AN ORDINANCE AMENDING
SECTION 5.08.150 FAILURE TO PAY FEE -- ACTION TO COLLECT
OF THE MOAB MUNICIPAL CODE
WHEREAS, the Moab City Council feels it necessary to amend
said Section 5.08.150 of the Moab Municipal Code to set forth a
penalty and to specify punishment for any violation of such
Section;
NOW, THEREFORE, IT IS HEREBY ORDAINED AS FOLLOWS:
That Section 5.08.150 FAILURE •TO PAY FEE -- ACTION TO
COLLECT of the Moab Municipal Code, is hereby amended to read as
follows:
Section 5.08.150 FAILURE TO PAY FEE -- ACTION TO COLLECT --
PENALTY. A. Whenever any fee required to be paid under this
Chapter is not paid on or before the day on which it becomes
delinquent, a penalty of 10% of the amount due shall be imposed,
or a minimum penalty of $10.00 shall be imposed, whichever sum
shall be greater.
B. Any license fees due and unpaid under this chapter and
all penalties thereon shall constitute a debt to the City and
shall be collected by court proceedings in the same manner as any
other debt in like amount, which remedy shall be in addition to

all other existing remedies.
C. A failure to pay any fee required under this Chapter in
a timely manner shall constitute a Class B Misdemeanor and shall
be punished as prescribed by law.
