HomeMy Public PortalAbout2014.212 (12-02-14)RESOLUTION NO. 2014.212 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE SUBMITTAL OF THE APPLICATION TO CALRECYCLE, DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY FOR THE RUBBERIZED PAVEMENT GRANT PROGRAM FOR WHICH THE CITY OF LYNWOOD IS ELIGIBLE WHEREAS, Public Resources Code sections 40000 et seq. authorize the Department of Resources Recycling and Recovery (CalRecycle) to administer various grant programs (grants) in ' furtherance of the State of California's (state) efforts to reduce, recycle, and reuse solid waste generated in the state thereby preserving landfill capacity and protecting public health and safety and the environment; and WHEREAS, CalRecycle has been delegated the responsibility for the administration of the program within the state, setting up necessary procedures governing application by individuals, businesses, local governments and research institutions under the program; and 1 WHEREAS, CalRecycle grant application procedures require an applicant's governing body to declare by resolution certain authorizations related to the administration of CalRecycle grants; and WHEREAS, the grant term starts on the date of the Notice to proceed from CalRecycle and construction must be completed by April 1, 2017; and WHEREAS, on November 13, 2014, City staff submitted the grant application to CalRecycle; in which CalRecycle requires an approved resolution for the submittal of the application by the second due date, December 16, 2014; and WHEREAS, if awarded a grant, the City of Lynwood will enter into an agreement with CalRecycle for-development of the grant. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the City Council approves the submittal of the application to CalRecycle for the Rubberized Asphalt Concrete (RAC) Grant Program for which the City of Lynwood is eligible. Section 2. That the City Council authorizes the City Manager as the Signature Authority, as agent of the City of Lynwood to sign all grant related documents necessary to implement and close out the grant, conduct all negotiations, and to execute and submit all documents including, but not limited to, applications, agreements, amendments, payment requests and so forth, which may be necessary for the completion of the project as described in the grant application. Section 3. This Resolution authorizes the Signature Authority to delegate his /her signature authority to the Senior Public Works Manager. The designee's authority shall be effective for a period of less than five years after the adoption date of this Resolution, from December 2, 2014 through December 2, 2019. Section 4. That this Resolution shall take effect immediately upon its adoption. Section 5. The City Clerk shall certify as to the adoption of this Resolution.
