Account 4 C- (N -18- 103 -201 NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from CME Associates for engineering services related to the PSE &G Minue Street Transmission Property Right of Way, at a total cost not to exceed $22,000.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to N.J.S.A 40A:11- 5(l)(a) in accordance with the Borough's Fair and Open Process as authorized by law. A copy of this Resolution be forwarded to the Borough's Purchasing Department, the Borough Director of Engineering and CME Associates. With this is mind, we offer the following: Preparation of an Outbound and Topographic Survev Our office will prepare an outbound and topographic survey of the total 11.5 acre ± parcels in accordance with the State Board of Professional Engineers and Land Surveyors Administrative Rules and Regulations 13:40 -5.1 "Preparation of Land Surveys ". Any additional fees required to address the problem shall be agreed upon in writing prior to continuing with the survey. Exceptions • The Borough shall coordinate with PSE &G and advise them that the property will need to be accessed to conduct the survey work. • A certified title report shall be provided by the Borough. • The survey will depict only those utilities open to view at the time of survey. Any easements found in the public record supporting underground utilities will be shown on the survey. • Any land surveying, environmental and /or professional engineering services beyond the scope outlined above will be considered extra. Said fees will be based on the hourly rate or a fixed fee mutually agreed upon in writing. • The above - quoted fees will be in effect for a period of twelve (12) months from the date of this proposal; however, the fees on the hourly rate schedule are subject to change by January 1 of each year. Should this fee estimate meet your approval, please provide our office with a professional services agreement or Resolution as an indication of the work to proceed.
