PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael Thompson, Council Member Kathy McNamara, Council Member Peter Wadsworth, City Attorney Andrew Rawlings, Public Works Director Zech Prouse, Treasurer Amy Sullivan and City Clerk Kcri Well. ABSENT: None. VISITORS: Ken Baldwin, Vicki Baldwin, Kevin Casper, Bob Davenport, LOAnn Belnap, John Stanger, Shayna Stanger, Ron Roberts, Tony Glenn, Cass) Adams. Mayor Gubler welcomed everyone and Attorney Andrew Rawlings led the Pledge of Allegiance. A roll call was taken to open the meeting. CONSENT AGENDA: City Council Work Meeting and City Council Meeting Minutes of June 25, 2019 were reviewed. Town Hall Meeting Minutes of June 13, 2019 were reviewed. Special City Council Meeting Minutes of July I I, 2019 were reviewed. Council reviewed the finance reports for the period ending June 30.2019 Mks of the fiscal year elapsed). The City had SKI3,90839 in the bank and routine bills had been paid, "Exhibit A". Mayor Gubler entertained a motion. Council President Geray made a motion to approve the consent agenda as presented Council Member Wadsworth seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: Appointment of Gary Elliott to Planning & Zoning Commission — Mayer Gubler introduced Gary Elliort from the audience and asked if Mc Elliott was able to attend this month's Planning & Zoning Meeting to introduce himself to the Planning & Zoning Commission. Mr. Elliott confirmed. Mayor Gabler entertained a motion. Council Member Wadsworth made a motion to appoint Gary Elliott to the Planning & Zoning Commission for the City of Iona Motion was seconded by Council President Geray. All in favor. Motion carried. Appointment of Dave Noel as City Engineer— Mayor Gubler stated the City has removed Paul Scoresby of Sehiess & Associates as the City Engineer due to multiple deadline conflict Mayor Gubler has proposed to appoint Dave Noel as the temporary City Engineer, until the City is ready to open the position up to bid. Mayor Gubler entenained a motion. Council Member Thompson made a motion to lemporanly appoint Dave Noel as the City Engineer for the City of Iona. Motion was seconded by Council Member Wadsworth. All in favor. Motion carried. Approval of Legal Services Proposal, Fiscal Year 2020 for Holden, Kidwell, Hahn & Crapo, P.L.L.C. - Council President Geray asked Attorney Rawlings if any of the rates had changed in this contract from the previous year. Attomey Rawlings stated his rate did increase from $I75/hour to $I80/hour, but no other rates changed. Mayor Gubler entertained a motion Council President Geray made a motion to approve the Legal Services Proposal for Fiscal Year 2020 with Holden. Kidwell, Icahn & Craps. Motion seconded by Council Member Thompson. All in favor_ Motion carried. Approval of Fiscal Year 2020 Preliminary Budget - Mayor Gubler stated the Preliminary Budget was discussed in the Work Meeting. The tentative budget has been set at S5,952,514. 'This is an increase in the General Budget from last fiscal year in the amount of S44,000. The total budget includes all the monies being used for the water project. Mayor Gubler entenained a motion Council President Gerry made a motion to approve the FY 2020 Preliminary Budget of $5952.514. Motion was seconded by Council Member Thompson_ All in favor. Motion carried. Iona Days - Clerk West announced Iona Days will be held Saturday, July 20". She continued and slated the City Council will need to be at Iona Elementary at 9:15am to participate in the parade. General Water System Discussion - Mayor Gubler stated the water tank project has been progressing and the Floor for tank should be poured in the next 1-2 weeks. He also stated the transmission line has already been installed under the railroad track and the two canals. Mayor Gubler continued and said the timing has been pushed back due to a conflict with scheduling of the rock saw required on the hill. He confirmed the transmission line will be completed by the fall of2019. Public Hearing- Conditional Use Permit Application, Ken Baldwin, Car Sales on R-1 Lot - Clerk West stated this was denied by the Planning & Zoning Commission due to the fact it did not meet the requirements set fonh in the Conditional Use Permit section ofthe R-1 Zone, in the Iona City Code. Clerk West also stated she has received five comments of concern t'or this application from various Iona residents. Mayor Gubler stated if the current version &City Code does not allow this type of Conditional Use in the R-I Zone, the Council cannot approve this application at this time. Council Member Wadsworth informed the audience that the City Council is currently working with the City Attorney to make some changes to the Conditional Use Permit guidelines and requirements to make them more accessible, while still protecting the City. Ken Baldwin (5026 Rockwood Avenue) approached the podium and introduced himself as the owner of Mc Suds and the applicant for this agenda item. Mr. Baldwin stated he had a car dealership at his home many years ago and he never had complaints from neighbors. He 2 continued and said he already has a business license for his auto detailing company, Mc Suds. He now wants to sell a few cars at a time there also. Mr. Baldwin stated he has a shop that he will put the cars in, so it won't affect the visual aspect of the neighborhood. Mayor Gubler stated this application will be tabled until the revisions to the City Cade are complete. Ordinance to Amend Section 1-5-11 and 1-6-5 of the Iona City Code to Revise the Annual Salaries for the Mayor and City Council — Mayor Gubler introduced this item