A RESOLUTION OF THE CITY, COUNCIL OF THE CITY OF LYNWOOD
AUTHORIZING THE MAYOR TO EXECUTE A ONE (1) YEAR AGREEMENT WITH
DAPEER, ROSENBLIT & LITVAK, LLP TO PROVIDE CODE ENFORCEMENT
ATTORNEY /CITY PROSECUTOR SERVICES
WHEREAS, the goal of the Lynwood Code Enforcement Program is to obtain
voluntary compliance with the regulatory provisions of the Municipal Code; and
WHEREAS, complying with the Municipal Code assists in maintaining and
enhancing the health, safety, and welfare of the community; and
WHEREAS, in an effort to avoid costly litigation and streamline the efforts of
Code Enforcement activities, thereby providing a more efficient and effective cost
recovery system, the Development Services Department is seeking legal assistance to
better implement the Code Enforcement activities; and
WHEREAS, for more than thirty (30) years, Dapeer, Rosenblit & Litvak, LLP
( "DRL ") has been successfully assisting cities to reduce blight, increase public safety,
and combat all types of nuisances; and
WHEREAS, DRL have helped municipalities establish cost recovery programs to
ensure the continued viability and vitality of such law enforcement efforts; and
WHEREAS, the Development Services Department feels that DRL will be able to
meet the needs of the City.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:.
Section 1. That the City Council of the City of Lynwood approves and authorizes
the Mayor or designee to execute agreement from Dapeer, Rosenblit & Litvak, LLP to
provide Code Enforcement Attorney /City Prosecutor Services, subject to approval of the
form of the agreement by the City Attorney. Such agreement shall include terms as
discussed herein and in the staff report accompanying this Resolution. Further, such
agreement shall contain a provision that ensures that the City of Lynwood receive rates
that are at, or better than, the lowest rates provided by Dapeer, Rosenblit & Litvak to its
municipal clients.
Section 2. That the City Council finds, as evidenced by a 4 /5ths vote or better,
that the execution of an agreement may be more economical and efficient if effected
through the use an alternate procedure, such that the City Council hereby approves the
exercise of the purchasing exemption authorized under Lynwood Municipal Code
Section 6- 3.13(a)(3).
Section 3. That the City Council authorizes the City Manager or designee to
transfer ($75,000) budgeted amounts for General Fund salaries and benefits for certain
vacant positions to the Professional /Contractual Services line item in the Development
Services Department as follows:
Development Services Department Legal Fees Expenditure Line — 1011.
General Fund Salaries and Benefits 50. 605.62001- $75,000
Line Item 1011.50.605.60005
($40,000) and 1011. 50.505.6001
($35.000)
Section 4. This Resolution shall go into effect immediately upon its adoption.
Section 5. The City Clerk shall certify as to the adoption of this Resolution.
