ARCHITECTURAL REVIEW AND PLANNING BOARD OF THE TOWN OF GULF STREAM,
FLORIDA ON THURSDAY, SEPTEMBER 23, 2021, AT 8:30 A.M., IN THE WILLIAM F.
KOCH, JR. COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF
STREAM, FLORIDA.

Board Member Smith made a motion to accept the minutes of the
regular meeting on July 22, 2021. Alternate Board Member Canfield
seconded the motion with all voting AYE at roll call.

B. Administer Oaths
Town Clerk Taylor administered the oath to Laura MacKinnon,
George Parry, Aleksandra Hayes, Gary Eliopoulos, Louis
Valhos, Paul Courchene, and Mitch Kunik.
C. Applications for Development Approval
1. Action on this item was deferred from the hearing that
was held on July 22, 2021.
An application submitted by Judd Brown of Judd Brown
Designs, as agent for Laura & Robert MacKinnon, owners of
property located at 2526 Avenue au Soleil, Gulf Stream,
Florida 33483, legally described as Lot 51 and part of Lot
52 in the Place Au Soleil Subdivision.
a. LEVEL 2 Architectural/Site Plan Review to permit the
addition of a i% car garage, a storage room with flat
deck above to be accessed from an outside, open
stairway, and a covered front entrance for a total
addition of 960 square feet.
Mrs. Laura MacKinnon made a presentation explaining
the revisions to the landscaping, the addition of a 1;5 car garage and a
storage room that were all within compliance of Gulf Stream
regulations. She added they were changing the roof to be more of a hip
roof in the preferred design structure for Gulf Stream leaving only 100
flat roof. Mrs. MacKinnon stated they were also adding a covered front
entrance that worked seamlessly with the remaining structure. Vice
Chairman Murphy asked if there had been any feedback from the neighbors
to which Town Clerk Taylor answered in the negative. Mrs. MacKinnon
stated they had showed the plans to their neighbors who had seemed
pleased. Chairman Smith asked what the color scheme was going to be to
which Mrs. MacKinnon stated the roof was going to be charcoal and the
house white. Board Member Smith asked about the front door to which
Mrs. MacKinnon stated they were keeping the existing door, which was
wood stained black.
Vice Chairman Murphy made a motion to approve a Level II
Architectural/Site Plan to permit the addition of a 1;5 car garage, a
storage room with flat deck above to be accessed from an outside, open
stairway, and an under -air vestibule or hall behind the front door for a
total addition of 1,075 square feet based on a finding that these
revisions and additions meet the minimum intent of the Design Manual,
and applicable review standards. Alternate Board Member Canfield
seconded the motion with all voting AYE at roll call.
2. An application submitted by George & Kristen Parry,
the owners of property located at 11 Driftwood Landing,
Gulf Stream, Florida, which is legally described as Lot 7
Driftwood Landing.

a. LEVEL 2 Architectural/Site Plan Review to permit the
replacement of the existing Gulf Stream Bermuda front
entry with double doors which are 47% glass panes with
walnut panels at the bottom.
Mr. George Parry apologized for failure in navigating
the permitting process. He explained they were trying to stay within
the architectural design of the Town with their new front doors. He
added that their current front door was not up to code with hurricane
standards. Mr. Parry felt they were abiding by the Code and were in
line with other homes in Gulf Stream and referred to photos of those
other homes. Chairman Smith asked if the door was walnut or metal to
which Mr. Parry answered that it was a walnut finish on metal. Board
Member Smith asked if it was double or single to which Mr. Parry
answered that it was double doors.
Vice Chairman Murphy made a motion to approve a Level II
Architectural/Site Plan to replace the existing Gulf Stream Bermuda
front entry with double doors which are 47% glass panes with walnut
panels at the bottom of the door. Board Member Smith seconded the
motion with all voting AYE at roll call.
3. An application submitted by GE Architecture, Inc. as Agent
for Davin Gebauer, owner of property located at 3420 Gulf
Stream Road, Gulf Stream, Florida, legally described as
Lot 1, Block 1, Polo Fields, Plat No. 1.
a. Special Exception to permit 222 sq. ft. of covered
open space that exceeds the maximum permitted FAR.
b. Level 3 Architectural/Site Plan Review to permit
construction of a 5,365 sq. ft. two story, single
family, Gulf Stream Bermuda style dwelling with a 2.5
car attached garage, and a swimming pool/spa.
Aleksandra Hayes, Architect from GE Architecture, made a
PowerPoint presentation which showed the empty lot on Gulfstream Road
where they will be constructing a 5,365 sq. ft. Gulf Stream Bermuda
two-story home. She explained the floor plan in detail and pointed out
the mahogany garage doors and dark aluminum railings on the front
balcony and porch that added a contrast of color. Ms. Hayes pointed
out the same aluminum railings on the second -floor balcony in the back
of the house as well as two covered porches. Mr. Dave Bodker,
Landscape Architect, gave a detailed presentation of the landscape
plan. Vice Chairman Murphy asked about the front of the house which
looked like gates and a small courtyard before arriving at the front
door. Mr. Gary Eliopoulos explained that there were decorative
aluminum gates and a courtyard because the owners had dogs and they
wanted to be able to let them out without them going into the front
yard and street. Chairman Smith asked where the small special
exception was going to be located to which Mr. Eliopoulos answered that
it was over the entire construction. Vice Chairman Murphy expounded on
that point to make sure it wasn't an open area that could potentially

