III. MINUTES OF THE REGULAR MEETING AND PUBLIC HEARING OF 10-28-2021
Board Member Roach made a motion to accept the minutes of the
regular meeting on October 28, 2021. Board Member Smith seconded the
motion with all voting AYE at roll call.

C. Applications for Development Approval
1. An application submitted by Benjamin Schreier of Affiniti
Architects, as Agent for James and Nadia Davis, owners of
property located at 588 Banyan Road, Gulf Stream, Florida,
which is legally described as Plat of Polo Cove, Lt. 1, S
50 ft. of Lt 2 & S 75 ft. of Lot 3 & N 55 ft. of Lt 2A.
a. DEMOLITION PERMIT to remove existing structures on the
property, with the exception of the existing entry
wall pier feature at the entrance.
b. SPECIAL EXCEPTION to reduce the rear setback from 50'
to 35' as per Section 70-75 (j), Rear Setbacks for
Waterfront Lots in the Core District.
c. LEVEL 3 ARCHITECTURAL/SITE PLAN REVIEW to permit the
construction of a single family, two story, 8,699 sq.
ft. Anglo Caribbean dwelling with attached 2&1/2 car
garage and a swimming pool.
Mr. Benjamin Schreier, Architect and Agent, gave a
detailed presentation proposing a new two-story Anglo Caribbean house
after removing the existing home. He noted they wanted to renovate the
existing site wall, which was in a non -conforming location. Mr.
Schreier stated they were proposing a stucco base, windows with a light
blue frame and a cedar shake shingle roof. He then passed samples
around. Mr. Schreier noted the garage doors would be the same blue as
the window frames. Mr. Schreier stated Town Clerk Taylor had called him
with a concern regarding the glass on the back of the home. He noted
that the Town Code allowed for 40% and after their calculations, they
were at 30.40, so well below the allowable amount.
Mr. Joe Peterson, Landscape Architect gave a detailed
presentation of the landscaping. He noted trees that were already on
the property that they were going to save as well as others that were
not healthy, they would be disposing of and replacing.
Board Member Smith asked about the cedar shake roof, to which Mr.
Schreier stated that cedar shake was true to the Anglo Caribbean style,
and he passed around a sample. Chairman Smith asked if it was staying
in its natural state with no stain to which Mr. Schreier answered that
it was not being stained but would probably fade a bit from the sun.
Alternate Board Member Jones asked about it silvering to which Mr.
Schreier stated it may silver a bit. Mrs. Jones then asked if they were
going to put any preservative on it and Mr. Schreier stated they were
going to keep it in its natural state the way it was historically.
Board Member Dockerty asked how long a cedar shake roof would last to
which Mr. Schreier answered that with good maintenance it could last 20-
25 years.
Alternate Board Member Jones asked about the color of the garage
doors to which Mr. Schreier stated they would match the blue of the
window frames. She asked if there was anything in the Code regarding
the color. Town Manager Dunham stated there were no restrictions or
prohibitions. Town Clerk Taylor added that the color was up to the

Board and whatever they deemed fitting to the architectural style. Mr.
Schreier stated they had picked the color from the color chart in Town
Hall. Chairman Smith stated he thought window frames were restricted to
either white or bronze to which Town Clerk Taylor answered that it was
dependent on the architectural style. Board Member Dockerty asked if
this architectural style allowed for color to which Town Clerk Taylor
answered she knew of no reason it couldn't be a color, but that the
color was the Board's responsibility. The Board was in consensus that
the blue was too intense and asked for a lighter, softer shade of blue,
a more muted blue or a blue gray. Mr. Schreier consulted the owners,
who stated they would be in favor of a lighter blue, but not a blue
gray. The Board asked for multiple samples of a lighter shade of blue
to be brought back before the board at a later time prior to issuing a
C.O.
Board Member Roach asked about the special exception and where it
was located on the property. He pointed out that in Section J of the
Code it stated any portion of the structure within 50' of the waterway
shall not exceed one story. Mr. Schreier stated that only the one-story
portion of the house was in the setback and the location was on the
inlet, not the Intracoastal.
Chairman Smith asked if the seawalls were all good to which Mr.
Davis told him there were some repairs that needed done, which they were
planning on doing at the same time as the building of the house. Board
Member Dockerty asked about grade increase to which Mr. Schreier
answered 1.5-2 ft. Chairman Smith asked if there had been any comments
from the neighbors to which Town Clerk Taylor stated there had been
none.
Board Member Roach made a motion to recommend approval of a
demolition permit to remove existing structures on the property, except
for the existing entry wall pier feature at the entrance. Board Member
Dockerty seconded the motion with all voting AYE at roll call.
Board Member Roach made a motion to recommend approval of a
special exception to reduce the rear setback from 50' to 35' as per
Section 70-75 (j), Rear Setbacks for Waterfront Lots in the Core
District. Board Member Dockerty seconded the motion with all voting AYE
at roll call.
Board Member Roach made a motion to recommend approval of a Level
III Architectural/Site Plan based on a finding that the construction of
an 8699 sq. ft. Anglo Caribbean, two-story, single-family dwelling with
a 2.5 car garage and swimming pool meets the minimum intent of the
Design Manual and applicable review standards with the following
conditions:
1. Any minor modifications to the approved landscaping shall
be submitted to the Town Manager for review and approval and
any major modification shall be brought back to the ARPB for
review and approval, prior to commencement of landscaping.

2. The color of the window frames, railing and garage doors
be modified to a more subtle blue than was presented at the
meeting and brought back before the ARPB for approval.
Board Member Dockerty seconded the motion with all voting
AYE at roll call.
