Chairperson Naill called the meeting to order at 6:33 p.m.

Commissioner Cook moved, and Commissioner Soles seconded the motion to approve
the Agenda. Motion carried: 5 -0.

a. Planned Development District Plan, Final Plan /Development Permit The Village at
Grand Park, Lot 12A Located in Section 28, Township 1 South, Range 75 West of
the 6 PM, County of Grand, State of Colorado
Commissioner Soles moved, and Commissioner Cook seconded the motion to open the
public hearing on the Planned Development District Plan, Final Plan /Development
Permit The Village at Grand Park, Lot 12A Located in Section 28, Township 1 South,
Range 75 West of the 6 PM, County of Grand, State of Colorado. Motion carried: 5 -0.
Proof of publication was provided.
The applicant is requesting a rezoning of a 40,200 SF (approximately .92 acre) parcel of
land. The parcel of land is currently zoned Business. The property is adjacent to Pine
Tree Plaza in the Town of Winter Park on the south, surrounded on the west and north
by the Grand Park PDD and US40 on the east. It is important to note a Development
Permit would be required for a parcel of land whether it is zoned Business or whether it
is zoned commercial in a PDD District.
The following was submitted on behalf of the applicant for the rezoning request:
Grand Park Development is seeking approval for a rezone to PDD, Final Plan and
Development Permit for the 0.92 acre property previously known as the McConnell
Parcel, located just north of Pine Tree Plaza.

Grand Park Development is proposing to rezone from Business to PDD. This rezone will
make this parcel's zoning consistent with the rest of the Village at Grand Park and
provide the necessary entitlements to begin construction on a new entertainment venue
in Fraser. The purpose of the rezone application is to ensure consistency in
development standards over Lot 12A as currently this lot has split zoning. The applicant
is proposing a standalone PDD with the development standards that are consistent with
Planning Area 1Wa in the Grand Park PDD. The Grand Park PDD includes a large area
and development standards that are not relevant to this small site therefore it was
determined that it would be more practical to create a separate PDD.
In conjunction with the rezone, Grand Park Development is seeking approval of a Final
Plan and Development Permit for a bowling alley and movie theater. The proposal is for
a joint facility that will include two movie screens and an eight lane bowling alley.
The relevant sections of the Fraser Municipal Code are Section 16 -4 -10 entitled
Business District and Section 16 -5 -10 entitled Planned Development District. Some of
the submission requirements were not applicable because most of the infrastructure has
been completed and dedicated previously to the Town.
The Planning Commission reviewed a subdivision final plat for this property in January
2011 before the applicant contemplated a rezoning request on said parcel. This final
plat has not yet been approved by the Town Board. All conditions of approval as stated
in the January 26, 2011 Planning Commission minutes will need to be addressed as a
condition of approval of this PDD, FP and Development Permit.
We received a letter from the Colorado Department of Transportation (CDOT) regarding
the access permit for this property. They are requiring a new traffic study for this
proposed land use.
Clark Lipscomb answered questions regarding the Final Plan /Development Permit.
Dick Norman, representing Mountain Chalet Property Management and Pine Tree Plaza
(PTP) had some questions regarding the venue. PTP is requesting that any approval for
this project include the completion of the street that will ultimately tie into Kings Crossing
Road in Winter Park. This will present an alternate means of ingress and egress of the
Grand Park Development. Could larger windows be placed on the south side? PTP
would like to create a reciprocal arrangement with Grand Park to move the PTP
dumpster to a location that would back up to the GP dumpster location. PTP would
then work with the developer to create enclosure that would be of benefit to both sites
with a common adjacent dumpster enclosure wall. PTP wants confirmation of the
property boundaries in order to add landscaping between the properties. PTP requested
additional information about existing easements. Discussion between the PTP BOD, the
current owner of the property, and the proposed developer /new owner took place
several weeks ago. All parties agreed at that meeting to vacate Private Easement #1
and Private Easement #2.
Brian Dornbusch, of Alan Carter Architect and Marc Unicume, proposed buyer of the
property, addressed the Commission on the architectural design of the building.
Commissioner Soles moved, and Commissioner Cook seconded the motion to close the
public hearing on the Planned Development District Plan, Final Plan /Development
Permit The Village at Grand Park, Lot 12A Located in Section 28, Township 1 South,
Range 75 West of the 6 PM, County of Grand, State of Colorado. Motion carried: 5 -0.
Commissioner Cook moved, and Commissioner Soles seconded the motion to
recommend approval of the rezoning of the property from Business to PDD, and the
Planned Development District Plan and the Final Plan /Development Permit, The Village
at Grand Park, Lot 12A Located in Section 28, Township 1 South, Range 75 West of the
6 PM, County of Grand, State of Colorado with the following conditions:
1. Approval of the Final Plat Phasing Plan, The Village at Grand Park Filing
2 and the Final Plat, The Village at Grand Park Filing 2, Lot 12A Tract
D by the Town Board.
2. All conditions listed in the1/26/2011 PC minutes relating to the approval of
the Final Plat Phasing Plan, The Village at Grand Park Filing 2 and the
Final Plat, The Village at Grand Park Filing 2, Lot 12A Tract D shall be
addressed.
3. Add a trail easement to the Final Plat, The Village at Grand Park Filing 2,
Lot 12A Tract D.
4. Off -site snow storage easement agreement(s) to be approved by the
Town.
5. Applicant to provide parking exhibit to clarify shared parking arrangement.
6. A portion of the utility easement at reception 2008007838 needs to be
vacated as the proposed building encroaches on a portion of this existing
utility easement which contains existing storm sewer infrastructure.
7. Landscaping plantings to be reviewed by the Town Gardener.
8. Final engineering plans and lighting specifications to be approved by the
Town Engineer.
9. An addendum to the Construction Plans needs to be submitted and
approved by the Town due to a change in the alignment of Second Street.
10. A Construction Guarantee Agreement (CGA) needs to be executed for the
private improvements prior to building permit issuance.
11. Add water and sewer service line connections to the utility plan and show
all easements on the site analysis sheets.
12. Parking meets all requirements.

the public hearing on Zoning Code Amendments. Motion carried: 5 -0.
Commissioner Shapiro moved, and Commissioner Soles seconded the motion to
continue the public hearing on Zoning Code Amendments. Motion carried: 5 -0.
5. Planning Commission Choice:
Commissioner Sumrall moved, and Commissioner Cook seconded the motion to
adjourn. Motion carried: 5 -0. Meeting adjourned at 8:40 p.m.