be closed at a later time since the 222 sq. footage was absorbed into
the entire property. Mr. Eliopoulos answered in the affirmative.
Chairman Smith asked if he was correct in stating that in the future,
and under the current Code, no one could expand the footprint of the
home. Town Manager Dunham answered in the affirmative and then Mr.
Eliopoulos stated that, for the record, it could be expanded by one
foot. Vice Chairman Murphy asked if there had been any feedback from
the neighbors to which Town Clerk Taylor answered there had been none.
Vice Chairman Murphy made a motion to recommend approval of a
Level III Architectural/Site Plan based on a finding that the
construction of a 5,365 sq. ft. (including 222 sq. ft. of covered open
space that exceeds the maximum permitted FAR) Gulf Stream Bermuda, two-
story, single-family dwelling with a 2.5 car garage and swimming
pool/spa meets the minimum intent of the Design Manual and applicable
review standards with the following conditions:
1. Any minor modifications to the approved landscaping shall be
submitted to the Town Manager for review and approval and any
major modification shall be brought back to the ARPB for
review and approval, prior to commencement of landscaping.
2. Prior to the issuance of a certificate of occupancy, the
owner of the property shall prepare and record a deed
restriction which shall provide that all roof projection
areas shall remain unenclosed as per approval of the special
exception for as long as the structure is in existence or
exceeds the maximum permitted FAR.
Board Member Smith seconded the motion with all voting AYE at roll
call.
Vice Chairman Murphy made a motion to recommend approval of a
Special Exception to permit 222 sq. ft. of covered open space that
exceeds the maximum permitted FAR. Board Member Smith seconded the
motion with all voting AYE at roll call.
4. A development application submitted by the owner,
Bluewater Cove Gulf Stream, LLC, owners of Lot 1 in Place
Au Soleil Addition No. 2.
a. Level 3 Architectural/Site Plan Review to permit
construction of a 5,464 sq. ft. Gulf Stream Bermuda,
one-story, single-family dwelling with an attached
two -car garage and a swimming pool.
Mr. Mitch Kunik, Architect for Affiniti Architects,
gave a detailed PowerPoint presentation and started by stating Lot 1
was the first lot on the north side as you enter the community and was
a Gulf Stream Bermuda as the overall architectural theme. He added
this was a one-story home that met all the ordinances and setbacks for
Gulf Stream. Mr. Kunik stated that the roof areas were complying to
the less than 100 of flat roof area which kept it underneath the
overall building height. He explained that they were trying to do a
side -loading garage with all the homes and a 10' setback for the pool.

Chairman Smith asked if the chimneys were workable to which Mr. Kunik
answered they were just architectural features. Mr. Kunik showed
physical samples of the roof tile and driveway pavers. Mr. Louis
Valhos, Landscape Architect, gave a detailed presentation of the
landscape plan. Chairman Smith asked how big the Arica Palms were
going to be that were being put on the north side to which Mr. Valhos
answered 12-14'. Board Member Smith asked how long it would take the
clusia to grow since they were starting at 4-5' to which Mr. Valhos
stated a year. Board Member Smith asked about shutter colors and at
that point physical samples were handed out to the Board showing a
bluish gray.
Vice Chairman Murphy made a motion to recommend approval of a
Level III Architectural/Site Plan based on a finding that the
construction of a 5,464 sq. ft. Gulf Stream Bermuda, one-story, single-
family dwelling with a two -car garage and swimming pool meets the
minimum intent of the Design Manual and applicable review standards with
the following condition:
1. Any minor modifications to the approved landscaping shall be
submitted to the Town Manager for review and approval and any
major modification shall be brought back to the ARPB for
review and approval, prior to commencement of landscaping.
Alternate Board Member Canfield seconded the motion with all
voting AYE at roll call.
S. A development application submitted by the owner,

a. Level 3 Architectural/Site Plan Review to permit
construction of a 5,457 sq. ft. Colonial West Indies,
two-story, single-family dwelling with an attached
two -car garage and a swimming pool.
Mr. Mitch Kunik, Architect for Affiniti Architects,
gave a detailed PowerPoint presentation and started by stating Lot 2
was a Colonial West Indies two-story. He stated they were in
compliance with the flat roof area, overall roof heights and setbacks.
Mr. Kunik pointed out the side -loading garage and stated the second
story was towards the front of the home and had an uncovered balcony
for the entry feature. Mr. Kunik stated the upper story was going to
be a simulated wood made of stucco. Chairman Smith asked what the
window frame colors were going to be to which Mr. Kunik answered they
were white. He added that the roof was going to be a simulated shake
roof and showed the board a sample as well as a sample of the pavers
and paint swatch of the shutter color. Chairman Smith asked if the
shake roof was allowed in Gulf Stream to which Assistant Town Attorney
Nazzaro stated wood shingles were prohibited. Chairman Smith wasn't
sure about artificial wood shingles and didn't think there was an
example in town to look at. Mr. Paul Courchene stated he had this
roofing on his own home and if anyone wanted to see it, he would give

