but also felt the city was giving up the use of a piece of property for 10 years or more and felt $280/boat or $1120/year was the lowest he would feel comfortable with. Killen agreed with Coyle. Next committee discussed several points of the contract such as the standard of maintenance the dock should be kept to. Committee decided it would inspect the dock each year during the annual park tour and if there is a problem they will let the association know. If nothing is done or if the association doesn't agree with the committee the problem will then be turned over to city council with a recommendation to take court action or discontinue the contract through the 30 day termination clause. Second the committee discussed point #19 which stated "This agreement shall bind and inure to the benefit of the parties and their respective heirs, successors and assigns." Committee agreed that the words "respective heirs" should be removed and the dock privileges should be assigned to the land. Attorney Burton agreed and will change the wording in the contract. Finally, committee discussed the association boundaries and asked Attorney Burton to work with the association in defining these boundaries to only include pertinent properties. Chair Grote with consent of the committee requested the association to prepare an addendum with a picture showing the property and the dock, and requested Attorney Burton to redraft the contract with the above revisions, add the association by laws and addendum/map and change the cost to $1,120.00/year. Chair also asked the association to provide its articles of incorporation for attachment to the contract. The revised contract will be reviewed at the next parks and recreation meeting. IV. SUMMER FEST PARK RESERVATION APPLICATION(ATTACHED) - PATTY WHITE & NANCY UMBACH Mrs. White informed the committee that the McCall Music Society would like to reserve Mill Park August 6,7, & 8, 1993 to hold the McCall Summer Fest which is a orchestral presentation. Mrs. White also informed the committee that music would start each night at approximately 7:00 p.m. and be over before dark. The Music Society requested permission for: . 2-3 concession stands, one of them to serve alchohol through Si Bueno's catering license. • The orchestra would be placed in the south west corner of the park with a eating/listening area in the center of the park and listening chairs around the perimeter. Mrs. White informed the committee approval to use land to the north of Mill Park (Manchester's) for parking has been obtained, portable toilets have been reserved, and the society expects 250-300 people to attend the event. ************* After discussion Killen moved to recommend council issue a special use permit for the reservation of Mill Park on August 6th, 7th & 8th for the McCall Music Society's, McCall SummerFest, an Orchestral Presentation after the following conditions have been met: 1. Mr. Reed Gillespie is contacted and informed of the event. 2. Mr. Judd Deboer is contacted and informed of the event. 3. All other adjacent land owners are contacted and informed of the event. 4. Written plan for parking, crowd control, and alcohol is submitted to Chief Parker for comment. 5. A certificate of insurance is provided. Martens seconded, and the motion carried. V. TOYS FOR TOTS RESERVATION OF MILL PARK - RON WHITE. Mr. White informed the committee that the McCall Chamber of Commerce had recinded its Footloose reservation and in fact had canceled the entire Footloose event. Mr. White informed the committee that he would like to move the Toys for Tots Battle of the Bands (which was staged Labor Day weekend in Mill Park last year) to August 13, 14, & 15th. He already has the bands booked for Footloose and has many hours of work invested in this particular weekend. Mr. White informed the committee that the Battle of the Bands would be following the same 50's- 60's music format as last year. Bands would start playing at noon and end by 6:00 p.m. on August 13 and would start at 11:00 a.m. and end at 6:00 p.m. on August 14, & 15, with clean up being done by 8:00 p.m. each evening. The number of booths would be increased from last year by one, a lost child booth sponsored by Keebler Cookies. In addition, the Toys for Tots weekend would also include a sixteen team softball tournament at Fairway Park on August 14, & 15. Finally Mr. White asked to have one food/beverage and one beer/wine booth at Fairway Park during the Toys for Tots softball tournament. Chair informed White that permission would be conditioned on whether or not an exclusive concesssion contract is let for the parks this year. Committee discussed the following topics and concerns: • music being played during nearby church hours. Committee requested that Mr. White notify Pastor