HomeMy Public PortalAboutNPDES (2020-21)TOWN OF GULF STREAM Town of Gulf Stream NPPES Annual Report Update Fourth Cycle, Fifth Year (2020.2021) Date: October 6, 2021 FOR PROFESSIONAL CONSULTING SERVICES: Engineering services for assistance in preparing the Fourth Cycle, Fifth Year Annual NDPES Report update. a:%al:1Ai1]*1N IIJi[•]►I On November 18, 2002, the Florida Department of Environmental Protection (FDEP) issued a National Pollutant Discharge Elimination System Permit No. FLS 000018 to the Town of Gulf Stream (Town) and 38 other co-permittees for all of their existing and new stormwater discharges into Waters of the State. The FDEP issued the Fourth Cycle permit in September 2016 which includes additional evaluation and provision of water quality monitoring program procedures than what was required in the Third Cycle permit. The permit requires implementation of a comprehensive Stormwater Management Program to control the quality of stormwater discharged from the municipal stormwater system. The permit requires annual reporting of activities conducted for the Stormwater Management Program. The consulting services provided under this authorization will provide services associated with preparing the Fourth Cycle, Fifth Year report for the period October 1, 2020 through September 30, 2021. This authorization is intended to set forth the scope of services, as well as other terms of the engagement such as compensation and billing, hourly billing rates, and other standard contractual terms. SCOPE OF SERVICES Baxter & Woodman, Inc. (B&W) proposes to provide the following services: MS4 MONITORING REQUIREMENTS ASSESSMENT PROGRAM TASKS: As per the requirements of the Florida Department of Environmental Protection and as outlined in Part V — Monitoring Requirements; Sub -part A — Assessment Program produce an annual report on the Assessment Program. The annual Assessment Program reporting consists of the following: • The name of the Town's approved Assessment Program plan, the date it was approved, and the status of implementation. • Assessment of the monitoring and loading results as they specifically relate to the Town's MS4. The water quality monitoring data will be obtained from the group's existing monitoring station as outlined in the approved Assessment Program. • Provide a summary of the monitoring and loading results as they specifically relate to the Town's MS4. Page 1 of 5 NPDES ANNUAL REPORT TASKS: 2. B&W shall coordinate with staff to provide the required information for tracking and reporting of the Town's NPDES program. Provide a brief evaluation of the Town's efforts with regards to the goals of the NPDES permit. The information will be implemented into the report and will include the following: a. Structural Controls inspections b. Identification of significant redevelopment c. Litter control and collection d. Pesticide, herbicide, and fertilizer regulation of application e. Obtain Town's total expenditures and budget amounts for the NPDES program f. Town facility controls and inspections g. Report of staff training h. Review of development and construction projects and whether their scope impact elements of the NPDES program i. Public information and outreach j. Inspections of illicit discharges and improper disposal k. Spill prevention programs I. Construction site inspections and BMPs 3. Review the implementation program of the co-permittees' overall water quality monitoring plans. Summarize the program and information as it relates to the Town of Gulf Stream. Meet with staff to discuss Stormwater Management Program resources and impacts on the program. B&W shall prepare a written evaluation of the strengths, weaknesses, and recommendations for revisions to address identified deficiencies in the applicable program elements as listed in the annual report form. 5. Prepare the Annual Report utilizing the FDEP form and provide the appropriate attachments. Provide a draft copy to the Town for review and comment. Provide an electronic copy to the Lead Permittee for review and comment. Address the comments, prepare the Final Annual Report and provide two (2) hard copies and an electronic copy to the Town. Provide an electronic copy to the Lead Permittee for submittal to the FDEP. 6. Prepare the Assessment Program Report providing a status of the implementation of the Town's Assessment Program to be included with the Annual Report. ASSUMPTIONS 1. Public education for illicit discharges is assumed to be by the group of co-permittees and will be included in the joint report. No additional work is included herein. The Town will provide B&W with a copy of all stormwater system inspection reports, monitoring, complaints, records of stormwater system repairs, records of volume of litter collected etc., for the reporting year. Page 2 of 5 3. A minimum of one meeting with staff is anticipated to discuss the required data and the stormwater program conducted over the prior year. Required discussions and meeting with staff shall be combined to the extent possible. 4. The scope of work does not include water quality testing or monitoring. 5. The scope includes responding to a single round of comments, if received by FDEP. CONTRACT PERFORMANCE Proposed fees and schedule for completion of tasks listed above are summarized below: COMPLETION DATES The work shall be completed by January 21, 2022. SUMMARY OF PROPOSED FEES Proposed Lump Sum labor costs and associated expense for engineering services are $8,270.00. A breakdown is provided in Attachment A. Work requested by the Town outside this scope of work, shall be completed if specifically directed by the Town, on an hourly basis in accordance with the rates listed in Attachment A. Signature of per on taking Acknowledgement Signature of Acknowledger Typed, Printed or Stamped Page 4 of 5 Compliance with Florida Statutes 119.0701— Public Records NPDES Annual Report Update, Fourth Cycle, Fifth Year (2021-22) In accordance with Section 119.0701, Florida Statutes, the Contractor must keep and maintain this Agreement and any other records associated therewith and that are associated with the performance of the work described in Scope of Services. Upon request from the Town's custodian of public records, the Contractor must provide the Town with copies of requested records, or allow such records to be inspected or copied, within a reasonable time in accordance with access and cost requirements of Chapter 119, Florida Statutes. A Contractor who fails to provide the public records to the Town, or fails to make them available for inspection or copying, within a reasonable time may be subject to attorney's fees and costs pursuant to Section 119.0701, Florida Statutes, and other penalties under Section 119.10, Florida Statutes. Further, the Contractor shall ensure that any exempt or confidential records associated with this Agreement or associated with the provision of services contemplated herein are not disclosed except as authorized by law for the duration of the Agreement term, and following completion of the Agreement if the Contractor does not transfer the records to the Town. Finally, upon completion of the Agreement, the Contractor shall transfer, at no cost to the Town, all public records in possession of the Contractor, or keep and maintain public records required by the Town. If the Contractor transfers all public records to the Town upon completion of the Agreement, the Contractor shall destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. If the Contractor keeps and maintains public records upon completion of the Agreement, the Contractor shall meet all applicable requirements for retaining public records. Records that are stored electronically must be provided to the Town, upon request from the Town's custodian of public records, in a format that is compatible with the Town's information technology systems.
