THE CITY OF RICHMOND, INDIANA, TUESDAY, FEBRUARY 22, 2005
The Common Council of the City of Richmond, Indiana met in regular session Tuesday,
February 22, 2005, in the Council Chambers in said City. President Bruce Wissel presided and
the following business was conducted:

Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing
Welch, Larry Parker, Gil Klose and Diana Pappin. Absent was Al Glover.
APPROVAL OF MINUTES
Councilor Parker moved to approve the minutes of the meeting of Monday, February 7, 2005
with a second by Councilor Welch. The motion carried with a unanimous voice vote.
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
Minutes of the January 27 and February 3, 2005 meetings were accepted as presented.
MISCELLANEOUS BUSINESS
The following students from Richmond High School were in attendance: Travis Marshall,
Shannon Franklin, Heather Stone, Aherin Law, Alyssa Clark, Deszaree Stoner, Stephanie
Lamberson, Marquita Miller, Vanessa Adams, Micah Owens, Barry Manaluh, Tyray Logan,
Christopher Harris, Derek Worch, Nicole Wickman, Katie Stevens, Chris Murray, Dan Adleski,
Amy Hilton, Tyler Hamm, Danielle Schattel, Taylor Shake, Kristin Templeton, Jessica Tran,
Ashley Nolan, Erica Kennedy, Anna Margaret Bickel, Christine Toschlog, Zac O'Maley, Adam
Rice, Mickey Dunham and John Stockton.
Council President Wissel announced an Executive Session has been scheduled for March 7,
2005 at 6:00 PM in the Council Chambers. The purpose of this Session is to discuss possible
litigation.
ORDINANCES ON FIRST READING
Councilor Elstro moved to suspend the rules and read Ordinance Nos. 7, 10, 11 and 12-2005 on
first reading by title only.
ORDINANCE NO. 7-2005—A GENERAL ORDINANCE AMENDING SECTION 31.02 OF THE
RICHMOND CODE
The Clerk read Ordinance No, 7-2005 on first reading by title only.
City Attorney Walt Chidester spoke to this Ordinance. Section 31.02 of the Richmond Code
established certain Departments within the City Administration and Indiana Code 36-4-5-3
allows the Executive of the City of Richmond to insure efficient government of the City. In order
to ensure efficient government, it is necessary to terminate the existing Department of Planning,
Permits and Inspections and the Department of Community Development and Transit and in its

place, to transfer the powers, duties, functions and obligations of those Departments to a new
Department titled the Department of Metropolitan Development. Indiana Code 36-4-9-4 allows
the Legislative Body, upon recommendation of the Executive to establish Departments deemed
necessary to fulfill the needs of the community.
Councilor Lundy moved to suspend the rules and advance Ordinance No. 7-2005 to second
reading and read by title only with a second by Councilor Elstro. The motion carried with a
unanimous voice vote.

Council President Wissel declared Ordinance No. 7-2005 on second reading and public hearing.
There being no comments for or against the ordinance, Councilor Elstro moved for engrossment
of Ordinance No. 7-2005 with a second by Councilor Welch. The motion carried with a
unanimous voice vote.
Councilor Welch moved to suspend the rules and advance Ordinance No. 7-2005 to third and
final reading and read by title only with a second by Councilor Sharp. The motion carried with a
unanimous voice vote.

Ordinance No. 7-2005 was adopted with an 8-0 roll call vote.
ORDINANCE NO. 10-2005— AN APPROPRIATION ORDINANCE AMENDING ORDINANCE
NO. 65-2004 KNOWN AS THE 2005 SALARY ORDINANCE
The Clerk read Ordinance No. 10-2005 on first reading by title only.
Mayor Hutton explained that Ordinance No. 10-2005 would amend Ordinance No. 65-2004 (also
known as the 2005 Salary Ordinance). The changes would reflect the changes in the
Department structure and creation of the Department of Metropolitan Development.
Councilor Lundy moved to suspend the rules and advance Ordinance No. 10-2005 to second
reading and read by title only with a second by Councilor Elstro. The motion carried with a
unanimous voice vote.

ORDINANCE NO. 11-2005—AN ORDINANCE ADOPTING A NEW SCHEDULE OF RATES
AND CHARGES FOR SERVICES RENDERED BY THE CITY OF RICHMOND'S MUNICIPAL
ELECTRIC UTILITY, RICHMOND POWER & LIGHT
The Clerk read Ordinance No. 11-2005 on first reading by title only.
Richmond Power and Light General Manager Dave Osburn, reported that the Indiana Utility
Regulatory Commission has approved a 6.5% rate increase. Ordinance No. 11-2005 would
authorize RP&L to begin billing at the increased rate in April 2005.
Council President Wissel announced that Ordinance No. 11-2005 will be on second reading and
public hearing on March 7, 2005.
ORDINANCE NO. 12-2005—A GENERAL ORDINANCE AMENDING CHAPTER 150 OF THE
CITY OF RICHMOND CODE
The Clerk read Ordinance No. 12-2005 on first reading by title only.
Building Commissioner Wayne Jackson reported that Ordinance No. 12-2005 would amend
Chapter 150 of the City of Richmond Code. This revision would provide the City of Richmond
with a Building Code that not only complies with State of Indiana Law but better ensures proper
construction, alteration, use, occupancy, maintenance, demolition, moving and additions to all
buildings and structures, other than fences.
Councilor Welch moved to suspend the rules and advance Ordinance No. 12-2005 to second
reading and read by title only with a second by Councilor Sharp. The motion carried with a
unanimous voice vote.

Council President Wissel declared Ordinance No. 12-2005 on second reading and public
hearing. There being no comments for or against the ordinance, Councilor Elstro moved for