Dahlin of the event when he was contacting adjacent property owners. • Committee member Martens said not -for -profit status is often used to justify scams in which the promoters take all the profits in "expenses" and very little ends up going the the charity. He suggested that the committee find some way of verifying the legitimacy of these fund raisers, perhaps by requiring letters of reference from the charity, if well known or if not, from charity watchdog agencies. Administrator Schmidt suggested that one of the conditions of the special use permit could be to request that event organizers pay for an independent financial audit of the event. Chair said that she would list this as a topic of discussion for the parks reservation policy the committee is working on, but did not think it should be a concern here, since this particular fund raiser has used the parks in the past. • Chair Grote raised a fear that the more complicated these events get, the more liable they are to financial disaster. She wondered if it would be in order to require the promoter to submit the budget for the event for the public to scruitinize, since the public essentially becomes a business partner of the promoter by renting him the site for less than what similarly developed private land would be worth. She said that at the very least, she would like the committee to consider requiring bonding for the larger events in the event park damage exceeds the deposit. •Committee discussed the fact that Toys for Tots is requesting the use of Mill Park for the weekend immediately following the Music Society and concluded that since no one attending the town meeting on the master plan the previous week even mentioned concern over Footloose or too many events in the parks, that this was not an issue of particular public concern. The cancellation of Footloose and the rescheduling of Toys for Tots means that the number of days Mill Park is likely to be closed to the public will remain the same as last summer. •Committee asked Director Baker if the city could make more net profit with a city -run softball tournament than renting the fields for a private event. White noted that a state softball tournaments are happening in Boise that weekend which would seriously reduce the attendance at a city -run softball tournament. Director Baker said that he would put a pencil to the economics and come to an agreement with White to be approved by the chair. (Note: Baker's opinion was that the profits to be derived from either use would be about the same. Chair recommends council approve a $150 per day fee for Fairway Park for that weekend). Killen moved to recommend council issue a special use permit for the reservation of Mill Park, August 13,14, & 15 for the Toys for Tots Battle of the Bands, live music playing from 11 a.m. - 6:00 p.m. with close down being completed by 8:00 p.m. each day and Fairway Park August 14, & 15 for a Toys for Tots softball tournament after the following conditions have been met: 1. No vehicles will be allowed into Mill Park and permission of the landowner to the north (Manchester) will need to be obtained for park access. 2. All adjacent landowners will be contacted in advance of council approval. 3. A written parking plan, alcohol plan, and crowd control plan be commented on by Chief Parker through a memo to Administrator. 4. Two(2) portable toilets will be provided and pumped as needed. 5. Trash will not be evident at any time. 6. Mill Park and Fairway park will be returned to their original or better condition. 7. Mr. Gillespie is to be notified prior to Council approval. 8. Mr. Debor is to be notified prior to Council approval. 9. Pastor Dahlin is notified prior to Council approval. 10. All other adjacent land owners to be notified prior to Council approval. 11. A certificate of insurance is provided prior to Council approval. 12. $150.00/day/per park fee plus $150.00/day/park refundable damage deposit is paid. Coyle seconded, and the motion carried with Martens abstaining. VI. STAFF REPORTS A. Recreation Director 1. Ice Break up contest. - Director informed committee that it was of the City Attorneys opinion that this contest is not legal for the City of McCall to hold. 2. Condemnation of the Hoyle property. - Director informed committee that the City Attorney filed the action - summons and complaint has been served. Hoyle's attorney has contacted City Attorney and they are arguing about the price at this point. The city has had a appraisal done, Hoyle has not but believes the city's is about $300,000.00 to low. 3. Kalman's section of railroad right of right of way - Director informed committee that the city is suing and a trial date has been set in July. City Attorney believes the city already owns 60' of the right of way due to Railroad