RESOLUTION NO. 96-35
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE
ABANDONING THE TOWN'S INTEREST IN THE SLOPE AND DRAINAGE
MAINTENANCE ELEMENT OF A RECREATIONAL EASEMENT
WHEREAS, the Town of Truckee has received a request to vacate and abandon a 20 foot
recreational and slope and drainage maintenance easement located on the rear property lines of lots
32, 50, 51 and 52 and along the east side property lines of lots 45 and 46 of the Glenshire
subdivision, Unit 2 (APN 40-100-18, 19, 20 and 22 and 40-090-09 and 20);
WHEREAS, the recreational element of the easement will be abandoned by the Glenshire
Devonshire Residents Association consistent with a future abandonment resolution adopted by the
Glenshire Devonshire Residents Association Board;
WHEREAS, said easement has not been used for the purpose for which it was dedicated or
acquired for five consecutive years immediately preceding this proposed vacation;
WHEREAS, the Town Engineer and the Community Development Director have reviewed
the proposed vacation and find the easement no longer necessary for public purposes; and
WHEREAS, Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code, Section
8335, et seq., provides a procedure for summary vacation of easements;
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TRUCKEE,
1. Summarily vacates and abandons the 20 foot slope and drainage maintenance
easement located along the rear property lines of lots 32, 50, 51 and 52 and along the east side
property lines of lots 45 and 46 of the Glenshire subdivision, Unit 2 as shown on Exhibit A;
2. Declares that from and after the date that this Resolution is recorded, the subject
easement no longer constitute a public easement; and
3. Instructs the Town Clerk to record this Resolution of Vacation of Public Easement,
pursuant to Section 8336 of the Streets and Highways Code.

The foregoing Resolution was introduced at a Regular Meeting of the Town Council of the Town
of Truckee, held on the 7th day of November, 1996, by Council Member Drake who moved its
adoption, which motion being duly seconded by Mayor McCormack was upon roll call carried and
the Resolution adopted by the following vote:
AYES: Council Members Drake, Eagan, & Mayor McCormack
NOES: None
ABSTAIN: Council Member Carpenter
ABSENT: Council Member Cross
