HomeMy Public PortalAboutReslotuion No. 24-064 - Resolution ratifying a change to the scope of services to the underground tank removal project amending the agreement with Gulfstream Petroleum Services Inc.Sponsored By: City Manager RESOLUTION NO. 24-064 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, RATIFYING THE CITY MANAGER'S DECISION TO CHANGE THE SCOPE OF SERVICES TO THE UNDERGROUND STORAGE TANK REMOVAL PROJECT AND FURTHER AUTHORIZES THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE AGREEMENT WITH GULFSTREAM PETROLEUM SERVICES, INC. TO INCLUDE THE REMOVAL OF 3 ADDITIONAL UNDERGROUND STORAGE TANKS AND THE PRELIMINARY REMEDIATION OF SOIL, IN AN AMOUNT OF TWELVE THOUSAND, TWO HUNDRED TWENTY-THREE DOLLARS ($12,223.00), AND IN A CONTRACT FORM ACCEPTABLE TO THE CITY ATTORNEY; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, on April 13, 2022, the City Commission of the City of Opa-Locka ("City") approved Resolution 22-9968 for Gulfstream Petroleum Services, Inc. ("Contractor") for the removal of fuel storage tanks pursuant to RFP NQ. 21-0929200; and WHEREAS, the project included the removal of two (2) 4,000 -gallon and one (1) 1,000 - gallon underground tanks; and WHEREAS, pursuant to Resolution 23-128, the City and Contractor previously amended the resulting agreement by executing two changes: 1) Section 3.1 substantial completion changed from thirty (30) to ninety (90) days; and 2) Section 11.1 Removal of the language for performance and payment bonds, which is required for projects that exceed Two Hundred Thousand Dollars ($200,000.00); and WHEREAS, the City Manager is recommending that the agreement be amended again; and WHEREAS, after the Project commenced, it was determined that there were additional storage tanks that required extraction; and WHEREAS, the City Manager has determined that a scope of services and contract amendment of Twelve Thousand, Two Hundred Twenty -Three Dollars ($12,223.00) will cover the expenses incurred from the removal of the additional two (2) 3,000 -gallon and one (1) 1,500 -gallon underground tanks and the preliminary remediation of the soil; and WHEREAS, the City Commission finds it in the best interest of the City and its residents to ratify the City Manager's decision to change the Scope of Services to the Underground Storage Tank Removal Project and further authorize the City Manager to execute an amendment to the agreement with Gulfstream Petroleum Services, Inc., as Resolution No. 24-064 described here in, in an amount of Twelve Thousand, Two Hundred Twenty -Three Dollars ($12,223.00) and in an a contract form acceptable to the City Attorney. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA: SECTION 1. The recitals to the preamble herein are incorporated by reference. SECTION 2. AUTHORIZATION The City Commission of the City of Opa-Locka, Florida hereby ratifies the City Manager's decision to change the Scope of Services to the Underground Storage Tank Removal Project and further authorizes the City Manager to execute an amendment to the agreement with Gulfstream Petroleum Services, Inc., as described here in, in the amount of Twelve Thousand, Two Hundred Twenty -Three Dollars ($12,223.00) and in a contract form acceptable to the City Attorney. SECTION 3. SCRIVENER'S ERRORS Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the Interim City Manager following review by the City Attorney, without the need of a public hearing by filing a corrected copy of same with the City Clerk. SECTION 4. EFFECTIVE DATE This Resolution shall take effect upon the adoption and is subject to the approval of the Governor or Governor's Designee. Staff Summary: The City Commission adopted Resolution 22-9968 which approved the removal of the storage tanks at the former Police Station located at 2495 Ali Baba Avenue. Through RFP No. 21-0929200, this project was awarded to Gulfstream Petroleum Services, Inc for the removal of two (2) 4,000 -gallon and one (1) 1,000 - gallon underground tanks. After demolition, it was determined that there were additional storage tanks that required extraction. The ratification of $12,223.00 will cover the expenses incurred from the removal of the additional two (2) 3,000 -gallon and one (1) 1,500 -gallon underground tanks and the preliminary remediation of the soil.