Street and Idaho Street right of ways and that we own through adverse possession the snow storage area behind city hall. The trial will be to determine what the city owns. Committee members continue to be anxious to complete the purchase of the railroad right-of-way before the 1995 sunset of the State Transportation Grant. Chair with consent of the committee, asked Coyle to contact Mr. John Barns who is in charge of the grant administration in this area and invite him to the next Parks and Recreation Advisory Committee meeting so the committee can become educated on the exact terms of the grant. VII. NEW BUSINESS A. Commercial use of city parks. Committee member Martens informed the committee that he believes some commercial use of city parks is happening with out the knowledge of the city. Chair with consent of the committee asked staff to research city codes concerning commercial use of the city's parks, specifically on what actions are to be taken when the code is violated. Chair also asked staff to report on its finding at the next committee meeting. VIII. OLD BUSINESS A. Nonresident participation in Recreation Programs(Club McCall Card). Director informed committee that 50% of the youngsters enrolled in the Spring Soccer Program do not live within the city limits. Director distributed a draft of the City of McCall's Nonresident User Fee Policy. Committee discussed different ways to collect nonresident user fees and decided that the easiest way to collect nonresident user fees would be to collect a one time per year fee rather than collecting extra fees for each program. Chair with consent of committee asked staff to work with committee member Martens and revise the draft of the City of McCall's Nonresident User Fee Policy to show a one time/year fee and attach it to the June agenda. B. New Recreation Programs Chair with consent of committee deferred the topic of new recreation programs to the June agenda. C. Parks Reservation System. Director distributed a draft of the McCall Parks Reservation System to the committee. Chair requested each committee member study the draft and be prepared to make a recommendation concerning the draft at the June meeting. IX. REPORTS ON NON -CITY PARKS AND RECREATION ISSUES. A. Payette Lakes Tail System Killen informed the committee that the PLTS is preparing to resubmit their transportation department grant, the PLTS raised $2,200.00 on the Ice Break-up contest, and the PLTS is preparing to put on a fashion show for a fund raiser on the 26th of May. B. Chair's meeting with Mary Austin -Crofts - Blaine Co. Recreation District. Chair informed the committee that she had meet with Mrs. Austin -Crofts to discuss transportation department grants. Mrs. Austin -Crofts informed Chair that the transportation department wants to see its grantees making serious progress towards its goals, that communication and keeping the transportation department up to date is very important. C. S.I.T.P.A. Site. Coyle informed the committee that the project is moving along and there really is nothing to report on. Next meeting of the committee was set for Monday June 7, 1993. MESSAGE This draft of a Garnet St. dock agreement is my recommenda- tion to the Administrator and Park and Recreation Committee, who will make a recommendation to the Mayor and Council. Parks & Rec. meets on the 26th of this month, but has a very full agenda consisting of its master plan for the near future, a public hearing. How many people will attend, and whether the Committee will want to deal with this dock at that time, I do not know. You may wish to contact Craig Baker about that. DOCK SITE AGREEMENT This Agreement is made by and between the City of McCall, an Idaho municipal corporation ("City"), and the Garnet Beach Homeowners Association, an unincorporated association, of McCall, Idaho ("Association"), for and in consideration of the mutual promises herein contained. R.ackground 1. City is the owner of the right of way of Garnet Street in fee simple determinable, and holds it for the use of the traveling public. 2. Association is an association of homeowners who own property fronting on Garnet Street or adjacent portions of McCall Avenue. 3. Garnet Street is a platted street the far west end of which is the high water mark of Payette Lake. The westerly part of the street has not been constructed beyond the point necessary to afford access to abutting properties. The right of way west of that point is a fairly steep area that is covered with native trees and shrubs. 