RESOLUTION AUTHORIZING EXCEL ENVIRONMENTAL
RESOURCES, INC. TO APPLY FOR GRANT FUNDING
WHEREAS, the State of New Jersey Department of Environmental Protection through
the Hazardous Discharge Site Remediation Fund, has grant funds available to
municipalities for the purpose of funding preliminary assessments, site investigations,
remedial investigations and /or remedial action to determine the existence or extent of
hazardous substance discharge conditions on properties; and
WHEREAS, the Borough of Carteret Chrome Waterfront Brownfield Development Area
(BDA) application was approved by the New Jersey Department of Environmental
Protection (NJDEP) in December 2007 and a Memorandum of Understanding, governing
the partnership between the municipality, the Steering Committee and the NJDEP, was
fully executed on May 28, 2008; and
WHEREAS, the Borough of Carteret wishes to conduct a preliminary assessment, site
investigation, remedial investigations and/or remedial action with respect to the property,
located within the BDA, commonly known as the Carteret Arthur Kill Walkway,
Roosevelt Avenue, referred to as Block 304. Lot 2.02; and
WHEREAS, Excel Environmental Resources, Inc. is qualified to prepare and submit said
Application for such funding.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, Middlesex County and State of New Jersey as follows:
1. Excel Environmental Resources, Inc. is hereby authorized and directed to apply
for grant funding in order to conduct preliminary assessments, site investigation,
remedial investigations and/or remedial action for the above- described parcel.
2. The Mayor and Borough Clerk or Director of Finance for the Borough of Carteret
is authorized to execute any and all documents necessary in order to apply for the
aforesaid grant.
3. In the event that funding is approved pursuant to a grant issued in favor of the
Borough of Carteret, Excel Environmental Resources, Inc. is hereby authorized
and directed to implement preliminary assessments, site investigation, remedial
investigations and /or remedial action for the above described parcels. with
payment for the aforesaid services to be made to Excel Environmental Resources,
Inc. from the aforesaid grant funds in accordance with the contract to be approved
by the Borough of Carteret Council and the New Jersey Department of
Environmental Protection.
4. That the Borough of Carteret is committed to the redevelopment of the Carteret
Arthur Kill Walkway, located within the Chrome Waterfront Redevelopment
Area, within a three year period from the completion of the remediation.
