HomeMy Public PortalAboutResolution No. 24-062 - Resolution amending the agreement with Diamanti Construction to include additional work for the entrance of the new police station within City HallSponsored by: City Manager RESOLUTION NO. 24-062 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, RATIFYING THE CITY MANAGER'S DECISION TO CHANGE THE SCOPE OF SERVICES FOR THE POLICE DEPARTMENT DEMOLITION AND REBUILD/RELOCATION PROJECT AND FURTHER AUTHORIZE THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE AGREEMENT WITH DIAMANTI CONSTRUCTION & DEVELOPMENT, INC. TO INCLUDE THE ADDITIONAL WORK COMPLETED IN THE AMOUNT OF FORTY-NINE THOUSAND THREE HUNDRED DOLLARS ($49,300.00), AND IN A CONTRACT FORM TO BE APPROVED BY THE CITY ATTORNEY; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, in 2021, the City of Opa-Locka ("City") received a grant from the Florida Department of Law Enforcement for the Demolition and Rehabilitation of the Old Police Station (2495 Ali Baba Avenue) and Relocation of the new Police Station in the amount of One Million, One Hundred Twenty -Five Thousand Dollars ($1,125,000.00) and WHEREAS, due to dilapidated conditions of the previous Police Station, the City was unable to provide a safe workspace for the City's Police Force; and WHEREAS, a grant that was provided to the City for the Project was not sufficient enough to repair or replace the Police Station, with a cost projection at the time of Ten Million Dollars ($10,000,000); and WHEREAS, utilizing the City's Municipal Building, the original cost of construction was One Million, Three Hundred Twenty -Three Thousand, Eight Hundred Fifty Dollars ($1,323,850.00). The City Manager later determined that there should be a relocation of the Police Station from the third floor to the first floor of the City's Municipal Building; and WHEREAS, to accommodate the Police Station on the first floor, the space had to be completely demolished to include the existing structure and the replacement of infrastructure; and Resolution No. 24-062 WHEREAS, during construction, City Staff made additional construction changes to comply with Police Department's various requirements for safety, security, and provide the police force and the community with adequate space, without significantly altering or interrupting the daily operations of other departments and Municipal Complex tenants; and WHEREAS, the additional changes and adjustments added an additional cost of Forty -Nine Thousand Three Hundred Dollars ($49,300.00) to the City approved contract, representing an additional four (4%) of the proposed construction cost; and WHEREAS, the final cost for this project is One Million Three Hundred Seventy - Three Thousand One Hundred Fifty Dollar ($1,373,150.00); and WHEREAS, the City Manager is requesting ratification to the scope of work and authorization to enter into a project agreement of an additional amount of Forty -Nine Thousand, Three Hundred Dollars (S49,300.00) specifically for the additional HVAC system work and security work and electrical renovations that have been completed at the new police station; and WHEREAS, additional work also included framing, plumbing, window tinting, modifications to HVAC ducts, floor leveling, additional space accommodations and the addition of a transom window; and WHEREAS, because this project was subject to a grant along with a completion and a reporting schedule and constrained timelines tied to funding, to avoid delays and the risk of losing the grant, the City Manager made a decision to change the scope of services and is now seeks ratification from the City Commission; and WHEREAS, the City Commission finds it is the best interest of the City to ratify the City Manager's decision to change to the Scope of Services for the Police Department Demolition and Rebuild/Relocation Project and further authorize the City Manager to execute an amendment to the agreement with Diamanti Construction & Development, Inc for additional HVAC system, security and electrical renovations already completed at the new police station, as described herein in Exhibit "A" attached hereto, in the amount of Forty -Nine Thousand Three Hundred Dollars (S49,300.00) and in an a contract form acceptable to the City Attorney. 2 Resolution No. 24-062 John H. I aylor Jr., Mayor NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, THAT: Section 1. Adoption of Representations. The foregoing "Whereas" clauses are hereby ratified and confirmed as being true and the same are hereby made a specific part of this Resolution. Section 2. Approval of Change Order. The City Commission hereby ratifies a change to the Scope of Services for the Police Department Demolition and Rebuild/Relocation Project and further authorizes the City Manager to execute an amendment to the agreement with Diamanti Construction & Development, Inc for additional HVAC system, security and electrical renovations already completed at the new police station, as described herein in Exhibit "A" attached hereto, in the amount of Forty -Nine Thousand Three Hundred Dollars (S49,300.00) and in an a contract form acceptable to the City Attorney. Section 3. Scrivener's Errors. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors, which do not affect the intent of this Resolution may be authorized by the Interim City Manager, following review by the City Attorney, without need of public hearing, by filing a corrected copy of same with the City Clerk. Section 4. Effective Date. This Resolution shall be effective immediately upon adoption hereof and approval by the Governor of the State of Florida or Governor's designee. Staff Summary: In 2021 the City received a grant from the Florida Department of Law Enforcement for the Demolition of the Old Police Station (2495 Ali Baba Avenue) Rehabilitation of the building and Relocation of the Police Station in the amount of $1,125,000.00. Due to the conditions of black mold, mildew, and inability to provide a safe space for our Police Force and due to the high cost of developing a new stand-alone building, City Management made the recommendation to relocate the Police Department to the First Floor of the Municipal Building (780 Fisherman Street) fora construction cost of $1,323,850.00. The selected First Floor location used to function as a daycare center and had not been utilized for 10 years. DocuSign Envelope ID: AB6C6C0E-9786-4435-843C-CD94C5AD3B48 This space had to go through a complete demolition of its existing structure and removal of specialized equipment utilized for the daycare, all while simultaneously addressing the replacement of existing infrastructure such as HVAC ducts and all electrical connections. Apart from these challenges, several additional issues were identified during the construction process which are addressed in the change order documents. During construction, City Staff had to make additional changes and adjustments to the construction files to comply with Police Department requirements for safety and security, and provide the Community and Police Force a space that would fulfill their needs, without significantly altering or interrupting the daily operations of the other departments and tenants that function within the Municipal Complex. These additional changes and adjustments added an additional cost of $49,300.00 to the initial approved contract, representing only an additional 4% of the proposed construction cost. The final cost for this project is $1,373,150.00. Since this project was related and subject to a grant completion and reporting schedule as well as constrained timelines for funding and to avoid delays and the risk of losing the grant, we are bringing this to the attention of the City Commission at the time the project has been finalized. Staff recommends the approval of the additional $49,300.00 to the project to pay the Contractor who completed the project in good faith and without any issues. Financial Impact: The additional funding for the project will be addressed under Budget Amendment No.3 after the City Commission's Approval. Proposed Action: Staff recommends the City Commission authorize the Interim City Managerto add the additional funding of $49,300.00 to the project of relocating the Police Department to Suite 105 of the Municipal Building. Architectural plans did not show connections. - Plans showed electrical panels in the HVAC air handler room. By code, they had to be relocated. 6 Floor Leveling $ 3,500.00 Floor Leveling. When the floor surface was removed, it revealed many uneven sections with layers of concrete missing, low spots, and scaling. 7 Duct Painting $ 9,500.00 HVAC Ductwork Painting. In the areas were the AC ducts were exposed, it was decided to paint them black to add character to the space and to become part of a cohesive background pallete. 8 - AC Duct $ 3,100.00 New ductwork installation in Police Department requested the installation. 9 Transom Window $ 3,500.00 Transom Window on hallway double doors. Plans called for framing and installing drywall above the double doors. The City requested the contractor to install a Transom Window instead to add style and allow in more natural light.