4. Association desires to construct a boat dock and to attach it to land at the West end of Garnet Street, to build a pathway from the end of the developed street to the dock, and generally to make landscape improvements upland from the dock within the right of way. 5. City views the dock as an extension of the transportation use of the right of way, and this Agreement has been favorably recommended to the City Council by City's Park and Recreation Committee. Agreements 6. Association is authorized by this Agreement to attach a dock to the west end of the Garnet Street right of way. The placement of and plans for such dock are subject to approval by the State of Idaho Department of Lands, and Association shall obtain that approval before commencing any construction of such a dock. Such dock shall comply with the Shorelines and Rivers Environs zoning restrictions, MCC 3-13-4 (A) 2, and draft Ordinance 615, section 3-15-040 (B) 2, a copy of which is attached. 7. Association shall pay City the sum of $2,175 on or before the first day of June of each year, commencing June 1, 1993, as consideration for the right granted by paragraph 6. above. With such payment Association shall DOCK SITE AGREEMENT, Garnet St. r/w page 1 furnish City a list of its then current membership, indicating the mailing address of each and the location of the McCall residence owned and occupied by each, and the certificates of insurance indicated below. Such rent shall be increased in the fifth year and every succeeding 5 years by a percentage equal to the percentage increase in the wholesale price index computed by the Bureau of Labor Statistics with respect to Boise, Idaho. 8. City neither authorizes nor prohibits the construction of a pathway and landscape improvements within the right of way of Garnet Street. Any such improvements are made at the risk of the Association, as against any public transportation needs. 9. Association shall maintain any such dock, pathway, and other improvements in a condition safe for public use, and otherwise in good maintenance and repair. Association shall provide insurance against personal injury and property damage occurring on or near such dock, pathway, and improvements, in the amount of $100,000, and shall cause the City to be an additional named insured. Certificates of such insurance shall be filed with the City Clerk annually with the payment under paragraph 7 above. 10. Association shall not deny the public access to such dock, but may and shall limit moorage to members of the Association. Association shall not operate a marina or other commercial activity; thus Association shall not conduct any activity for profit. 11. Association shall not admit to membership any person who. is not the owner and occupant of a residence within that portion of Davis Beach Tracts or Sunset View Subdivision abutting Garnet Street or the west side of McCall Avenue north of Opal Street, nor shall Association deny membership to any person who is such an owner and who offers to participate on a basis equal to that afforded by the Association to others similarly situated. Should the number of persons desiring to be members and owning a boat which they desire to moor at the dock exceed the number of berths at the dock, Association may give preference to the earlier -in -time members. 12. The initial term of this Agreement shall be ten years from the date of this Agreement; and it shall be renewed for succeeding terms of five years each unless City or Association elects not to renew by giving notice within the 180 days next preceding the renewal date. This Agreement may be terminated by the City in the event of a breach by Association or in the event of the arising of an inconsistent public transportation need, by giving DOCK SITE AGREEMENT, Garnet St. r/w page 2 thirty days written notice. City shall not terminate this Agreement by reason of a non -monetary breach of this Agreement if Association in response to such notice and within such 30 days both gives notice to City that it intends to, and in fact does, commence and diligently pursue a cure of such non -monetary breach to the point of actual cure. 13. Association shall have sixty days after termination by the City to remove the dock and any other structure extending above the surface of the ground; such period of time shall be computed excluding times when the ground is covered by snow. Any such dock or other structure left within the Garnet Street right-of-way or its extension over the water after the expiration of such sixty days, shall at the option of the City become the property of the City. Any such left structure which in the opinion of the City is not of value, may be removed and disposed of by the City for the account of the most recent members of the Association who shall be jointly and severally liable to the City for the cost of such removal and disposal. 