them the address and added that it was a very handsome roofing
material. Chairman Smith understood they were trying to differentiate
between the houses so they didn't all look cookie -cutter, but he wasn't
sure if going with a new roof style would open a can of worms in Gulf
Stream. Chairman Smith asked if there was another style of roof that
could be used on this home to which Mr. Courchene stated they could go
with a gray tile. Mr. Kunik stated they would probably go with a more
blended style of tile for the two-story home and the one-story home
next door would be more monotone. Town Clerk Taylor stated cedar shake
was permitted on the architectural style that cedar shake is associated
with. Mr. Kunik stated that cedar shake was associated with the West
Indies architectural style. Town Clerk Taylor stated that cedar shake
had been on some homes in Gulf Stream in the past and asked if it was a
lot more expensive to which Mr. Kunik agreed that it was a more
expensive option. Chairman Smith asked if this was something that
could be an exception or variance to which Town Manager Dunham stated
the Code said cedar shake was prohibited. Mr. Kunik noted that a cedar
shake shingle was different than a cedar shake tile. Mr. Courchene
asked if a cedar shake shingle was allowed to which Town Clerk Taylor
and Assistant Town Attorney Nazzaro stated in the affirmative. Mr.
Kunik asked about a metal roof to which that was immediately answered
with a resounding no. Mr. Louis Valhos, Landscape Architect, gave a
detailed presentation of the landscape plan.
Assistant Town Attorney Nazzaro stated he was retracting his
earlier statement regarding cedar shake and added that it looked like it
was prohibited, but he would investigate it further and have an answer
for the contractor and Commission.
Vice Chairman Murphy made a motion to recommend approval of a
Level III Architectural/Site Plan based on a finding that the
construction of a 5,457 sq. ft. Colonial West Indies, two-story, single-
family dwelling with a two -car garage and swimming pool meets the
minimum intent of the Design Manual and applicable review standards with
the following condition:
1. Any minor modifications to the approved landscaping shall
be submitted to the Town Manager for review and approval
and any major modification shall be brought back to the
ARPB for review and approval, prior to commencement of
landscaping.
2. At the submission to the Town Commission meeting, the
revised proposed roof covering should be brought to the
Town Manager for consideration prior to the meeting.
Alternate Board Member Canfield seconded the motion with all
voting AYE at roll call.
6. A development application submitted by the owner,
Bluewater Cove Gulf Stream, LLC, owners of Lot 14 in
Place Au Soleil Addition No. 2.

a. Level 3 Architectural/Site Plan Review to permit
construction of a 5,460 sq. ft. Anglo Caribbean, one-
story, single family dwelling with a two -car attached
garage and a swimming pool.
Mr. Mitch Kunik, Architect for Affiniti Architects,
gave a detailed PowerPoint presentation and started by stating Lot 14
was an Anglo Caribbean style one-story home that would sit to the south
of the entrance. He added there were no flat roofs on this home, and it
complied with the Town Code Design Manual. Chairman Smith asked if this
home had a vaulted ceiling to which Mr. Kunik answered that was the
intent. Vice Chairman Murphy asked about the features on the front of
the house to which Mr. Kunik answered they were a parapet roof feature
that worked as an element within the Anglo Caribbean architectural
style. Board Member Smith asked if there were bronze windows on this
home to which Mr. Kunik answered in the affirmative. Board Member Smith
thought those were prohibited. Assistant Town Attorney Nazzaro stated
they were admissible for this style of home but they were prohibited on
the Gulf Stream Bermuda style. Mr. Louis Valhos, Landscape Architect,
gave a detailed presentation of the landscape plan. Chairman Smith
asked why the hedge wasn't brought all the way down on the left side of
the property to which Mr. Valhos stated that the hedge only came all the
way down on the driveway side of the home. Board Member Smith asked
what the the color was to which it was answered that it was a white
tile roof.
Vice Chairman Murphy made a motion to recommend approval of a
Level III Architectural/Site Plan based on a finding that the

VII. Items by Staff.
Assistant Town Attorney Nazzaro explained to the Board that at
its September 10, 2021, meeting, the Town Commission passed on first
reading Ordinance 21/5. He added that the Ordinance seeks to restore
the previously allowed (under the discouraged category) heights for roof
and roof features, entry features, and eaves of single -story homes. It
has no impact on two-story homes. Town Manager Dunham explained that it
had become more and more challenging for the Town to approve one-story
homes, so this change was encouraged by the staff to encourage more one-
story homes in Gulf Stream.
