MEETING OF THE COMMON COUNCIL, SERVING
AS A COMMITTEE IN CHARGE OF THE OPERATION
OF THE MUNICIPAL TIROTRIC LIGHTING AND
POWER PLANT OF THE CITY OF RICHMOND IND.
MONDAY, JUNE 6, 1949.
The Common Council of the City of Richmond, Indiana, serving as a com-
mittee in charge of the operation of the Municipal Electric Lighting
and Power Plant, met in regular session in the office of the Board of
Public Works and Safety in the City Building in said City, Monday, June
6, 1949, at 7:30 o'clock P.M. , c.s.t. , Councilman Chambers presiding
with the following members being present: Messrs. Eastman, Harris, Law,
Marino, Myers, Russell and Tracy. Councilman Baldwin being absent. The
following proceedings were had, to-wit:
On Motion duly made, seconded and carried unanimously, the minutes of the
previous meeting were dispensed with.
Councilman Tracy moved that the committee approve the Light Plant furnish-
ing labor and material to the American Legion Post r65, for the fireworks
display on the 14th day of July displayed by said Post, at the Glen Miller
Park. Councilman Eastman seconded this motion and on voice vote the motion
was carried unanimously and so cr'dered.
Councilman Eastman moved that the letter received from the Public Service
Commission of Indiana in regard to special rates to Eax^lham College from
the Light Plant, be filed and spread upon the records of this meeting,
seconded by Councilman Harris and on voice vote the motion was carried un-
animously.

Dear Sir:
• This will acknowledge receipt of your letter of May 26th outlining a Resolu-
tion of your Board in which it proposed to give some special rate to Earl-
ham College.
This is to advise that under. the Acts of 1913, Chapter 76, Paragraph No. 111,
Page 167, and also Acts of 1915, Chapter 96, Paragraph No. 1, Page 302,
Burns 514-701, you will find, among other things, the following:
"If any public utility or any agent or officer thereof or any officer of
any municipality constituting a public utility as defined in this Act should
directly or indirectly by any device whatsoever, charge, demand, collect,
or receive from any person, firm, or corporation, a greater or less compensation
for any service rendered or to be rendered etc."--such public utility shall
be deemed guilty of unjust discrimination etc."
Therefore, we cannot approve such a request as contained in your Resolution
because it is in violation of the Statutes.

Mr. Beck also advised the committee that it was against the State Laws for
a Public Utility to enter into a cost-plus contract basis with any company.
This is effective on the recent Gibbs-Hill contract.
On motion duly made by Councilman Harris aril seconded by Councilman Eastman
and carried unanimously, the following resolution was adopted:

RESOLUTION
RESOLVED, that the-General Manager of the Municipal Electric Lighting
and Power Plant, City Controller and Treasurer of the City of Richmond,
Indiana, be authorized- to subscribe for U. S. Treasury certificates, Series
E-1950 in the amount of $47,000 and to sign the name of this company to
all necessary papers covering the purchase of, the exchange of, and the safe- .
keeping and the withdrawal of said securities.
Adopted by the Common. Council of the City of Richmond, Indiana, serving
as a committee in charge of the operation of the Municipal Electric Lighting
and Power Plant of said City this 6th day of June, 1949.

On motion duly made, seconded and carried unanimously, the committee approved
the authorization of Mr. Beck to purchase a new Utility Billing Machine for
the Light Plant office at a cost of $3,73S.10.
Mr. Beck advised the committee that the Plant has approximately SO days supply
of coal on hands.
The committee allowed claims in the amount of $102,260.07. Of this amount,
there were the following transfers: The sum of $20,793.15 from the General
Fund Cash to the Depreciation Reserve Fund Cash; $52S.75 (Interest on Treas-
ury Certificates) from the General Fund Cash to the Depreciation Reserve Fund
Cash.
On motion duly made, seconded and carried unanimously, the committee adjourned.