14. If any legal action or proceeding related to this Agreement is begun by any party to this Agreement, the prevailing party shall be entitled to recover commercially reasonable attorneys fees and witness and expert witness fees, incurred in prosecuting or defending the same. The City shall be entitled to such fees, if the prevailing party, notwithstanding the fact that the City Attorney is salaried. 15. This Agreement is governed by the law of Idaho, and Valley County, Idaho is the proper venue. 16. Time is of the essence with respect to the obligations of the parties under this Agreement. 17. Any rights and remedies stated in this Agreement are cumulative. 18. The neglect of any party to enforce its rights at any particular times or upon any particular occurrences shall not preclude resort to those rights at any other time or with respect to any other occurrences. Any waiver of any right must be done in a writing executed by the party to be charged with such waiver, and executed with no fewer or different formalities and approvals than were attendant upon execution of this Agreement. 19. This Agreement shall bind and inure to the benefit of the parties and their respective heirs, successors and assigns. DOCK SITE AGREEMENT, Garnet St. r/w page 3 20. This Agreement constitutes the entire Agreement between and among the parties as to the matter set out in it, and all prior negotiations and discussions, memoranda, correspondence, and communications are merged into and extinguished by this Agreement. 21. Any notice permitted or required by this Agreement shall be effective when received, if mailed by certified mail, return receipt requested, or by hand delivery, to the address for notice below: City of McCall P. 0. Private docks and piers shall: (a) Require a building permit from the City in addition to the permits required by the State Department of Lands, or other authorities having jurisdiction. (b) Be used to provide access to boats. (c) Be floating or held on pilings. (d) Be built with chemically inert materials; and foam materials shall be fully enclosed. (e) Not be constructed in whole or part by or in association with excavation or dredging, unless a conditional use permit has first been issued. We are all very excited that the process is moving forward. However, the amount computed for rent, which was calculated by determining the average costs of mooring at local marinas less the amortization of three 20' sections of dock, did not include some necessary direct costs which will be paid by the Garnet Beach homeowners. It should be noted that you cannot moor six (6) boats on a 60 foot dock. Only four (4) boats could be moored on a 60 foot dock. It would take an 80 foot dock to moor six (6) boats. I have attached a schedule of rents less expenses for a 60 foot (4 boat) dock and an eighty foot dock (6 boats). Please do not hesitate to contact us if you have any questions. Signature Date The McCall Music Society Announces the first annual SUMMERFEST IN MCCALL Friday, Saturday & Sunday, August 6, 7 & 8, 1993 The McCall Music Society will inaugurate a weekend, outdoor music festival called SummerFest In McCall, Friday -Sunday, August 6, 7 & 8, 1993 at Mill Park overlooking Payette Lake. The three-day musical event, will focus on culturally stimulating, family - oriented entertainment especially suited for an outdoor venue. Concert goers will be encouraged to bring and enjoy their picnic supper on the green. The concerts will feature the professional musicians of the Boise Chamber Orchestra and the Boise Big Band as heard at Boise SummerFest'93. "Pop Goes the Orchestra" will open the festivities in a program of pop and rock, Broadway and Hollywood, folk and jazz inspired music. "Summertime Symphony" will be heard on the second evening with an orchestral concert of light classics from the world of opera, ballet, and the instrumental genres. Gershwin's "Rhapsody in Blue" will be featured work of the evening. McCall residents, their guests, and numerous out-of-town visitors will also enjoy chamber music performed by various ensembles in various locations over the weekend. The musical fare promises great music in the beautiful and idyllic setting of McCall, Idaho. Creating a SummerFest in McCall tradition promises to enhance the cultural life of all Idahoans. It will bring a new and "much needed" cultural experience to area residents and will attract a new and enlightened regional audience who may be looking to McCall for recreational or residential needs. SummerFest provides an outlet for Idaho professional musicians and helps promote their artistry throughout the state. SummerFest in McCall will provide residents, especially seniors and our youth, with an opportunity to hear professional musicians in their hometown while providing entertainment for out-of-town guests, thus enhancing tourism. An educational program for all local school children will be offered during the orchestra's rehearsal