ORDINANCE ADOPTING THE AMENDED DMPA ECONOMIC DEVELOPMENT
RIDER INTO THEEICHMOND POWER AND LKG'11TRAT0TA0XFF
VV8ERE/\S, the City ofRichmond, Indiana owns and operates its own o|cot,io Utility,
Richmond Power& Light(hereinafter"RP&L"or the"Utility"), under the supervision and control
of the Board of Directors (hcnciouMcc "Board"), ofRP&L pursuant to IC 8'1.5-3'4; and
VV}fERE/\S, the rates and charges ofQP&cI. are subject to the jurisdiction of the Cnnnnnon
Council ('^Counri[`); and
WHEREAS,the existing rates and charges for electric services provided by the Utility were
placed into effect ho|(ovviog approval by the Indiana Otiiity Regulatory Cunuonisaiun in {�ouuc No,
45361 in u Final Orckr dated January 20, 2021 and unoendcd effective July |, 2022; and
VV82KL' \S, ALP&L. is u nuenobcr of the Indiana Municipal Pnv/ur Agency ("TMPA")� and
VVBEKLE/\S, the Council previously adopted un E0000nnic Development Rider, which is
included in the rates and charges tariff, that makes incentives avui|uh|c to qualifying Customers of
the electric utility uu the yunnc tcrnou as |MP/\`o \,cononoic Development Rider (tbc ^1MP/\
Rider"); and
W|l6RC&S, lMP/\ recently amended the iMP/\ I{idcc and RP&I, must now make
conforming changes to) its Economic Dcvz|opnucni Rider(attached as [Zxbibit/\ in amended form);
and
VVHER2/\D, the Board adopted Resolution No. 1-2023 on April 3, 2023, which
recommended approval of the amended lMPf\ Rider by the Cunon000 Council.

NOW TIIEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF TIIE CITY
OF RICHMOND, INDIANA, THAT:
The attached amended IMPA Rider be adopted and incorporated into the RP&L Rate Tariff
and shall be in full force and effect from and after its adoption by the Common Council and
approval by the Mayor.

Economic Development Rider
\. Availability. This Rider is uvui|uh|c to a Qualifying Customer (as defined herein) to
encourage large power users to expand or create new operations within the Utility's servicc
territory.
2, Qou|ifiuudooy. /\ "Qualifying Cuxioruc/` iso new or existing non-residential customer in
the Qb|iiy`s service territory that is establishing new operations or expanding existing
operations smch that the new or expanded opc,u\innu will rcmok in new or additional
demand of at least one (1) MW (1000 kW)at one delivery point(the"Qualifying Dcmand")
and the new or expanded operations has involved a cuphu| investment of' at least one
million dollars ($1.000,000) within the Utility's service territory.
For u Qualifying Customer that iu expanding operations, Oua|i[ving /]cozond is measured
bmm the average monthly peak demand for the twelve (12) months immediute|yprcccding
the Incentive Pohod`x Effective Date. [o, u Qualifying Customer that is establishing new
operations, Qualifying Demand is measured from zero,
/\ Qualifying C.ustonuer is not u customer: (l) with ^^nov/" dcrnond that results from a
change in ownership of an existing ceiuh|iohoncnt vvhbouL qualifying new load; (Z)
renewing service following interruptions xuch as cquipnnCnt failure, ico`ponucy plant
Shutdown, strike, economic conditions, or natural disaster; or (3) that has shifted its load
from one nperuhmo or customer to another within the lJd|ity`n service territory. The Utility
may dntconioc exclusively, vvilhVu1 recourse by the cumtmnncr, vvhetbe, an event has
occurred that would prevent u Customer hvnn being a Qualifying Customer.
3. Rate Incentive. Beginning with the Incentive Period's FfTective Date, Utility will receive
a credit no its vvhoicuu[c bill for the qualifying new load. The incentive uroountccccivcd
by Utility from the Indiana Municipal Power Agency for such load will be passed in full
to Qualifying Customers. For reference purposes, the discount to the Ouu|iyvin&
Customer's wholesale coot for qualifying new load will he calculated according to the
following schedule:

"Incentive Period" nucanm months l through 60` as designated above. The "Incentive

customer receives the incentive. If the |occotivuPeriod`o Effective Date is after December

The Qualifying Cuutooucrouuot meet the minimum Qualifying Demand during each month
of the Incentive Period. Failure to nocui the noiuinuuno Ouo|i[vinD [)cnnond in upnrticular
month will rcau|i in 0Y6reduction for that month.
4. l[erons and Conditions. The Qualifying Customer must suhnoi\ u Service Application to
the Utility specifying: (|) a description oil'the amount arid noiu,eo[the new load-, (2) thc
basis on which the Qualifying Customer rnectx the requirements of this Rider; (]) the
Qualifying Customer's desired effective date; and
This Rider will terminate on the same doic that |MPA"w economic development rider
tconimu1co. except that any Qualifying Customer receiving the rate incentive atthe time of
the Kjdcr`m termination may continue receiving the incentive for the remainder of the
upp|icuh|c Incentive Period (us long it continues to meet the Rider's requirements)
