HomeMy Public PortalAbout04-18-2005 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, APRIL 18, 2005 The Common Council of the City of Richmond, Indiana met in regular session Monday, April 18, 2005, in the Council Chambers in said City. President Bruce Wissel presided and the following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR KLOSE ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. Also present were members of the Centerville High School Government Class: Chris Rohe, Terra Paul, Brad Smoker, Powell Baumer, Mathew Rowe, Aubrey Maze, Tess Hardy, Ann Hamilton and Sean Robinson. Nick Williams of Boy Scout Troop No. 214 was also in attendance. APPROVAL OF MINUTES Councilor Parker moved to approve the minutes of the meeting of Monday, with a second by Councilor Sharp. The motion carried with a unanimous voice vote. COMMUNICATION FROM THE MAYOR The City has received a check from FEMA for $57,000 ± for overtime during the December 2004 snowfall. The first week of Neighborhood Clean-Up was in the South end of Richmond on April 16. Sixty- six tons of trash was picked up that day. The City crews are cleaning up loose ends on April 18 and 19. This effort will continue the next seven weeks. An itinerary for the Master Plan meetings was given to each Councilor. The Department of Permits and Inspections has found 101 parking lots which are not paved properly within the City limits. Notices will be mailed to the owners of these properties. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY The Minutes of the March 24 and 31 meetings were accepted as presented. REPORTS FROM STANDING COMMITTEES Street Tree Commission: Councilor Pappin announced that Pam Lotz, Department of Natural Resources was present on April 16 and presented the Commission with the Street Tree Award which the City of Richmond has received for 14 years. The Tree Line Award was also presented to the City. Common Council Minutes April 18,2005 Page 2 MISCELLANEOUS BUSINESS Council President Wissel thanked the members of Council who helped with the Northwest 5th Street clean up last weekend. This was part of the Adopt-A-Street program. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 24, 25, 26, 27 and 29- 2005 on first reading by title only and to read Ordinance No. 28-2005 in its entirety. There was a second by Councilor Sharp. The motion carried with a unanimous voice vote. ORDINANCE NO. 24-2005—A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM R-3 TO A SPECIAL USE DISTRICT The Clerk read Ordinance No. 24-2005 on first reading by title only. Ordinance No. 24-2005 is a petition to rezone to the Special Use District in an R-3 One to Eight Family Residents would change the zoning of property commonly known as 2000 East Main Street, from R-3 Zoning to a Special Use District in order to allow the owner to run a professional office from this location, namely to provide legal services. Ordinance No. 24-2005 was referred to the Plan Commission for public hearing at its meeting on April 28, 2005. ORDINANCE NO. 25-2005 -A SPECIAL ORDINANCE PROVIDING FOR A PLANNED UNIT DEVELOPMENT GENERALLY LOCATED SOUTH OF HIDDEN VALLEY DRIVE AND SOUTHWEST 15TH STREET TO BE USED FOR RESIDENTIAL PURPOSES The Clerk read Ordinance No. 25-2005 on first reading by title only. Ordinance No. 25-2005 is a petition to rezone to a Residential P.U.D. District, the properties owned by Ed Nicholson between Test Road and Southwest 15th Street which is currently a combination of R-2 One Family Residence District and 0-1 Greenbelt. The overlay zoning would allow the owner to develop 72 residential units while preserving the significant natural and historic resources of the site. Ordinance No. 25-2005 was referred to the Plan Commission for public hearing at its meeting on April 28, 2005. ORDINANCE NO. 26-2005—A SPECIAL ORDINANCE PROVIDING FOR A PLANNED UNIT DEVELOPMENT TO BE USED FOR RESIDENTIAL PURPOSES The Clerk read Ordinance No. 26-2005 on first reading by title only. Ordinance No. 26-2005 is a petition to rezone to a Residential P.U.D. District the properties at 2501, 2505 and 2515 East Main Street in an R-3 One to Eight Family Residence District. The overlay zoning would allow the owner to develop 12 residential units and 1 medical office facility. Common Council Minutes April 18,2005 Page 3 Ordinance No. 26-2005 was referred to the Plan Commission for public hearing at its meeting on April 28, 2005. ORDINANCE NO. 27-2005—AN APPROPRIATION ORDINANCE AMENDING THE 2005 BUDGET The Clerk read Ordinance No. 27-2005 on first reading by title only. Under Indiana Code 6-1.1-18-6, Ordinance No. 27-2005 is a request to amend the 2005 Local Road and Street budget by deleting $80,000 from Hot/Cold Mix (Account No. 210. 18.180.180.000.2363) and adding $80,000 to Street Improvements (Account No. 210.18.180.180.000.4331). Councilor Welch moved to suspend the rules and advance Ordinance No. 27-2005 to second reading and read by title only with a second by Councilor Lundy. The motion carried with a unanimous voice vote. Council President Wissel declared Ordinance No. 27-2005 on second reading and public hearing. There being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance No. 27-2005 with a second by Councilor Sharp. The motion carried with a unanimous voice vote. Councilor Lundy moved to suspend the rules and advance Ordinance No. 27-2005 to third and final reading and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 27-2005 on third reading by title only. ORDINANCE NO. 28, 2005—A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION The Clerk read Ordinance No. 28-2005 on first reading. A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION WHEREAS, the City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific purpose; and WHEREAS, the acceptance of a donation for a specific purpose constitutes the appropriation of such property for the intended purpose. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the following shall be accepted and gratefully acknowledged by the citizens of Richmond: The donation of funds to the Richmond Municipal Airport for a one day air show to be held in conjunction with the July 4, 2005, City fireworks event. The motion carried with a unanimous voice vote. Council President Wissel declared Ordinance No. 28-2005 on second reading and public hearing. There being no comments for or against the ordinance, Councilor Lundy moved for engrossment of Ordinance No. 28-2005 with a second by Councilor Sharp. The motion carried with a unanimous voice vote. Councilor Elstro moved to suspend the rules and advance Ordinance No. 28-2005 to third and final reading and read by title only with a second by Councilor Lundy. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 28-2005 on third reading by title only. ORDINANCE NO. 29-2005—AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS IN CERTAIN FUNDS The Clerk read Ordinance No. 29-2005 on first reading by title only. Ordinance No. 29-2005 is a request to amend the 2005 Budget and appropriate an additional $4,000 to the Haz-Mat Funds. Councilor Lundy moved to suspend the rules and advance Ordinance No. 29-2005 to second reading and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice vote. Council President Wissel declared Ordinance No. 29-2005 on second reading and public hearing. There being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance No. 29-2005 with a second by Councilor Parker. The motion carried with a unanimous voice vote. Councilor Lundy moved to suspend the rules and advance Ordinance No. 29-2005 to third and final reading and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 29-2005 on third reading by title only. CALL FOR ADJOURNMENT There being no further business, the meeting was adjourned.
