THE CITY OF RICHMOND,INDIANA, TUESDAY, JANUARY 4, 2005
The Common Council of the City of Richmond, Indiana met in regular session Tuesday, January 4, 2005,
in the Council Chambers in said City. President Bruce Wissel presided and the following business was
conducted:

Councilors present were Howard "Jack" Elstro, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al
Glover, Gil Klose and Diana Pappin. Absent was Etta Lundy.
APPROVAL OF MINUTES
Councilor Parker moved to approve the minutes of the meeting of December 20, 2004 with a second by
Councilor Welch. The motion carried with a unanimous voice vote.
COMMUNICATION FROM THE MAYOR
Mayor Hutton thanked Councilor Glover for his leadership in having 55 new bus stop signs installed
throughout the City.
The Mayor thanked all City employees for their efforts which went over and above the call of duty during
the recent record snow storm. Ms. Hutton reported she is working with the Police, Fire, Sanitary, Street
and Park Departments in developing an emergency snow removal plan with all departments working as
one team.
Mayor Hutton also announced there will be a rally on Saturday, January 8 at 10 AM to show Target the
support of our community. Target will be closing on January 29 but it is hoped there will be a clear
message that Richmond would like to be considered for another Target store in the future. At the same
time of the Rally, donations will be accepted to be forwarded to victims of the recent Tsunami in Asia.
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
Minutes of the December 9 meeting were accepted as presented.
MISCELLANEOUS BUSINESS
Council President Wissel presented an engraved pen to Larry Parker and thanked him for his service as
President of Council in 2004.
Mr. Wissel distributed copies of nominations for positions on the Human Rights Commission, the Urban
Enterprise Association Board and the Citizen Advisory Committee. Additional nominations will be
accepted until the January 17 meeting.

Mr. Wissel also stated on Committee appointments will remain the same for 2005 with the exception of
the Tax Abatement Committee where Dianna Pappin will replace Bruce Wissel.
ORDINANCES ON SECOND READING
ORDINANCE NO. 96-2004 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A
CERTAIN PARCEL FROM M-1 TO A SPECIAL USE DISTRICT(923 N"E" Street)
The Clerk read Ordinance No. 96-2004 on second reading by title only.
Council President Wissel reported the Richmond Advisory Planning Commission conducted a public
hearing on Ordinance No. 96-2004 on December 16 2004. This is the petition of Richmond and Kathy
Parker, owners; requesting a rezoning to the Special Use District in a M-1 Light Manufacturing District,
for an assembly hall for parties, receptions, reunions, etc., located on the top floor of the Richmond
Hardware business at 923 North"E" Street. The nature of the area is changing from industrial to a mix of
retail and service uses. The area is changing for the better. This use will be good for the neighborhood.
Five adjacent property owners were notified with no comments received. The Plan Commission voted 8-
0 to recommend approval of the ordinance. Mr.Parker was present and available to answers questions.
Council President Wissel declared Ordinance No. 96-2004 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 96-2004 with a second by Councilor Parker. The motion carried with a unanimous voice vote.
Councilor Welch moved to suspend the rules and advance Ordinance No. 96-2004 to third and final
reading and read by title only with a second by Councilor Pappin. The motion carried with a unanimous
voice vote.
The Clerk read Ordinance No. 96-2004 on third reading by title only.
Ordinance No. 96-2004 was adopted with an 8-0 roll call vote.
ORDINANCE NO. 97-2004 - A SPECIAL ORDINANCE VACATING A UTILITY EASEMENT
(1330 S 15th Street)
The Clerk read Ordinance No. 97-2004 on second reading by title only.
Wissel reported the Richmond Advisory Planning Commission conducted a public hearing on Ordinance
No. 97-2004 on December 16 2004. This is the petition of Jon and Michelle Stoffle, 1330 South 15th
Street, requesting a vacation of a portion of a platted, but unused, utility easement. This request is for a
vacation of an easement entirely on the petitioner's property. All utilities were notified and will not be
used by any utility in the future. The Plan Commission voted 8-0 to recommend approval of the
ordinance. Bob Goodwin, Director of City Planning, was present on behalf of the owner.
Council President Wissel declared Ordinance No. 97-2004 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 97-2004 with a second by Councilor Welch. The motion carried with a unanimous voice vote.
Councilor Welch moved to suspend the rules and advance Ordinance No. 97-2004 to third and final
reading and read by title only with a second by Councilor Sharp. The motion carried with a unanimous
voice vote.

ORDINANCE NO. 98-2004 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A
CERTAIN PARCEL FROM C-1 TO C-2 COMMERCIAL DISTRICT(1000 S `E' Street)
The Clerk read Ordinance No. 98-2004 on second reading by title only.
Councilor Wissel, reported the Richmond Advisory Planning Commission conducted a public hearing on
Ordinance No. 98-2004 on December 16 2004. This is the petition of James Wigger, owner; Jeff Hanna,
agent, requesting a rezoning from the C-1 Limited Commercial District to the C-2 Commercial District,
located at 1000 South "E" Street in order to allow the owner to operate a package liquor store. Six
adjacent property owners were notified with two responses received in opposition. There was substantial
opposition from the neighborhood as well as a letter from the Police Chief opposing the request. The
staff recommended denial of the request because it represents an effort to "spot zone" and was not a
natural continuation of nearby zoning. The Plan Commission voted 8-0 to recommend denial of the
ordinance.
Council President Wissel declared Ordinance No. 98-2004 on second reading and public hearing. There
being no comments with for or against the ordinance, Councilor Elstro moved for engrossment of
Ordinance No. 98-2004 with a second by Councilor Welch. The motion carried with a unanimous voice
vote.
Councilor Welch moved to suspend the rules and advance Ordinance No. 98-2004 to third and final
reading and read by title only with a second by Councilor Pappin. The motion carried with a unanimous
voice vote.

Ordinance No. 98-2004 was denied with an 8-0 roll call vote.
ORDINANCE NO. 99-2004 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A
CERTAIN PARCEL FROM R-3 TO A SPECIAL USE DISTRICT(2826 E Main Street)
The Clerk read Ordinance No. 99-2004 on second reading by title only.
Councilor Wissel reported the Richmond Advisory Planning Commission conducted a public hearing on
Ordinance No. 99-2004 on December 16 2004. This is the petition of Rick and Carol Webb, owners;
requesting a rezoning to the Special Use District in an R-3 Multi-family District, for a professional office
for insurance and financial services, located at 2826 East Main Street. Eight adjacent property owners
were notified with three responses received in opposition and three responses received in favor. There
was substantial opposition from the neighborhood residents, twenty-two of whom signed a petition
opposing the request. The staff recommended denial of the request. The Plan Commission voted 7-1 to
recommend denial of the ordinance.
Council President Wissel declared Ordinance No. 99-2004 on second reading and public hearing. Carol
Webb, owner, spoke in favor of Ordinance No. 99-2004. Speaking in opposition were neighbors Pam

Cochran, Janet Wortman and Dr. H. Timson. Councilor Welch moved for engrossment of Ordinance No.
99-2004 with a second by Councilor Pappin . The motion carried with a unanimous voice vote.
Councilor Pappin moved to suspend the rules and advance Ordinance No. 99-2004 to third and final
reading and read by title only with a second by Councilor Sharp. The motion carried with a unanimous
voice vote.

Ordinance No. 99-2004 was denied with an 8-0 roll call vote.
CALL FOR ADJOURNMENT
There being no further business, a motion duly made and seconded, the meeting was adjourned.