free of charge. The conductor and our music society director will lead this program for their enrichment. SummerFest contributes to the overall cultural development of the community, reinforcing the desire of the local arts patrons for more performing arts and creating a new local and regional audience attracted through a variety of aesthetic and entertaining programs. Ticket prices will be kept low so that all interested may attend. SummerFest will contribute to McCall's image as an arts -aware, pristine recreational center in the Northwest. An Idaho project, performed by Idahoans; SummerFest in McCall will build on the successes of Boise's SummerFest event. SummerFest seeks to develop and strengthen the relationships between two cities, Boise and McCall, by bringing the Boise SummerFest program to McCall. Responding to ideas and advice from the McCall Music Society members and their audiences, Idaho musicians, and the business community, SummerFest in McCall promises to be an exciting endeavor: an arts festival for the future. The McCall Music Socie~? is requesting the use of Mill Part;'. for the evenings of August 6,7 & 8. The concerts, will begin at 7PM but the f~te will be open at 6:15PM for picnickers; to come and settle in ahead of time. Seating will be on the lawn. Low backed beach chairs without legs will be allo¥~d. A few folding chai~ will be at hand on the sides for seniors. The conce¢: wilt be over before dark. PARKING: A committee has been fon'ned to direct parking from the three streets-' accessing the park area. Parking pen'nission has been given by Brundage Mt. to use the spaces in and around their building. Shore Lodge, being one of the sponsors of the concert, has given pen'nission to use the back part. of the mill properiT./for parking. These committee members will direct concert goers to available parking sight as they enter the area. There will be committee members stationed at the entrances of Mill Park Condos and other %,fl limits" areas to keep anyone ~om parking there. The McCall police depa~nent has been notified of this event and it's arra ngeme nfs. SANITATION: Four additional porta- potties have been reserved and will be put in place in the north east corner of the park on the alternoon of August 6th- an area least likely to be seen by Mill Park Condo renters. They will be removed early Monday morning, August 9th. S ix additional vfaste cans will be stationed about to make it easy for picnic dinner residue to be disposed of. A clean up committee will follow up after each evening's perfom'~ance. STAGING: The Boise Chamber Orchestra consists of 38 rnusicians who will be seated in chairs which are placed upon a flooring laid on the ground in the southwest corner of the park....the only flat area large enough to seat the entire orchestra.. The area will be "dressed" with large potted plants brought in at rnidday on Friday, August 6th. At the same time, the stage crew will be setting up an acoustical shell which sit.:_: behind the orchesb'a. There will be a 28X40 caterer's tent (open ai0 for wine and dessert concessions (see below). We w~,uld like r.o leave most of this arrangement in place during the daytime, bebfveen concert~% and will make some arrangement for securi~./ on sight. This v~.-)uld not inhibit the use of the park. by the public on those days. ELECTRICAL: The speaker system is ,:.-.,ne that will not need additional power other than that now accessibie at the park. The stage crew will make the necessap/ provisions, t v,~utd like to know exactly where the access is when the oi;:;hestra director cornes to McCall for a planning session in May. I will con.~ct C~.ig ahead of time. Because the concer_l:s will be finished before dark, there will be no need for lighting. There may be some light use of electrical by the '"Caterer". CATERING: We are, at present, planning a wine concession since w,e understand that people may not a "bring their own" onto ci~.' property (this point will be brought to attention in our publici~ ...... Boise SummerFest t~ad NEVER had a problem in this regard). This concession will be operated by a caterer with proper licensing (still to be selected). A catered dessert is also being considered. Details on these b~ concessions will be happily passed by you for approval upon final selection, if necessa~'. This event is being patterned alter the S ummerFest in Boise held at the campus at BS U in their outdoor amphitheater. Because of the h./pe of music being offered, the crovcd there is one of mellow, family, cultured fo~.:s and alter four yeat:s they have yet to have any negative incidents and reporb~ are that '"clean up" is hardly necessary since people put their dinr~ers away in their baskets when they finish. I anticipate similar behavior from McCall attendees.