and stated the City is proposing to raise the Mayor's annual salary from $6,000 to $12,000. He also stated the City is proposing to raise the annual salary of each City Council Member to $3,600 from $2,400. Mayor Gubler also stated the state requires these amendments to be done poor to an election and do not take effect until January 15, after the election. Mayor Gubler asked for all those in the audience who oppose this change to approach the podium. No response. However. Mayor Gabler read aloud a letter received from previous Mayor Brad Andersen, who expressed his opposition to this action but could not attend the meeting. After reading the lenen Mayor Gubler addressed several concems presented in Mayor Andersen's letter. Mayer Gubler stated the salary increases that are being proposed tonight were determined Bier reviewing comparable cities in a statewide salary survey completed by the Association of Idaho Cities. Resident Cody Menill asked if these increases are already included in the Preliminary Budget that was just approved and when the increases go into effect. Mayor Gubler confirmed the increases are already included in the Preliminary Budget and the increases will not go into effect until January 1, 2020. Mayor Gubler asked for all those in the audience who are in favor of this change to please approach the podium. No response. Mayor Gubler did state he has received two handwritten Iehers in suppon of this increase. Mayor (Abler once again asked for all those in the audience who oppose this in se to approach the podium and voice their concern. No response. Mayor Gubler then closed thePublic Hearing portion of this agenda item. Mayor Gabler entenained a motion. Council President Geray made a motion to approve an Ordinance of the City of Iona Idaho amending Sections 1-5-8 and 1-6-5 of the Iona City Code, revising annual salaries for the Mayor and City Council, preserving prior Ordinances in each instance, providing for severdbility, and establishing an effective date. Council President Geray also moved to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Motion was seconded by Council Member McNamara. A roll call vote was taken: Council Member Wadsworth: Yes Council President Geray: Yes Council Member Thompson: Yes Council Member McNamara: Yes Bonneville County Sheriff's Office Contract Proposal — Mayor Gubler stated the City is deciding tonight whether they keep the Iona Police Department OPD) or contract with Bonneville County Sheriffs Office (BCSO) for full-time policing in the City of lona. Mayor 3 Gubler acknowledged a petition has gone around the City to suppon keeping the IPD. Council President Geray counted the signatures and confirmed a total of 46. Mayor Gubler also stated this is the fourth meeting the City has held to discuss this proposal. One of those meetings was a Town Hall Meeting where 28 people were in attendance to oppose the contract. Mayor Gubler continued and stated the main concern that was brought up was regarding the amount of police presence the City of Iona needs. The majority of the people that have attended the meetings and that he has spoken to personally have stated they want more police presence. Mayor Gabler highlighted what the proposed contract with BCSO would include; 195 hours of patrol, an additional full-time officer that would work a 40 hour work week in the City of Iona. Code Enforcement and Animal Control. Mayor Gabler also stated the City will maintain ownership of all police equipment. Ile continued and stated the contract includes an option to cancel the contract at any time. Mayor Gubler also stated he understands the desire to have an officer in the City that has a relationship with the residents. He continued and said BCSO requires their officers to make contact with residents each shift and develop a relationship with the community. In addition, he stated there are currently 9 officers with BCSO that live in the City of Iona. Resident Cody Menill (3330 N. Dayton Street) stated he has lived in Iona for 16 years He continued and stated the City bears a large amount of liability by having its own police force. If an IPD officer causes an accident or handles a situation incorrectly, the City is 100% liable for that. He also stated if a higher crime happens in Iona. BCSO would have to take it over as the City doesn't have sufficient resources to handle a situation like that. In addition. in a domestic dispute, an officer is not supposed to enter alone The IPD never has two officers on shift at the same time, so this either creates a dangerous situation for the officer, or they would need to call BCSO for backup. Mr. Merrill stated he is very opposed to keeping the IPD due to the unseen liability involved. however, he did state BCSO is already obligated to answer our calls if we don't have the IPD. He continued and said the only reason for a contract is for the City of Iona to help pay more of the service for all of Bonneville County. Anomey Rawlings stated BCSO is obligated to provide a base service to the City of Iona, because we reside in Bonneville County. However, the contract being proposed goes over and above the base services required. This includes the 40 hour full-time officer, shift work, Code Enforcement, Animal Control, lesser crimes, etc. Those services are not requirements for BCSO to cover without a contract. Dennis McArthur (3652 N. Dayton Street) sated he would like to find a way to have both the IPD and have BCSO help cover. He values the presence and community feeling of having the IPD. Mr. McArthur continued and stated the history with BCSO was not a great experience. Mayor Gubler stated he understands the negative history with BCSO. That is why the City is not getting rid of any police equipment and why the contract has a cancellation option at any time. Mayor Gabler stated if BCSO does not fulfill their contractual agreement or the City is unhappy with their service, the City can cancel the contract and reinstate the IPD. Shayna Stanger (5357 E. Scoresby Avenue) voiced her concern that those opposing the contract with BCSO are not being heard by the City Council and Mayor. Mayor Gubler stated he appreciates those that have attended the meetings. However, from his personal experience, those people do not represent the whole community. He continued and said he has spoken with many people in the community and the majority is in favor of a contract with BCSO. 4 John Stanger (5357 E. Scoresby Avenue) stated this is me big of an issue to allow 5 people to decide. He strongly believes this is an item that needs to be voted on by the City at a City Election. Mayor Gubler stated the City Council and Mayor are voted on by the City to represent the community as a whole. They are elected to make important decisions, including this and the annual budget that involves millions of dollars. Mr. Stanger stated he will gather more signatures and get a ballot initiative on this Novembers City Election. Mayor Gubler stated there is not enough time at this point to add an initiative to the ballot Mr. Stenger stated he has called the Bonneville Elections Office and they told him he only needs 30 days before the election to submit an initiative. Mayor Gubler encouraged him to pursue it Chelsie Moore (3053 N. Sagebrush Avenue) asked what the cost difference is for the IPD to hire another officer, rather than contracting with BCSO. Council Member Geray stated the Police Budget in the Preliminary Budget is approximately $270,000 and includes 2.5 officers. That includes the cost of the vehicles, equipment and payroll. Each full-time officer costs the City approximately $100,000/year for the full benefit package, payroll and gear. Fred Blood (5185 E. Hansen Avenue) stated they moved to Iona from California last year. One of the reasons they chose Iona was because of the presence and Rendliness of the IPD- Mr. Blood also expressed concern for having a contract with BCSO and losing that control. Lieutenant Kevin Casper (BCSO) spoke regarding the police necessities required for a small city. Some days the City of Iona may only have a couple of calls that require one officer. However, there are other days when the City of Iona has heavy call volume and requires many officers due to the type of infractions. Lt. Casper responded to a question regarding BCSO being short-staffed by saying they currently have officers in training. He also stated by policing the City of Iona full- time, they will be able to more efficiently cover more ground because they arc already covering all the area surrounding Iona. Lt. Casper also stated the IPD has gone through ) full-time employees in the last 5 years With each tumover, BCSO has to pick up the pieces and that has been very difficult forthem. Lt. Casper encouraged the residents to give the BCSO a chance with an open mind. He also stated Officer Hinton has already begun the hiring process with BCSO and can possibly be the full-time officer for Iona air he completes the 12 week mandatory training. Resident Jalyn Louk (5428 E. Rockwood Avenue) voiced concern that BCSO has previously stated they will not be able to have the 40 hour full-time officer in Iona for up to 6 months because of transition and staffing. She encouraged the City Council to consider that when voting. Mayor Gubler stated he has heard all of the concerns talked about at this and previous meetings. however, he believes that a contract with BCSO will provide more police coverage for the City at a significant savings. He encouraged the residents to have an open mind and patience with the transition. Council President Geray stated he has provided feedback regarding the contract to Attorney Rawlings pertaining to police presence and the expectation the City has in the amount of presence provided by BCSO. Attorney Rawlings said they are attempting to address that in the contract by adding an objective to measure that presence. He referenced a section in the contract that has a target for presence. Attorney Rawlings stated the City can add to the contract specific 5 hours per shift Lt. Casper stated the City and BCSO will need to work together on the wording to align with the goals of both entities. Mayor Gublcr entertained a motion. Council President Geray made a motion to apprme the Bonneville County Sheriffs Office contract proposal as it will be amended to address stated sues, not to exceed the identified 8212,000 for a one year contract. Motion was seconded by Council Member Thompson. Clerk West also informed the City Council there have been changes with the Planning & Zoning Commission, including a new Chairman. lames West, the new P&Z Chairman, has expressed concern regarding inconsistencies in the City Code. Chairman West has requested permission for the Planning & Zoning Commission to begin reviewing various chapters of the City Code monthly and provide recommendations for the City Cowell to then review. Council Member Wadsworth, Council President Geray and Council Member Thompson all stated nothing to report. Council Member McNamara stand the Iona Historical Museum will be in charge of the Silent Auction at Iona Days this year. She encouraged suppon for the museum by participating in the Silent Auction.
